SC Writes Letter To Union On Ex-CJI Chandrachud's Extended Stay In Govt Residence

The Supreme Court administration has reportedly written to the Ministry of Housing and Urban Affairs (MoHUA), highlighting that former Chief Justice of India D.Y. Chandrachud continues to occupy the official residence at Krishna Menon Marg in New Delhi beyond his tenure. Citing the overstay, the court has urged the Centre to initiate steps for the immediate vacation of the bungalow, according to multiple media reports.
As per a Hindustan Times report, the top court has requested that the bungalow, designated for the sitting CJI, be vacated.
DY Chandrachud's CJI Tenure
Although his term as the top judge of the country concluded around eight months ago, Justice Chandrachud is still the occupant of the official residence allocated for the CJI. He served as the 50th CJI between November 2022 and November 2024.
After Justice Chandrachud, ex-CJI Sanjiv Khanna took over the robes and served a six-month tenure however he did not move into the official bungalow. Following, Justice Khanna, current CJI Sanjiv Khanna is also reportedly living in the same residence that was allotted to him previously.
Justice Chandrachud's Conversation With CJI
According to an NDTV report, Justice Chandrachud has attributed the delay in vacating the bungalow to 'personal circumstances', stating that the administration of the apex court was aware of the situation. Meanwhile, although the government had allotted him another bungalow, it was in disrepair due to prolonged disuse and is currently undergoing renovations.
Justice Chandrachud reportedly wrote to former CJI Khanna on April 28 requesting him for an extension till June 30 for vacating the residence, however he did not receive an answer.
Prior to this, Justice Chandrachud had written to then-CJI Justice Khanna requesting an extension of stay, which was approved. He was granted an extension until May 31, with the condition that no further extensions would be allowed.
Can Judges Overstay?
The Rule 3B of the Supreme Court Judges (Amendment) Rules, 2022, says that a retired CJI can stay in a type VII bungalow for a maximum period of six months after retirement.
Type VII bungalow is reportedly one level below the current residence of Justice Chandrachud.

VP Jagdeep Dhankhar (File Image) NEW DELHI: Vice President Jagdeep Dhankhar reiterated Justice Yashwant Varma's case and said that the government was handicapped due to a three-decade-old judicial order that prevented it from registering a First Information Report (FIR) without prior permission from the judiciary. Dhankhar, who is on a two-day visit to Kerala, has interacted with students and faculty at the National University of Advanced Legal Studies (NUALS), Kochi. Calling the Yashwant Varma cash-at-home case 'ghastly crime,' Dhankhar referring to the large stash of cash recovered from a judge's official residence, he questioned, 'Is this money tainted? What is its source? How did it land in a judge's quarters? Who does it actually belong to?' He stressed that several legal provisions appear to have been violated and expressed hope that an FIR would be filed promptly. Referring to Ides of March film, the Vice President said that the judiciary had 'Ides of March' on the night intervening 14th and 15th March: a terrible time! "Cash in large amount was found the official residence of a judge of the High Court. Now, if that cash was found, the system should have moved immediately and the first process would have been to deal with it as a criminal act, find out those who are culpable and bring them to justice. But so far, there has been no FIR," Dhankhar said. "The government at the central level is handicapped because an FIR cannot be registered in view of a judgment of the Supreme Court rendered in early 90s. New Delhi: In a sharp reaction to the ongoing voter roll revision process in Bihar, RJD MP Manoj Jha on Monday voiced serious concerns over what he termed as a mass-scale disenfranchisement plan targeting the poor, Dalits, Muslims, and backward communities. His remarks came as Opposition parties, including his Rashtriya Janata Dal (RJD), moved the Supreme Court challenging the Election Commission of India's (ECI) first phase of voter list revision in the state. 'This concern is not personal - it is collective,' Jha told IANS. "This is the concern of every poor person who is being targeted for eviction from the electoral list.' Jha criticised the ECI's approach as exclusionary and said it is especially unjust in a state like Bihar, which he described as "document-deficit." He pointed out that demanding 11 specific documents within just 25 days makes it nearly impossible for many, especially those living outside the state, to comply. 'You're revising rolls after 22 years and giving just 25 days. You know Bihar lacks easy access to certificates. You know 20 per cent of people live outside the state. Where will they get these documents from? How can they return, collect them, and submit them within this narrow timeframe?' Jha told IANS. The RJD lawmaker alleged that the entire exercise violates Article 326 of the Constitution and the Representation of the People Act, which promotes voter inclusion. "But this entire campaign is focused on exclusion. Even the public notices published in newspapers have only sown confusion. You are giving excessive powers to local officials - Electoral Registration Officers (EROs) - who can now arbitrarily add or remove names. This is deeply worrying.' He added that this is not just a legal or technical issue but a democratic one. "Today, every major newspaper in Bihar has written about it. People from every caste and religion are afraid. There was no consultation with stakeholders, no transparency. In such a situation, approaching the Supreme Court was the only option." The opposition INDIA bloc has called for a Bihar Bandh on July 9, opposing the voter list revision. The alliance claims the exercise could disenfranchise nearly 20 per cent of the state's 8 crore voters, disproportionately affecting marginalised groups. "Who are the ones being excluded? The poor, the backward, the Dalits, the Muslims. This isn't just about documentation — this is about trust in the system. The ECI must remember that it's not the custodian of suspicion, it is the custodian of free and fair elections." Jha also raised concerns about the recent 'Sanatan Mahakumbh' held at Patna's Gandhi Maidan, where Bageshwar Dham leader Dhirendra Krishna Shastri called for a 'Bhagwa-e-Hind' and demanded the creation of a Hindu Rashtra. "We are people of the Constitution. We believe in Ambedkar, in Gandhi, in Nehru. India is a multi-religious, multi-lingual nation with diverse traditions. Our flag is tricolour, not monochrome. One-nation-one-religion thinking doesn't fit the soul of India." The RJD MP also responded to Prime Minister Narendra Modi's remarks at the BRICS Summit, where the PM called terrorism "the most serious challenge facing humanity" and said it must be condemned unequivocally. "This platform has always had global significance, and the Prime Minister's message was indeed meaningful. But when the US President Donald Trump makes threatening statements about BRICS and its potential currency initiatives, we should have responded strongly to assert our independence and challenge American hegemony." Jha suggested India must take a principled stance in this evolving geopolitical environment and not appear passive in the face of economic intimidation. In a social media post, Trump warned of a 10 per cent tariff on any country aligning with what he called BRICS' "anti-American policies". He had earlier threatened a 100 per cent tariff if BRICS moves forward with proposals to reduce dollar dependence in global trade.

Interacting with the students and faculty members at the National University of Advanced Legal Studies (NUALS) today, the Vice President said there has been no FIR in the case and hoped that it would be registered for the police to investigate the matter. 'If the money is so huge in volume, we have to find out: Is it tainted money? What is the source of this money? How was it stocked in the official residence of a judge? Whom did it belong to? Several penal provisions are violated in the process. I do hope an FIR will be registered. We must go to the root of the matter because, for democracy, it matters that our judiciary, in whom the faith is unshakable — its very foundations have been shaken," he said. Dhankhar said the judiciary in India commands immense trust and immense respect from the people, but if people's faith is eroded, the country will be faced with a grim situation. Expressing his concern over post-retirement assignments for judges, he emphasised, 'Certain constitutional authorities are not permitted to hold assignments after their office — like a Public Service Commission member cannot take any assignment under the government. The CAG can't take that assignment. The Chief Election Commissioner and Election Commissioners can't take that assignment because they must be free, not subjected to allurements and temptations. This was not the case for judges. Why? Because judges were expected to be totally away from it. And now we have post-retirement posts for judges. Am I right? And not all can be accommodated — only some can be accommodated. So when you can't accommodate all, and you accommodate some, there is pick and choose. When there is pick and choose, there is patronage. It is seriously impairing our judiciary." A fire incident at Justice Varma's residence in the national capital in March, when he was a judge at the Delhi High Court, had led to the discovery of several burnt sacks of banknotes in the outhouse. Though the judge claimed ignorance about the cash, the Supreme Court-appointed committee indicted him after speaking to a number of witnesses and recording his statement. Then-CJI Sanjiv Khanna is believed to have prodded him to resign, but Justice Varma dug in his heels. The apex court has since repatriated him to his parent court, the Allahabad High Court, where he has not been assigned any judicial work.
