Freedom Of Speech Doesn't Extend To Insulting The Prime Minister: Allahabad High Court

The Allahabad High Court recently denied bail to a man accused of sharing edited social media posts that mocked and disrespected Prime Minister Narendra Modi, stating that the constitutional right to free speech does not include the liberty to insult the nation's Prime Minister.
Justice Arun Kumar Singh Deshwal, while dismissing the bail plea of Asharaf Khan alias Nisrat, observed that such posts go beyond criticism and amount to a threat to national harmony and dignity. 'Freedom of speech and expression does not stretch to permit a person posting videos and other posts disrespecting the Prime Minister of India," the court ruled.
According to the prosecution, Asharaf Khan had posted heavily edited and objectionable videos on Facebook during the recent India-Pakistan conflict. One of the videos allegedly portrayed Prime Minister Narendra Modi walking beside a donkey pulling an aircraft cart. Another showed the Prime Minister seeking forgiveness from Pakistan. The posts were accompanied by captions mocking India's military position and praising Pakistan's armed forces. It was further shown that the Wing Commander of Indian Air Force, Ms. Vyomika Singh was sitting with Pakistan's Army Chief. The material, authorities claimed, also included disparaging references to Defence Minister Rajnath Singh.
The state opposed the bail plea on the grounds that such content not only dishonored the country's leadership and armed forces but also had the potential to sow discord among communities. 'Such kind of post on social media creates disharmony among people of India and shows disrespect to the Indian Military," the state argued.
In defense, Asharaf's lawyers contended that the posts were not authored or circulated by him. They argued that the material was found on his mobile phone but had originally been sent by someone named Shahrukh, who had asked others to share it further. The defense maintained that Asharaf was not involved in creating or forwarding the content and had been wrongly implicated. He has been in custody since May 13, 2025.
The court, however, was not convinced. It warned of the increasing trend of misusing social media under the pretext of free speech to attack high constitutional functionaries. 'It has become a fashion among certain groups of people to misuse social media in the garb of freedom of speech and expression by making unfounded allegations against high dignitaries," the court observed.
Stressing the seriousness of targeting the Prime Minister in such a derogatory manner, the judge held that posts of this nature not only undermine the respect for constitutional offices but also encourage the separatism and endangers the sovereignty, unity and integrity of India.
Thus, rejecting the bail plea, the court concluded that the objectionable content posted by the applicant did not warrant any leniency. 'This Court does not find a fit case to enlarge the applicant on bail, at this stage," the order stated.

Both fighter aircraft are used by the Indian Air Force. Now, Russia wants to sell India the fifth-generation fighter aircraft Su-57 as well as the 4.5-generation Su-35. But New Delhi has not revealed its interest in either of the aircraft. Recently, a senior Egyptian military officer has highlighted several technical problems in the Made-in-Russia Su-35 fighter jet, which has raised concerns for the countries that wanted to buy it. The officer said that Egypt has cancelled its 2018 deal to buy Russian Su-35 fighter jets, as several technical problems were found during investigation. Following the Egyptian military officer's revelation, questions are being raised about whether this is the reason why India is not buying this aircraft? What Was The Deal Between Egypt And Russia? In the year 2018, Egypt signed a USD2 billion deal to buy 24 Su-35 fighter jets from Russia. This deal was considered as Russia's major defence success in the Middle East. But in 2020, the deal between Egypt and Russia went into cold storage. Notably, Russia's Su-35 is a 4.5 generation multirole fighter jet and is loaded with several high-tech weapons and radar systems. But now, a senior Egyptian military official has stated that the deal for Su-35 was cancelled, keeping in mind technical flaws and strategic needs. He said that the Radar, engine and electronic warfare in Su-35 are weak. Apart from this, Egypt was also under pressure of sanctions under the United States CAATSA Act. Why Egyptian Military Officer Saying This? The military officer said that when the Egyptian Air Force conducted a technical examination of this aircraft, they found that the Irbis-E radar is technically weak. It is based on the old-fashioned PESA (Passive Electronically Scanned Array) technology. As compared to US's F-35 and France's Rafale, they use AESA (Active Electronically Scanned Array) radar. Notably, AESA radar is considered more efficient because it is less prone to jamming during electronic warfare. Apart from this, the Egyptian Air Force also found that the Su-35's electronic warfare system is weak in comparison to modern warfare. As per the Egyptian Air Force this warfare system cannot withstand today's electronic countermeasures. The AL-41F1S engine used in Su-35 consumes more fuel and leaves high thermal and sound signatures, limiting the capabilities of the aircraft. These engines are powerful but generate high heat and sound signature due to which they are exposed to infrared and radar systems. Not Suitable For Defence Doctrine Of The Egyptian Air Force The defence doctrine of the Egyptian Air Force is based on operational independence, especially in conflict-prone region, such as air strikes in Libya or rebellion in Sinai. The Su-35 fighter jet depends on AWACS (Airborne Warning and Control System) in order to perform on its full potential. This is against Egypt's strategy of 'independent decision-making ability'. If we talk about France's Rafale jet, it has advanced capabilities like RBE2 AESA radar and SPECTRA electronic warfare system, making it capable of operating without external support. This is also a reason why Egypt cancelled the deal with Russia. US Threatened Egypt The US threatened sanctions against Egypt under the CAATSA act, jeopardising over USD1 billion in annual military aid if Egypt purchased Russian fighter jets.

Undetectable by enemy jammers, it is designed for high precision targeting. Key feature is its deep-penetration warhead, capable of destroying targets hidden in bunkers. The missile is compatible with Su-30 MKI fighter jet, with a capacity of 4 missiles per aircraft. This allows for targeting of multiple locations from a significant distance. How Much Does Lora Missile Cost? As per reports, Air Lora missile costs less than other comparable weapons systems. As the official price remains undisclosed, it is estimated that the missile costs below USD1 million (approx Rs8 crore). If we compare its price with BrahMos, a fraction of the BrahMos missile's cost Rs 34 crore. This is also cheaper than Agni 5 (estimated at Rs50 crore).
