SC Writes Letter To Union On Ex-CJI Chandrachud's Extended Stay In Govt Residence

The Supreme Court administration has reportedly written to the Ministry of Housing and Urban Affairs (MoHUA), highlighting that former Chief Justice of India D.Y. Chandrachud continues to occupy the official residence at Krishna Menon Marg in New Delhi beyond his tenure. Citing the overstay, the court has urged the Centre to initiate steps for the immediate vacation of the bungalow, according to multiple media reports.
As per a Hindustan Times report, the top court has requested that the bungalow, designated for the sitting CJI, be vacated.
DY Chandrachud's CJI Tenure
Although his term as the top judge of the country concluded around eight months ago, Justice Chandrachud is still the occupant of the official residence allocated for the CJI. He served as the 50th CJI between November 2022 and November 2024.
After Justice Chandrachud, ex-CJI Sanjiv Khanna took over the robes and served a six-month tenure however he did not move into the official bungalow. Following, Justice Khanna, current CJI Sanjiv Khanna is also reportedly living in the same residence that was allotted to him previously.
Justice Chandrachud's Conversation With CJI
According to an NDTV report, Justice Chandrachud has attributed the delay in vacating the bungalow to 'personal circumstances', stating that the administration of the apex court was aware of the situation. Meanwhile, although the government had allotted him another bungalow, it was in disrepair due to prolonged disuse and is currently undergoing renovations.
Justice Chandrachud reportedly wrote to former CJI Khanna on April 28 requesting him for an extension till June 30 for vacating the residence, however he did not receive an answer.
Prior to this, Justice Chandrachud had written to then-CJI Justice Khanna requesting an extension of stay, which was approved. He was granted an extension until May 31, with the condition that no further extensions would be allowed.
Can Judges Overstay?
The Rule 3B of the Supreme Court Judges (Amendment) Rules, 2022, says that a retired CJI can stay in a type VII bungalow for a maximum period of six months after retirement.
Type VII bungalow is reportedly one level below the current residence of Justice Chandrachud.

Chennai: CPI(M) Tamil Nadu state secretary P. Shanmugam has called upon workers and the general public across Tamil Nadu to actively participate in the nationwide general strike scheduled for July 9. The strike has been jointly called by central trade unions and sectoral federations to protest against a range of policies introduced by the BJP-led Centre. In a strongly worded statement, Shanmugam said the central strike aims to force the government to roll back what he described as 'anti-worker' labour reforms. Chief among the demands is the immediate withdrawal of the four labour codes that the Centre passed during its tenure. 'These codes undermine the rights and protections of workers and were brought in without meaningful consultation with trade unions,' he said. The strike also demands the restoration of the Old Pension Scheme, the implementation of minimum wages for all categories of workers, and the scrapping of policies that pave the way for the privatisation of the power sector. Shanmugam particularly criticised the Electricity (Amendment) Bill, alleging that it was designed to hand over control of the power sector to private corporates, which would ultimately hurt both workers and consumers. Other key demands include ensuring 1.5 times the cost of production for agricultural produce, protecting public sector undertakings from disinvestment, increasing budgetary allocation for the Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGS), and implementing strong measures to curb the rising prices of essential commodities. Shanmugam noted that while sector-specific protests have been taking place across the country, the July 9 strike represents a united effort by the entire working class to push back against the government's policy agenda. 'This collective resistance is not just about defending the rights of workers and trade unions. It is also about safeguarding democratic values and resisting corporate-driven governance,' he said. He urged party workers, trade unions, farmers' organisations, and the wider public to come out in large numbers and ensure the success of the strike. 'A resounding message of unity and resistance must be sent to the Centre,' he added.

A local court on Monday extended the judicial custody of social media influencer Jyoti Malhotra, arrested in an espionage case on May 16, by another 14 days. Earlier, her bail plea was rejected on June 12 after police raised objections, arguing that her release could hinder the ongoing investigation. This is the fourth extension of her judicial custody. Previously, the court had extended her remand on June 9 and June 23, each time by 14 days. She was first sent to judicial custody on May 26. Her lawyer, Kumar Mukesh, has contested the charges listed in the first information report (FIR). He argued that while the alleged incident took place in 2023—when the Indian Penal Code (IPC) was in force—the Hisar police booked her under Section 152 of the Bharatiya Nyaya Sanhita (BNS), which replaced Section 124-A (sedition) of the IPC. Mukesh pointed out that Section 124-A had been kept in abeyance by the Supreme Court and therefore could not be used for prosecution. He further claimed that the FIR was based on her statements during questioning on May 15, which he says violates the legal principle that no individual can be compelled to be a witness against themselves.
