Woman sues 'rapist' for child support
A single-member bench of the LHC comprising Justice Ahmad Nadeem Arshad allowed a petition filed by a Muhammad Afzal against the verdict of a trial court.
According to an FIR on March 4, 2020 for offences under section 376, 109 of Pakistan Penal Code, 1860, Maryam Zahid was allegedly raped by Afzal.
As a result of the rape, Maryam conceived and ultimately gave birth to a female child.
Later, a suit was filed on behalf of the child for recovery of maintenance allowance from Afzal. According to the suit, the child being the biological daughter of Afzal was entitled to get an allowance.
Muhammad Afzal contested the suit by filing a written statement, negating the version that he was the biological father of the child.
However, the trial court decreed in the respondent minor's favor. When Afzal failed to pay the interim maintenance allowance, his defense was struck off and the suit was decreed by awarding maintenance allowance to the minor at the rate of Rs3,000 per month.
Muhammad Afzal later challenged the trial court's order in the LHC, which allowed his petition.
In his order, Justice Ahmad Nadeem Arshad noted that this was not a case of recovery of maintenance allowance simpliciter.
He noted that the contention of Maryam Zahid in the plaint was that as a result of rape she conceived the minor, who being the biological daughter of the present petitioner is entitled to get maintenance allowance.
The verdict said that in case of a legitimate child, the mother institutes a suit under the Family Courts Act, 1964 or approaches the chairman of the concerned union council in the light of Section 9 of Muslim Family Laws Ordinance, 1961, for recovery of maintenance allowance.
The court then fixes an interim maintenance allowance as a temporary arrangement and on failure of the defendant/father to pay interim maintenance the court strikes off his defence and decrees the suit straightaway under Section 17-A of the Family Courts Act, 1964.
"But in the case where a woman claims maintenance for her child against the biological father, who denies the version, the woman would first need to establish, through trustworthy evidence, that the defendant is indeed the biological father of the child.
"The burden of proving that the defendant [Afzal] is the biological father of the child lies on the woman who claims the maintenance," it said.
The LHC said the trial court erred in law by granting maintenance for the child without first ensuring, through the proper process of evidence, that the child is indeed the biological offspring of the petitioner.

Rangers official booked for alleged murder of cop
A paramilitary Rangers official has been booked for allegedly murdering a police constable posted at the Gulshan-e-Maymar police station. The FIR was registered at the Site-A police station on the complaint of the victim's father, Sub-Inspector Nazir Hussain. According to Nazir, his 30-year-old son, Waseem Akhtar, was serving in the Sindh Police as a constable. Around 9:30am on Thursday, Waseem left home for duty on his motorcycle. At around 1pm, Nazir received a phone call informing him that a message circulating in a WhatsApp group claimed that his son had been killed. When he tried calling Waseem's mobile phone, the call was answered by SHO Site-A Imran Afridi, who asked him to rush to Abbasi Shaheed Hospital. Nazir was taken to the mortuary, where he identified his son's body. Nazir said that Waseem had gunshot wounds on his right arm and chest. Nazir said his son was riding his motorcycle on Manghopir Road, in the SITE area, when he was stopped by an armed motorcyclist, who reportedly opened fire without provocation, striking Waseem in the chest and arm. Waseem returned fire in self-defence and is believed to have injured the assailant in the leg. Nazir further stated that he later came to know through media reports that the shooter was identified as a paramilitary Rangers soldier named Noman. He alleged that Noman fatally shot his son without any known reason. Police registered FIR under Section 302 (premeditated murder) of the Pakistan Penal Code.

Unjustified methyl bromide imports banned
Listen to article The government has uncovered a methyl bromide scandal within the Department of Plant Protection (DPP) and suspended a suspicious company's licence, while halting shipments worth $1 million. Amid a major crackdown on the DPP, the government has reviewed the policy for methyl bromide imports and imposed a ban on the unjustified import of the product. Under the leadership of Federal Minister for National Food Security and Research Rana Tanveer Hussain, the DPP has undertaken a series of transformative, corrective and disciplinary measures over the past six months to overhaul its operations, systems and regulatory mechanisms. As part of this reform agenda, Rana Tanveer directed the initiation of several strategic measures, including the launch of NAFSA, upgrading testing laboratories and the establishment of a modern institutional infrastructure aligned with global phytosanitary standards. These reforms are aimed at improving Pakistan's compliance with international trade requirements and enhancing export competitiveness. One of the most impactful actions was the revision in import conditions on a scientific basis, resulting in a drastic reduction in the unjustified use of methyl bromide. This regulatory shift led to significant cost savings for the import industry, ranging from Rs30,000 to Rs40,000 per container, particularly benefiting imports of cotton, grains, pulses and lentils. The move was welcomed by the industry stakeholders and is being viewed as a landmark step towards rationalised pesticide use. The minister also took firm action against malpractices. A detailed internal audit revealed that a company was importing methyl bromide from a suspicious origin. Under the minister's instructions, the DPP undertook rigorous scrutiny, including third-party verification, cross-checking of documents and allied investigations. As a result, the company's licence was promptly suspended due to violations of regulatory norms and in coordination with Pakistan Customs, four under-process shipments valuing at $1 million were intercepted at the port before clearance. These enforcement actions not only prevented the entry of potentially harmful substances but also sent a strong signal about the ministry's zero-tolerance policy against non-compliance and malpractice. Furthermore, strict disciplinary proceedings have been initiated against those found responsible. Rana Tanveer has repeatedly emphasised the importance of transparency, accountability and institutional integrity within all attached departments of the food security ministry. The detection and disruption of a high-value scam, along with swift and lawful action, have been widely appreciated by stakeholders and the public. It reinforces the resolve to cleanse the system of inefficiencies, ensure fair competition and uphold phytosanitary integrity in national and international trade. Rana Tanveer reaffirmed that the Ministry of National Food Security would continue to pursue reforms with full force, ensuring that Pakistan's agricultural and quarantine systems meet global benchmarks, and that no leniency would be shown to those violating the law or compromising the national interest.

No bar on a Muslim to gift his property to an obedient child: LHC
LAHORE: The Lahore High Court (LHC) held that Islamic law and law of the land do not restrain a Muslim from gifting his property to the child who earned his trust and affection through personal service and care. The court observed such a transaction reflects not malice, but recognition of filial duty and falls squarely within the autonomy of an owner preserved under Islamic jurisprudence, as well as, law of the land. The court passed this order in a petition of Muhammad Naseem and others who approached the court against the decision of their deceased father Bashir Ahmed, who gifted his property to the petitioners' step-brother Asghar Ali. The court said prima facie, it appears that the deceased impressed by the conduct and care extended by the respondent chose to transfer his entire estate to him during his lifetime. The court said the disobedience of the petitioners and their distancing from the donor in his life was only an ancillary aspect of the matter. The petitioners; however, averred in their plaint that the oral gifts and the subsequent mutations were fraudulent and the donor never appeared before the revenue officials for execution, registration and sanctioning of the mutations. The court; however, noted that oral gifts in this case were made through separate mutations spread over a period of two years, all attested by the witnesses and bearing the thumb impressions of the deceased father along with his photograph. In the present case, the circumstances surrounding the oral gifts are materially different and suggest a bonafide transfer based on affection and the personal service of the respondent, the court added and dismissed the petition for being devoid of any merit.
