Telangana HC denies divorce over impotency claim, cites lack of evidence

Hyderabad: Citing insufficient evidence to prove the alleged erectile dysfunction of a 33-year-old man, the Telangana high court refused to grant divorce to his 38-year-old wife.
The woman, a software professional, had alleged that her husband, a govt employee, was sexually impotent and had concealed his medical condition prior to their marriage. She sought a divorce and permanent alimony of Rs 90 lakh.
Her initial petition before the family court in Hyderabad was dismissed, prompting her to move the high court in appeal. In her plea, she claimed that their marriage remained unconsummated, both during their honeymoon and while living together in the United States for a couple of years.
She cited medical issues, including erectile dysfunction and failed surgeries, as grounds for divorce under the Hindu Marriage Act, 1955, along with cruelty.

The husband, in his defence, produced medical records and testimonies to assert his potency. He maintained that the couple had a consensual sexual relationship both before and after marriage. A govt hospital potency test conducted in 2021 also stated that there was "nothing to suggest" he was incapable of sexual intercourse.

A division bench of Justices Moushumi Bhattacharya and BR Madhusudhan Rao upheld the family court's decision, ruling that the woman had failed to establish that her husband's alleged condition had rendered the marriage unconsummated.
The court also questioned her silence between their marriage in 2013 and the divorce petition filed in 2018. It pointed to inconsistencies in her claims, including her continued cohabitation with her husband from 2015 to 2018 and the absence of corroborative expert evidence.
The judges emphasised that unsubstantiated allegations, without medical or factual backing, were not sufficient to annul a marriage.
Additionally, the court declined her request to introduce documents related to pending financial disputes involving her husband in the US, calling them irrelevant to the case.

Chandigarh: Punjab Finance Minister Advocate Harpal Singh Cheema on Thursday announced a major hike in monthly stipends for medical and dental trainees in government colleges, reaffirming the Aam Aadmi Party (AAP) government's focus on improving healthcare and education across the state. In a press release, underscoring the Aam Aadmi Party-led government's unwavering commitment to bolstering the education and health sectors, Cheema on Thursday announced an increase in the monthly stipends for interns, Junior Residents, and Senior Residents across government medical and dental colleges in the state. Finance Minister Cheema said that there are currently 907 sanctioned intern posts, 1408 for junior residents, and 754 for senior residents within Punjab's government medical and dental colleges. He said, "The stipend for interns has been substantially raised from Rs 15,000 to Rs 22,000 per month. For Junior Residents, the new stipend structure will see a rise from the current Rs 67,968 per month to Rs 76,000 in the first year, Rs 77,000 in the second year, and Rs 78,000 in the third year. Similarly, Senior Residents will experience an increase from their current Rs 81,562 per month to Rs 92,000 in the first year, Rs 93,000 in the second year, and Rs 94,000 in the third year." Finance Minister Cheema reiterated the state government's dedication to allocating ample resources for education and health sectors. He said that the annual expenditure on these stipends, currently Rs 204.96 crore, will escalate to Rs 238.18 crore following this enhancement, representing an estimated annual increase of Rs 33.22 crore. The Finance Minister affirmed the Punjab government's resolve to enhance healthcare facilities throughout the state. He also mentioned the recent initiative to provide insurance coverage of Rs 10 lakh to every citizen, further emphasizing the government's focus on public welfare. Finance Minister Harpal Singh Cheema assured that there will be no scarcity of funds for the continued development and improvement of healthcare infrastructure and services in Punjab.

Natural can never be substituted by 'chemical' and in the tug of war both must be on the same side and not like a seesaw on opposite sides. Surat: Even after submitting all necessary hospitalization documents, honestly disclosing pre-existing conditions, and meticulously adhering to every policy guideline, insurance companies can still unearth startling—and often unimaginable—reasons to deny your medical claim. A Silvassa resident recently fell victim to one such flimsy reason for rejection: his Google Maps Timeline did not reflect his presence at the hospital mentioned in his documents—a situation that has raised serious concerns about digital privacy. Fortunately, the Valsad Consumer Disputes Redressal Commission (CDRC) came to his rescue, ordering the insurance company to reimburse the Rs 48,251 mediclaim, along with compensation for mental harassment. In its recent order, the commission noted that the insurer had presented incorrect information regarding the patient's Google Timeline in an attempt to justify the rejection. Motka approached the consumer forum in March 2025, after multiple failed attempts to persuade the company to reconsider. In its repudiation letter, the company cited discrepancies in the bills, indoor case papers, and supporting documents. Its investigators somehow examined Motka's Google Timeline, and inferred that the hospital location was not recorded during the stated dates when he was admitted. Motka's advocate, A N Desai, submitted the treating doctor's certificate and argued that all treatment was conducted strictly under medical supervision. In its order, the commission wrote: "The investigation report submitted to the court confirmed that Motka was treated as an indoor patient from Sept 11 to 14, 2024 for viral pneumonia. This was further verified by a hospital visit and examination of records. It appears the discrepancy in the Google Timeline was wrongly cited. We are convinced that the insurance company failed to take the doctor's certificate into account, likely with the intent to reject the claim. " Speaking to TOI, advocate Desai said, "We've learned that investigators of some insurance companies mislead patients and gain access to their phones to stealthily review their Google Timeline data. This act is illegal, as they have no authority to check a person's private details. It's also possible the patient had their 'location' or 'data' settings turned off, or faced network issues. Unless Google officials personally verify the data in court, the Timeline holds no legal validity. "
