Fair Work non-compliance rife among farm labour providers in Adelaide Hills and Riverland
The report, released last week, details investigations in 15 "high-risk" Australian regions where non-compliance was reported to the FWO.
From December 2021 to April 2024, the FWO inspected 360 sites across the nation, issuing $760,405 in fines to employers who failed to meet pay slip and record-keeping obligations.
Properties were inspected in South Australia's Adelaide Hills and Riverland regions.
Investigators found 92 per cent of the audited labour hire providers in SA were non-compliant, with strawberry and citrus producers having some of the highest non-compliance rates in the state.
According to the FWO, workers interviewed at a South Australian strawberry farm told inspectors they were paid in cash and did not receive pay slips.
The employer was a labour hire firm that "didn't provide any employee records to the FWO" and was issued with multiple infringement notices amounting to more than $12,500.
Speaking with Narelle Graham on ABC SA Regional Drive, Fair Work Ombudsman Anna Booth said it was common for labour hire providers to not supply wage records or pay slips and to be uncontactable.
"Labour hire is, unfortunately, notorious for the kind of breaches that we found," she said.
The investigation also uncovered 10 labour hire providers operating at one South Australian strawberry farm.
Of those, three refused to engage with the FWO when it asked for records. Workers, the report says, were paid between $19 and $25 per hour in cash.
Six infringement notices totalling $28,860 were issued to five labour hire providers operating at the property.
The FWO also made unannounced site inspections in SA involving a network of labour hire businesses suspected of illegal phoenix activity.
According to AUSTRAC, illegal phoenix activity occurs when a company liquidates its operation to "avoid paying its creditors, taxes and other regulatory payments", only to later reappear as a newly created company with the same directors.
Workers and managers in the Adelaide and Riverland region had accused "various enterprises" of failing to meet taxation obligations and not paying superannuation on behalf of employees.
The FWO report says it was also tipped off about three suspected phoenix labour hire providers in the state's Riverland region operating without a licence.
Citrus Australia chief executive Nathan Hancock said illegal phoenix activity had been occurring "for a long time".
"I think it's wrong and we need to get it out of our industry," he said.
Mr Hancock said many horticulture industries wanted a national labour licensing scheme that protected all labour hire workers from "bad actors".
"The loopholes that are created by the lack of such a regulation mean people are getting away with exploiting their fellow man, which is really disappointing," he said.
Employment and Workplace Relations Minister Amanda Rishworth said the federal government remained "committed" to implementing national labour hire reform.
"[We] will continue to work with state and territory governments on pursuing a national approach," she said.
"National labour hire reform will be on the agenda for the next meeting of state and territory ministers, which will be convened as soon as practicable."
Ms Booth said while the "very high" breach areas would be prioritised and revisited during the next two years, it will continue to stamp out bad behaviour across Australia.
"If we get any intelligence or any referrals from any other regulators with whom we work with, or we get any workers ringing us up, we will be there," she said.

South Australian maximum security inmate's grim act in isolation cell

This section is subjected to the highest and strictest security because it is home to the state's worst criminals — serial killers and rapists and white supremacists spend time here. Aboriginal Liaison Officer Melanie Turner, who also spent time with Barnes in G Division, also confirmed the grim details to Both said Barnes is suffering greatly while being confined to his cell 23 hours a day with 'no TV and no entertainment' and has attempted to take his own life on multiple occasions. Compounding the problem, they say, is a recent decision by the South Australian Department of Corrections to ban both Uncle Moogy and Ms Turner from visiting the inmate again. 'He's got a lot of problems. If you're in jail, you're not there for being an angel,' Uncle Moogy said. 'But he's got problems because of how he was getting treated.' That treatment, according to Ms Turner, could lead to another Aboriginal death in custody. Ms Turner, who was employed by the Department of Corrections, has written a letter to David Brown, the Corrections CEO. In it, she expresses her 'deep disappointment and frustration' at being 'hindered in performing my role as an Aboriginal Liaison Officer at Yatala Labour Prison'. 'You may be aware of the recent ban on ALOs from accessing G Division, where prisoners are at their most vulnerable and require ALO intervention,' she wrote. 'This decision was made ... without consulting intervention staff, correctional officers or management. 'In the past few weeks, a long-term prisoner (Barnes) in G Division has self-harmed and attemped suicide twice. 'He pleaded ... to see me for ALO intervention. I emailed my manager to request permission to enter G Division to meet with this prisoner, with whom I have established a good rapport, but I was denied.' She says it was 'heartbreaking and soul-crushing' that she is unable to fulfill a role designed at preventing Aboriginal deaths in custody and that Barnes has not been told why she cannot visit him. 'This poor individual believes that his ALO support network has abandoned him,' she wrote. Uncle Moogy told Barnes 'is in a bad way mentally' and was benefitting from his visits. 'I went up there to talk about culture, where he's from, the traditional ways. And I found out he's connected to my way, too,' he said. 'It was working out well. He enjoyed me going there, talking to him once a week. We're both connected to the Adnyamathanha people from the Flinders Ranges.' He is worried what Barnes will do now that he's stop visiting. The crime that landed Barnes behind bars at G Division was a violent one that involved throwing a cup of urine in the face of a prison officer at Port Augusta prison in 2021. The Adelaide Advertiser reported last year that Barnes was jailed for over a decade after a brawl that left his victim in hospital suffering a fractured eye socket and requiring surgery. Less than a month while at the Adelaide Remand Centre, Barnes attempted to bite off his own finger, the Advertiser reported, before a corrections officer pinned his arms. Barnes punched him to the left side of his body and ear, causing it to bleed and yelled 'I'm going to f***ing bite your ear off'. He reportedly used a metal pipe from a vacuum cleaner to hit an officer over the head three times. Barnes pleaded guilty to multiple offences, including causing harm with intent and assaulting an emergency worker. At his sentencing, District Court Judge Paul Slattery said Barnes was at 'extreme risk' of becoming institutionalised. 'Unfortunately, the combination of your criminal history, ongoing struggles with mental health and propensity to violent behaviour reveals a high risk of recidivism,' he said. He will not be eligible for parole until at least 2027. 'If he (takes his own life), he doesn't get out then,' Uncle Moogy said. He, along with Ms Turner, organised a meeting with the South Australian Attorney General Kyam Maher last week. Uncle Moogy said he was determined to advocate for Ms Turner to 'get back to her job'. 'I think it'd be good if she went back. She's got that boy on her mind the whole time.' has approached the South Australian Department of Corrections for comment. In a statement, a spokesperson said 'cultural support from Aboriginal staff ... continues to be part of the multi-disciplinary service to Aboriginal prisoners placed in the maximum-security unit. 'Aboriginal Liaison Officers perform their duties across the prison based on guidance by the General Manager and senior Managers. Where appropriate, this service includes seeing prisoners in the maximum-security unit. 'DCS values the contribution Elders make to our prisons, including site visits.' The spokesperson said prison officials had 'been seeking a meeting with Uncle Moogy to discuss his concerns and to make sure he can continue his important work and support'. The Department did not respond to specific questions about Barnes' self-harming or his suicide attempts.

‘Makes no sense': South Australian ban exposed
Soy milk, rice cakes and ham salad sandwiches aren't usually the first things that come to mind when you think of 'junk food'. Yet, here we are, in the first week of the introduction of the South Australian food and beverage advertising bans on government assets, still debating what has been banned and what has not. Confusion and uncertainty reigns as businesses, the public and even nutritionists are scratching their heads as to why everyday nutritious food and drinks have been caught by the ban and whole groups of food are permitted. Let's look at the facts. Under these new rules, everyday products like some soy milk, oat milk and rice cakes are banned from appearing in advertising on South Australian government assets. This is because these products contain small amounts of added sugar and that is enough to land them on the blacklist. Under the new regime, if any sugar is added, it is banned. That means a number of plain, unflavoured soy milks with only 1 gram (per 100ml) of added sugar cannot be advertised. On the other hand, according to the South Australian Government Implementation Guide, all condiments (including dips), and all jams and spreads are considered acceptable. Ham salad sandwiches were banned. Then they were not – if the ham was incidental to the advertisement. But, you need to submit the advertisement to a departmental panel for approval, creating more unnecessary bureaucratic red tape. Sound confusing? It is. This simply doesn't pass the pub test and is creating confusion and uncertainty for business and the community. We agree with the government that this needs a commonsense approach. The problem is the current approach doesn't make any sense. The fact that we are still having this conversation about which foods are objectively healthy and which are not, points to the flaws in this policy. All the industry is asking for is a credible independent nutritional test that creates certainty about what food and beverages are permitted to be advertised by the South Australian government. The industry is not asking for a free pass. We are asking for a fair go. That is why we are calling on the South Australian Government to adopt the Food Standards Australia New Zealand (FSANZ) Nutrient Profiling Scoring Criteria – a nationally consistent, scientifically rigorous framework – developed by an independent government agency under the Federal Government Department of Health. It is already used by all States and Territories as a credible tool to assess the nutritional value of food. The next step surely is collaboration. The industry, public health experts, and government need to come together to empower Australians to make healthier choices – not through ad bans and confusion, but through smart policy, positive messaging, and evidence-based regulation. The food and beverage industry is already taking steps to help consumers switch to healthier options through product innovation and reformulation. Australia also has some the strictest rules in the world around food and beverage advertising, which effectively ban the advertising of unhealthy food to children, across all advertising and all media, at all times. So here is our ask: pause and review this broken system and replace it with a better one based on nutritional science. Let's work together to promote healthier choices, through clarity, consistency and commonsense without throwing healthy foods under the bus. And let's put an end to policies that confuse the public and businesses and, fail to deliver results. Because if soy milk and rice cakes are the enemies in this fight against obesity, we are targeting the wrong culprits.

SA government approves rezoning for high-rise housing in Glenside redevelopment
The South Australian government has approved a developer's controversial bid to build apartments of up to 20 storeys in Adelaide's inner-eastern suburbs. The decision, announced by Planning Minister Nick Champion on Friday, will see parts of the former Glenside Hospital site upzoned from eight to 20 storeys — an unprecedented scale for development outside the Adelaide CBD. The land, situated near the corner of Fullarton and Greenhill roads on the edge of the south-eastern parklands, was acquired in 2016 by developers Cedar Woods for $25.8 million. Cedar Woods has gradually redeveloped the site with townhouses and an eight-storey apartment block. But the company argued 20 storeys was necessary to allow the Glenside development to reach "its full potential" and applied in December 2023 to amend the planning code. Mr Champion, who is the final decision-maker on planning code amendments, said the rezoning would allow up to 200 more homes to be built. He added that there was "quite a bit of [housing] density" on the site already. "To my mind, having a bit more density of high amenity and high value on this site will actually bring a lot of positive to it," he said. "I think in time people will see that this was the right decision even if in the run up to it they had concerns about it." The company welcomed the government's decision today and said it could add up to 200 homes to the existing plans for 1,000 homes on the site. "This amendment is relevant to the development of a cluster of four buildings within the precinct," Cedar Woods chief operating officer Patrick Archer said in a statement. "Cedar Woods is proposing one building out of the four to be up to 20-storeys, with the others cascading down to lower heights that will be determined through the design process." The rezoning proposal has not been without controversy, with a group of nearby residents forming a "Glenside Development Action Group" opposing the rezoning. They have argued a 20-storey apartment block would lead to overshadowing of their properties and place strain on "already inadequate local infrastructure". Glenside resident Deborah Munro, who is part of the group, said she would have thought twice about buying her apartment two years ago if she knew of plans for taller builds. "We chose carefully so there won't be a building, on our understanding, in front that would obstruct our view," she said. Local MP Jack Batty said the government has "ignored" the wishes of the community. "It's quite simply unfair for the thousands of people who've bought into this development on the basis of a very different plan," he said. Another resident and action group member, Craig Pickering, said his main concern was local traffic. "People who come visit me at my apartment building … they park at Foodland car park because they can't park in my street or anywhere near it because there's no parking available," he said. Mr Champion said he took the views of everyone into account when making his decision. "It'd be fair to say there was a lot of commentary and a lot of submissions and a lot of feedback," he said. "I weighed all of that in the decision I made and obviously the department did too. "We do take notes from submissions, and many of the issues around infrastructure or traffic will be dealt later by the State Planning Commission." Cedar Woods will still have to seek approval from the State Planning Commission for its final development proposal. Its chief operating officer Patrick Archer said the decision followed "a thorough consultation process" which included community feedback. "The successful outcome of this amendment aligns with South Australia's Housing Roadmap and is intended to create additional high-quality, contemporary housing options within a connected community, supported by established local amenities," he said. "The local traffic network will accommodate the new development, and additional parking solutions have been proposed to address visitor parking needs." Liam Golding, CEO of the Urban Development Institute of Australia SA division, said the government's rezoning decision was a "signal of intent for the future". "If we have underdevelopment now, we'll regret it for years to come where we go 'we could have had some more people living there in such a perfect location,'" he said. Property Council SA executive director Bruce Djite agreed, adding: "To have seen this development not get 20 storeys would have been a disappointment, especially in the middle of a housing crisis."
