
Ex-CJIs endorse constitutionality of 'one nation, one election' concept but flag issues with bill
During the interaction, Gogoi agreed with the concerns of some members over the excessive power given to the EC, sources have said.
Lalit had suggested that simultaneous polls should be rolled out in a staggered manner and not at one go, as he had said that cutting short the remaining terms of assemblies with substantive tenure left for the purpose of synchronising election cycles could be legally challenged.
However, all three ex-CJIs have not questioned the constitutionality of the concept of simultaneous polls.
Chandrachud said in his written opinion that simultaneous elections will not infringe upon the voters' right to elect their representatives and that the bill ensures that electors remain continuously represented by their duly elected MPs or MLAs.
He said, "Arguments opposing simultaneous elections are based on the premise that the Indian electorate is naive and can be easily manipulated."
He said, "The argument that staggered elections are a part of the Constitution's basic structure (or form part of the principles of federalism or democracy) does not hold. Staggered timing of elections cannot be considered as a feature of the original Constitution, let alone an immutable feature."
However, his opinion is not without notes of caution over some of the bill's features or the likely implications if it is to be enacted.
Chandrachud has appeared to share the concern that simultaneous elections could marginalise smaller or regional parties due to the dominance of better-resourced national parties, saying it is a significant policy aspect that warrants legislative attention.
He said, "To ensure a level playing field among political parties, the rules governing electoral campaigning, particularly those relating to campaign finance, must be strengthened."
While the Representation of the People Act, 1951 and the Conduct of Election Rules, 1961, impose ceilings on the amount a candidate may spend during the election campaign, there are no corresponding limits on the expenditure incurred by political parties themselves, he noted.
This gap in regulation weighs in the electoral process towards parties with greater financial resources, he said.
As the bill says that the term of a House elected after a midterm poll will be only for the remainder of the five year term, Chandrachud has said the ability of the government to take any meaningful project will be minimised if its tenure is only of a year or less as the Model Code of Conduct will come into force around six months before the next polls.
Several MPs in the panel have also raised this point about the likely priorities and strength of a government elected for a short period.

A notice to a farmer in Dinhata in Cooch Behar district from Assam's Foreigners Tribunal, declaring the 50-year-old an 'illegal migrant' has ignited a fierce political slugfest in West Bengal. Uttam Kumar, a resident of Sadyaler Kuthi in Dinhata subdivision, said he was stunned when he received the notice in January, accusing him of entering India 'illegally through Assam between 1966 and 1971.' 'I have never left Cooch Behar in my life. I was born and raised here. How can I be an illegal migrant? ' he told mediapersons, recalling that he only grasped the charge's seriousness after neighbours explained the tribunal's ruling. 'I was served the notice in January. I don't read things well, so I showed it to my neighbours. That is when I learnt Assam has charged me with being an illegal infiltrator,' he said. The notice alleges Kumar failed to submit required documents during police verification and now stands classified as a suspected illegal immigrant. Foreigners' Tribunals in Assam alone adjudicate such citizenship disputes. The Trinamool Congress (TMC) was quick to denounce the development as proof of the BJP's 'anti-Bengali' bias. Assam is ruled by the BJP. Calling the notice 'outrageous', TMC leader and North Bengal Development Minister Udayan Guha said: 'All residents of the Brahmaputra basin, who migrated before 1971, are Indian citizens as per the Assam Accord. Even if we assume someone entered before 1971, they are legitimate Indians. Uttam is a Rajbanshi, a son of this soil. The BJP is trying to repeat Assam's NRC chaos here.' On social media platform X, TMC Rajya Sabha MP Samirul Islam accused Prime Minister Narendra Modi and Union Home Minister Amit Shah of first deporting Bengali-speaking workers and now targeting lifelong residents. 'Despite documents showing his father's name on the 1966 electoral roll, Uttam is being hounded. But our leader Mamata Banerjee will fight this in court and on the streets,' he wrote. The BJP, however, rejected the accusations and instead blamed the Mamata Banerjee-led West Bengal government for the confusion over identity documentation. A party spokesperson described it as 'one or two stray cases' and insisted that the state administration must answer for blurred lines between real citizens and those using forged documents. 'We hold the Mamata Banerjee government accountable for the situation. The lines between real citizens and those using forged documents have become increasingly blurred,' he said. Thousands of infiltrators, the BJP leader alleged, have created fake papers to pose as Bengal residents. Sushil Chandra Barman, BJP MLA from Mathabhanga, also questioned the state administration's role. 'This is another baseless campaign of TMC. There is no truth in it. Agartala: Civil Society Organisations and NGOs held a rally here on Monday, demanding the state govt identify and deport illegal migrants from Bangladesh and Myanmar. The demonstration, featuring a national flag, aimed to draw attention to the issue of illegal immigration in the state. Notable figures from various tribal bodies and community leaders attended the rally, including BJP's ally in the govt, TIPRA Motha MLA Ranjit Debbarma. Debbarma appealed to all political parties to unite in combating illegal immigration to ensure greater unity and secure the future for the next generation. The organisers alleged a significant influx of Chakma tribes from the Chittagong Hill Tracts into the state. In the hills, these migrants have constructed Buddhist monasteries and established settlements over the years. In Agartala, a Chakma colony emerged rapidly, housing individuals from Bangladesh with illegal documents, they added. A substantial number of Chakmas secured govt jobs, including executive positions, by managing illegal documents within the state. "We should not engage in vote-bank politics regarding infiltration. Everyone must unite against illegal immigration," he asserted, adding that his party does not support community-based politics.

Trade unions forum calls for Bharat Bandh against govt policies tomorrow
A forum of 10 central trade unions and their associates has called for a 'Bharat Bandh' on Wednesday to oppose the 'anti-worker, anti-farmer and anti-national pro-corporate policies of the government'. The forum on Monday said preparations for the bandh have been taken up in earnest by unions in all sectors of formal and informal/unorganised economy. 'More than 25 crore workers are expected to take part in the strike. Farmers and rural workers will also join the protest across the country,' said Amarjeet Kaur from All India Trade Union Congress (AITUC). Harbhajan Singh Sidhu from Hind Mazdoor Sabha (HMS) said banking, postal, coal mining, factories and state transport services will be affected due to the strike. Apart from AITUC, Indian National Trade Union Congress (INTUC), HMS, Centre of Indian Trade Unions (CITU), All India United Trade Union Centre (AIUTUC), Trade Union Coordination Centre (TUCC), Self Employed Women's Association (SEWA), All India Central Council of Trade Unions (AICCTU), Labour Progressive Federation (LPF) and United Trade Union Congress (UTUC) are part of the forum. In a statement, the workers' union forum said it had last year submitted a charter of 17 demands to Labour Minister Mansukh Mandaviya.. It alleged that the government has not been conducting the annual labour conference for the last 10 years and continues to take decisions in contravention to the interest of labour force, attempting to impose the four new labour codes to weaken collective bargaining, to cripple union activities and to favour employers in the name of 'ease of doing business'. The forum also alleged that the economic policies are resulting in increased unemployment, rising prices of essentials, decrease in wages, cut in social sector spending in education, health, basic civic amenities, and all these are leading to more inequalities and miseries for poor, people of lower income group as well as the middle class. 'The government has abandoned the welfare state status of the country. It is working in the interest of foreign and Indian corporates, and it is evident from the policies being pursued vigorously,' said the forum. Referring to the Special Intensive Revision of electoral rolls in Bihar, the forum said: 'The attack on democratic rights continues more vigorously by this ruling regime and now the attempt to de-franchise the migrant workers is being designed, beginning with Bihar as an immediate case. The misuse of constitutional bodies is rampant to suppress voices of opposition, the enactments in some states to control and criminalise mass movements is on the cards; the Public Security Bill in Maharashtra and similar enactments in the state of Chhattisgarh, Madhya Pradesh etc are the pointers. Now the attempt to snatch citizenship is on the cards.' Trade unions have been fighting against 'privatisation of public sector enterprises and public services, policies of outsourcing, contractorisation and casualisation of workforce', it said. The four labour codes that have been passed by Parliament are meant to 'suppress and cripple the trade union movement, increase working hours, snatch workers' right to collective bargaining, right to strike, and decriminalise violation of labour laws by employers', the statement said. The Samyukta Kisan Morcha and joint front of agricultural workers unions have extended support to the July 9 banch call and decided to make massive mobilsations in rural India, the union leaders said. Trade unions had earlier observed similar nationwide strikes on November 26, 2020, March 28-29, 2022 and on February 16 last year.
