An interim US Attorney has a tenure of 120 days, post which if an attorney is not selected, the district courts can choose their replacement.

Why was Alina Habba removed?
New Jersey's judges said such a decision was according to the law and keeping in mind Alina Habba's lack of proper courtroom experience and notoriety for targeting particularly Democrats during prosecution.

Stating the judges had 'overstepped' their right by the replacement, AG Pam Bondi and the
DOJ reinstated Habba
as the attorney. They cited that Habba had broader public support.
Bondi, a well-known Trump loyalist, has been criticised for this action, however, her defence is that the judges showed a partisan retaliation when it came to judiciary action, implying such an act was not entirely improbable.
The federal judges invoked 28 US Code and 546 (D) to appoint a new attorney if no replacement was made in the 120-day period.
The DOJ contended that this was meant to be an executive action and not a business of the judiciary.
Post her 120-day period, federal judges of New Jersey replaced her with former deputy Desiree Leigh Grace.
Habba, known for her right-wing stance, with open comments such as 'New Jersey will soon be Red', has come to the scrutiny of federal judges and political mahouts.
Alina Habba's list of controversies
Habba has been the prosecutor for high-profile Democrat officials. One such person was Newark Mayor Ras Baraka and Representative LaMonica McIver.
Habba alleged that the mayor and her representative had 'trespassed', by organizing a migration protest.
Even, the federal judge of the case, commented that this was a 'worrisome step' and both Newark mayor and representative have accused Habba of being politically driven.
Habba, who has only had state level practice as a lawyer, has been criticised for her inexperience to handle contentious cases.
In the E Jean Caroll defamation case against President Trump, the judges commented on how the evidence was mishandled, and basic courtroom procedures, which are taught in the first year of law school, were not followed.
Disturbing workplace accusations
In 2022, she was allegedly suspected to have pressured an employee of the Trump National Golf Club to sign a non-disclosure agreement, contrary to the wishes of the employee and lack of proper explanation as to why such a move took form.

Bryan Kohberger was directly addressed by the family members of the victims he killed. For the first time Wednesday, Bryan Kohberger, who murdered for University of Idahoi students inside their off-campus house in November 2022 in a bone-chilling incident, came face to face with the families of three of the victims -- — Madison Mogen, 21, Kaylee Goncalves, 21, and Xana Kernodle, 20 — who are giving impact statements that are expected to last all day. Parents of Ethan Chapin, 20, said they recently found 'big-time closure' and will not attend the sentencing. Kaylee Goncalves' father Steve Goncalves told Kohberger he was so stupid to leave the lazy trail of evidence that he was found to be the culprit within minutes. "You were that foolish, that careless, that stupid," Goncalves said, explaining how police told him Kohberger's DNA was found "within minutes" along with footage of his car arriving and leaving the scene of the crime. "We knew from the very beginning we had you," the father said. The case drew nationwide attention due to its chilling nature and the lengthy, intense investigation that followed. On November 13, 2022, the four students were found fatally stabbed. The crime scene was horrific, and the small college town was left shaken. Investigators recovered a knife sheath at the scene with his DNA on it, and used genetic genealogy, comparing DNA from a Q-tip found in his family's trash, to confirm the match. Authorities also noted that he cleaned out his vehicle and apartment meticulously, suggesting a cover-up attempt. Kohberger was arrested at his parents' home in Pennsylvania on December 30, 2022, and extradited to Idaho in early 2023. Kohberger pleaded guilty to the stabbing and already agreed to accept four consecutive life sentences as part of a plea deal that allows him to avoid the death penalty. But after all these years of investigation, the motive of the brutal murder is still not known. It is not known whether Kohberger will speak at the sentencing.

A 60 day grace period to remain in US after a layoff is no longer sacrosanct for H-1B workers
Several laid-off H-1B workers are receiving notices to appear (NTAs)– the first step in the deportation proceedings, even while the 60-day grace period of authorised stay has not expired. Sameer Khedekar, immigration attorney and founder of Vanguard Visa Law explained, 'Upon lay-off a 60-day grace period is available to an H-1B visa holder who either transfers the H-1B status to a new employer or applies to change his/her visa status (say to a dependent visa) before the grace period ends. However, increasingly the Department of Homeland Security is sending NTAs in immigration courts. This is happening even when the laid-off H-1B worker has a change of status application pending. ' The notice points out to the date of withdrawal of the H-1B visa by the erstwhile employer and states that the individual has stayed in the US for longer than is permitted, he explains. Rajiv S. To illustrate: An H-1B worker, who timely filed an I-539 application to change status to B-2 visitor within their 60-day grace period, received an NTA before a decision was made on the I-539. 'This contradicts guidance issued by the US Citizenship and Immigration Services (USCIS). In other words, if you have a properly filed, non-frivolous application pending, you should be considered in 'authorized stay' for unlawful presence purposes. Despite this, we are seeing a significant volume of NTAs," states Khanna. According to USCIS's recent release their screening and vetting efforts have led to approximately 1,840 NTAs a week since Feb 2025. Many of these appear to be issued in circumstances that raise serious questions about adherence to stated policy, adds Khanna. USCIS under the Biden administration had issued guidelines for laid-off workers, which included changing status during the 60-day grace period. It had pointed out that status can be changed to that of a dependent if the spouse holds an H-1B or L-I visa. Other possible non-immigrant options include change of status to that of a student visa holder (F-1) or obtaining visitor status (B-1 or B-2 visas). This guidance has been achieved and no fresh guidance has been issued. When an NTA is filed with the immigration court, removal proceedings commence and unlawful presence is triggered which has serious consequences. For now, in addition to the loss of a job, laid off H-1B workers have the looming threat of deportation proceedings.
