Legal battle brews between KwaZulu-Natal premier and former director-general over resignation retraction

A legal storm is brewing between KwaZulu-Natal Premier Thamsanqa Ntuli and former director-general, Dr Nonhlanhla Mkhize, over her reinstatement after her resignation.
Mkhize resigned with immediate effect earlier this month; however, five days later, she retracted her resignation, arguing that she was under duress because of the incident of alleged intimidation by a youth director in the Office of the Premier, whom she claimed had threatened her.
However, Ntuli argued that since he had already accepted the resignation, in terms of the Public Service Act, she cannot retract the letter and could only reapply when the position is advertised.
Mkhize disagrees with this interpretation, and her lawyers have sent the premier a letter of demand.
In the letter that was seen by Independent Media and confirmed by the Premier's Office, Mkhize's attorneys demand that the premier respond to the retraction letter from their client.
'Our instructions are to request the acknowledgement of the receipt of our client's retraction letter of resignation and also respond within seven days,' read the letter.
In the letter of retraction, Dr Mkhize cited the incident between her and the youth director as a reason for her resignation. She said the letter was sent after being traumatised by the event that took place, which she described as insolent and unlawful conduct by the youth director.
'I was left severely traumatised by the incident. The matter has been taken under consideration, and I have since the incident received professional psychological counselling. Having filed a criminal case and recorded the incident for the honourable Premier's consideration, I am now feeling more confident of my safety; therefore, wish to retract the resignation letter and continue with dedicated years of service to the public. I request the honourable Premier to accept the withdrawal of the resignation,' read the letter.
The premier's spokesperson, Bongani Gina, said the letter from Dr Mkhize's attorneys is under review.
According to legal expert Advocate Bo Dlamini, the premier has no legal standing in the matter, and Dr Mkhize was legally entitled to rescind her resignation letter because she filed it in response to purported threats of violence.
'Now that it looks like there was a threat to her life when she submitted the letter of resignation, the employer is bound to accept the retraction since she resigned under duress. If the matter goes to court, chances are that she will win,' said Advocate Dlamini.
In a statement, Ntuli announced that his office is investigating the matter even though Youth Director Melusi Ndima has resigned.
He dismissed the insinuation that he did nothing to act against the allegations, which were described as having elements of gender-based violence, saying the investigation was instituted immediately after it was reported to him.

They said SAFA's lack of transparency made it difficult for them to recommend that the Ministry of Sports allocate further funding to the organisation. The association's latest financial report showed only R356 million in sponsorship revenue. Broadcast income from the SABC, which is itself under financial strain, remains minimal. Now Mkhize has come out in support of Jordaan and Hluyo, arguing that hiding the figures is actually in football's best interest. Speaking to Ukhozi FM, Mkhize said the numbers would shock the public and attract criticism that could damage the sport. 'I think it was the right decision not to reveal the amounts sponsored to the association because it's embarrassing if we're to hear the amount football gets sponsored,' said Mkhize. 'If people and the media knew the figures, there would be no questions of where the money is going — because it is so little.' 'We've asked these questions before, but we wanted to hide under tables when we heard the numbers,' he added.

14 more charges added, but ‘most wanted' is nowhere to be found

Image: Armand Hough / Independent Media WHILE the State added a host of new criminal charges against Vuyolwethu 'Yesu' Tshukela, bringing the total to 18, the Athlone Magistrates' Court heard on Thursday that his exact whereabouts were temporarily unknown. Alleged taxi hitman, Tshukela, was arrested last month in Welkom in the Free State after months on the run, initially facing four charges. These included murder, attempted murder, and extortion. However, the State revealed on Thursday that after consulting with a senior advocate, 14 more charges were added. Among them are kidnapping, robbery, assault, intimidation, malicious injury to property, arson, and a second count of attempted murder, this time allegedly involving a security officer. That has now changed to 14 additional charges being added after consultation with the State advocate.' Before proceedings began, court orderlies informed the State that Tshukela had not been brought to court. A police officer explained that when he went to Pollsmoor Correctional Facility in the morning, Tshukela was not there and had been moved the week before to another facility, due to safety concerns, but no one seemed to know which. 'The accused is not before the court, Your Worship. He wasn't brought from Pollsmoor this morning,' the prosecutor said. The State confirmed that arrangements had since been made with Pollsmoor officials to ensure the accused is present at his next scheduled appearance. The prosecutor added: 'Due to the higher risk posed by the accused, he is not kept at Pollsmoor. However, after speaking to the chief at Pollsmoor, arrangements have been made for him to be brought to court next time.' The court heard that Tshukela's legal representative had been consulted on Thursday morning and indicated that the accused would be abandoning his bail application. However, this could not be confirmed due to his absence. Magistrate Keith Le Keur expressed concern about Tshukela not being in court, highlighting the procedural importance of the accused being present. 'But the only reason he is not here must be in terms of Section 159(3)(c) of the Criminal Procedure Act, for example, if he were in hospital. There must be a medical certificate,' said Le Keur. 'Pollsmoor cannot simply decide to keep him there arbitrarily. Under normal circumstances, I would have postponed it to the next day to have him here and then roll the matter in his presence. The proceedings must happen in the presence of the accused.' The State asked that a J7 warrant be issued for Tshukela in absentia and for the matter to be remanded. 'Your Worship, a date has been arranged with Mr Ntsindane for July 18. The State requests that the matter be remanded to that date, for the accused to be before the court as well as his attorney.' The magistrate agreed and postponed the case to July 7. KZN Premier addresses cross-border crime at Kosi Bay Border Post
KwaZulu-Natal Premier Thami Ntuli conducted an inspection at the Kosi Bay border to view cross-border security measures recently. Image: KZN Government KwaZulu-Natal's border zone of Kosi Bay has been plagued by vehicle hijackings, cross-border smuggling, drug trafficking, human trafficking, and the illegal movement of goods and persons. These were the sentiments shared by KZN Premier Thamsanqa Ntuli during an oversight visit to the Kosi Bay Border Post, a key point of entry between South Africa and Mozambique last week. Ntuli is also the Executive Authority for the Department of Community Safety and Liaison in the province. His delegation inspected Border Gates 6 and 8, in collaboration with the Border Management Authority (BMA). He stated that Kosi Bay remained a key point of vulnerability, as criminal syndicates operated across the border, and that his department had taken steps to enhance integrated border management and improve inter-agency coordination. Ntuli stated that the Kosi Bay inspection was part of the provincial government's Safety Turnaround Strategy, which is a multi-sectoral approach to tackling crime hotspots, enhancing the effectiveness of law enforcement, and improving coordination between government entities in high-risk areas. Next Stay Close ✕ During the inspection, Ntuli was accompanied by Thembeni Madlopha-Mthethwa, the KZN MEC for Agriculture and Rural Development. Both held direct engagements with frontline officers, including the SAPS, South African National Defence Force (SANDF) troops, and BMA officials. The team evaluated existing infrastructure, patrol operations, surveillance systems, and identified areas requiring urgent attention. Madlopha-Mthethwa called for improved collaboration across all levels of government. 'Cross-border crime not only threatens community safety, but also undermines economic development and regional cooperation. This visit sends a clear message that KwaZulu-Natal will not be a haven for criminal operations,' she said. The delegation acknowledged the tireless work of local community safety structures that mainly operated under difficult conditions to protect their communities from criminal syndicates. 'These community structures are the true heroes. They risk their lives to safeguard others, and it is our responsibility to support and empower them,' Ntuli said. During the visit, Thembinkosi Khumalo, mayor of the uMhlabuyalingana Local Municipality, handed over a surveillance drone to be used by the BMA, SAPS, and community crime-fighting forums. Said Ntuli: 'This drone will significantly enhance aerial patrol capabilities and allow for real-time monitoring of vulnerable border zones.'
