Abide by audit deadlines or face more assessments, urges LHDN

The Star09-07-2025
KUALA LUMPUR: The Inland Revenue Board (LHDN) has advised taxpayers to respond within the stipulated timeframe during a tax audit.
LHDN senior assistant director Rohaizad Abd Fandi said failure to do so will be deemed as a lack of supporting documentation for the claims made, which may result in them being disallowed and additional assessments being issued.
'Any ineligible claim or claim that cannot be substantiated with valid evidence constitutes an offence under the Income Tax Act 1967.
'A Notice of Additional Assessment will be issued, and the taxpayer will be required to settle the amount within the prescribed period,' he said during an appearance on Bernama Radio's Klinik Cukai segment titled 'Kena Audit? Tenang dan Fahami Dahulu Proses dan Kepentingannya'.
Rohaizad said many taxpayers still view audits negatively, with some reacting in panic.
He stressed that tax audits are a routine process to verify the accuracy and transparency of information submitted in tax returns.
Rohaizad advised taxpayers to remain calm when selected for an audit, to first understand the contents of the notice issued and to contact the nearest LHDN office or attend in person to seek further clarification.
'Taxpayers have clear rights during the audit process, including the right to be formally notified before an audit is initiated,' he said, Bernama reported.
Taxpayers are also entitled to a reasonable period to prepare the required documents, to request an extension formally and to file an appeal if they disagree with the audit findings, he said.
Rohaizad added that taxpayers may seek assistance from qualified tax agents, especially for large-scale businesses with complex financial structures involving numerous transactions or multiple income sources.
He said tax audits may vary depending on the type and complexity of the case. As such, taxpayers are advised to fully cooperate throughout the process and ensure all relevant supporting documents are properly maintained.
He also reminded taxpayers to settle any outstanding taxes as instructed to avoid legal action, including the possibility of travel restrictions.

[UPDATED]: MACC questions 27 witnesses in scrap metal, e-waste smuggling probe

KUALA LUMPUR: The Malaysian Anti-Corruption Commission (MACC) has questioned 27 witnesses in connection with its operation against a syndicate involved in the smuggling of scrap metal and e-waste across five states. The syndicate is believed to have bribed enforcement officers, resulting in a loss of export tax revenue estimated at more than RM950 million. According to a source, one of the suspects believed to be involved in the activities was also questioned today. "However, no arrests have been made so far. "To date, the MACC has frozen a total of 324 bank accounts, 142 belonging to companies and 182 to individuals, involving nearly RM150 million, with seized assets amounting to approximately RM183 million. "In total, the value of seized and frozen assets now stands at more than RM332 million," the source said. Meanwhile, MACC Special Operations Division senior director, Datuk Mohamad Zamri Zainul Abidin, when contacted, confirmed the information and said that the MACC is still in the process of identifying suspects linked to the syndicate, which has caused the government to suffer export tax losses of more than RM950 million over the past six years. He added that the MACC is currently scrutinising the financial sources of the suspects and the companies under investigation in collaboration with agencies such as the Inland Revenue Board (LHDN), Royal Malaysian Customs Department (JKDM), and Bank Negara Malaysia (BNM). "In addition to investigations under Sections 16 and 18 of the MACC Act 2009, as well as offences related to money laundering, probes are also being conducted under the Income Tax Act 1967 and the Customs Act 1967 by the relevant agencies involved in this operation," he said. It was reported that three bungalows, a penthouse, shop lots, land, oil palm plantations, luxury cars, and luxury watches are among the assets seized, estimated to be worth more than RM183 million, following a raid on a scrap metal smuggling syndicate across five states that began yesterday. According to sources, the raids under Op Metal were carried out by the Special Operations Division of the MACC in collaboration with the Customs Department, Inland Revenue Board, and Bank Negara Malaysia. The operation also saw the freezing of 45 company accounts and 82 individual bank accounts involving a total value of about RM51 million. The source added that during the raid, the MACC also seized five luxury watches, namely Patek Philippe, Tag Heuer, Rolex, Omega Speedmaster and Omega Seamaster, estimated to be worth more than RM740,000. The MACC also conducted searches at 13 new locations in Penang, Kedah, Johor and around the Klang Valley on July 15.

Sarawak to kick off reforms to make business registrations quicker, easier, Dr Sim announces

SIBU: The Sarawak government will launch a pilot project aiming to reform the business registration process in the state, beginning August 1, 2025, and until the end of February 2026. The initiative to make business registrations faster and easier will be trialled in the Sibu and Kanowit districts over a six-month period, Deputy Premier Datuk Amar Dr Sim Kui Hian announced. Speaking at a press conference on Monday (July 21), Dr Sim, who is also state Public Health, Housing and Local Government Minister, said the time required to register a business would be reduced from over 60 working days to between 14 and 30 working days. He emphasised that this reform is essential for boosting business activity in Sarawak and positioning the state as a more attractive and investor-friendly destination. The pilot project is intended to help Sarawak maintain its competitiveness as an investment hub, offering administrative efficiency, predictability in processes, and robust government support for the business community. Currently, registering a business in Sarawak involves multiple government departments and agencies — including the Inland Revenue Board (LHDN), district offices, divisional treasury departments, and local authorities — resulting in an often inefficient and time-consuming process, he explained. Under the new initiative, all business registrations — including Business Name Registration, Trade Licence, and Operating Licence applications — will be handled by a single agency: the local authorities in Sibu and Kanowit, through a one-stop facilitation centre. "Applicants will only need to complete a single form that captures all required information for Business Name Registration, Trade Licence, and Operating Licence applications," Dr Sim said. The pilot project targets a processing time of 14 working days — from application to licence collection — for low-risk businesses. 'For businesses requiring only a business name and trade licence, the licence can be collected within five working days,' he added. This timeline, however, applies only to applications that include all the necessary supporting documents and meet the required checklist criteria. Dr Sim also stressed that applications for high-risk businesses — such as those involving the sale of gas, entertainment centres, care centres for the elderly or children, and reflexology centres — will be processed within 30 working days, as these require input from multiple government agencies.
