What Next in Impeachment Process For Judge Caught In Cash-At-Home Row

NDTV21-07-2025
New Delhi:
The process of impeachment of Justice Yashwant Varma - the former Delhi High Court judge at whose home "piles of burnt Rs 500 notes" were found - having started in parliament with a memorandum signed by 145 MPs, Speaker Om Birla is expected to carry the ball further tomorrow, by forming an inquiry committee.
The committee is expected to include a serving judge of the Supreme Court, the Chief Justice of a High Court and a reputed jurist. The report of the committee - which is expected to investigate the allegations against Justice Varma - is likely to come during the winter session of parliament.
After this, the process of investigation and hearing will start. The committee is expected to lay down the allegations and a copy of it will be given to the judge, who will also be given a chance to respond in writing.
After this, there could be an interrogation or cross-examination of witnesses in the matter, following which the committee will present its conclusions in parliament. The committee's report will be discussed in both houses and Justice Verma will be given a chance to present his side.
This would be followed by the actual process of voting for impeachment in both houses of parliament.
To carry out the impeachment, either a simple majority of the total number of members or a two-thirds majority of those present and voting will be required.
A go ahead from both houses is needed after which the President issues an order to remove the judge.
The complicated process of impeachment is part of the reason why no judge has been impeached in Independent India. On most of the five cases that came close, the judges had resigned before the proceedings had reached the final phase.
Justice Yashwant Varma had come under scrutiny after a fire broke out at his official residence on March 14 and wads of half-burnt cash were found. It had caused a furore, and though Justice Varma denied any wrongdoing, questions were raised about the judiciary.
In view of the row, then Chief Justice of India Sanjiv Khanna had initiated an in-house inquiry. A three-judge panel was appointed to conduct an investigation.
After the committee confirmed the presence of cash at Justice Varma's residence and submitted its report to the CJI, Justice Khanna sent the findings to the Prime Minister and the President, recommending initiation of removal proceedings as per the Judges Inquiry Act and Article 124(4) of the Constitution.

EC must stick to its mandate of holding free and fair polls: Manoj K Jha

As the Supreme Court on Monday told the Election Commission to consider Aadhaar and voter cards for the ongoing special intensive revision (SIR) of electoral rolls in Bihar, Opposition Rashtriya Janata Dal (RJD) Rajya Sabha MP Manoj K Jha tells Preetha Nair that the poll panel must behave like a constitutional body and stick to its mandate of conducting free and fair elections in the country. Excerpts: EC data says over 65 lakh voters may not figure in Bihar's draft electoral roll. Does it validate the Opposition's concerns on disenfranchisement? We have been consistently saying that the Election Commission is doing the exercise with a hallmark of opacity. For instance, if you look at the different categories— such as diseased, permanently shifted, untraceable or found to be registered at different places—shows lack of transparency. When people are not available, they presume they have moved out. That presumption is flawed. We will watch each and every entry in these categories, once the numbers are shared with our district and state level units, but more importantly, we will go by the Supreme Court, because somewhere the Election Commission has defied their direction by not incorporating Aadhaar, EPIC card and ration card as documents for the SIR. Did you ask EC to share the details of the voters who are excluded from the draft electoral roll? Yes. We have asked details of each category. We will not allow the Election Commission to do it in a brazen manner, where the very idea of inclusion gets lost. The 2024 general election was conducted on the basis of these numbers. Now if they are saying the numbers were flawed, then that election should be called null and void. The EC said that Aadhaar and Voter ID can't be relied upon. The denial of the Aadhaar card, voter ID card and ration cards are in the direction of disenfranchisement. I think that they have decided it much before the exercise. Bihar is one of the most document deficient states. However, Aadhaar has a penetration of 86- 87%.

DMK spent Rs 22 crore on ads without tenders: AIADMK gen sec EPS

CHENNAI: AIADMK general secretary Edappadi K Palaniswami on Monday said that since launching the statewide tour titled 'Let us protect Tamil Nadu people and reclaim the state' from July 7, so far, he has covered 46 Assembly constituencies in 10 districts and would be continuing his visit in the coming days, meeting all sections of the people. In a statement, Palaniswami alleged that DMK government misuses public funds for personal image-building, citing Rs 22 crore spent on advertisements without tenders, and naming schemes after former CM M Karunanidhi. He described the DMK regime led by Chief Minister M K Stalin as a 'failure model government' which 'failed to fulfil the expectations of the people on all counts'. Palaniswami also said that the AIADMK has launched a new campaign titled 'Against DMK's Lies and Thefts – For Truth and Rights', calling upon the people of Tamil Nadu to submit report cards highlighting the failures of the DMK government. The AIADMK leader accused the DMK of running a family-dominated, anti-people, and dictatorial administration, which has failed to fulfil even 10% of its 525 poll promises while claiming 98% implementation. He also slammed the DMK for rising taxes, unaffordable construction costs, law and order deterioration and widespread drug abuse.

DPR for Tunnel Road project in Bengaluru has left out bus lanes: MP PC Mohan

BENGALURU: The final Detailed Project Report (DPR) for the proposed Tunnel Road project in Bengaluru has come under sharp criticism after it emerged that dedicated bus lanes, included in the draft version, have been dropped. Bengaluru Central MP PC Mohan on Monday called the move a clear example of infrastructure being designed for the privileged, sidelining the needs of the common Bengalurean. 'Tunnel Road final DPR quietly drops bus lanes, once again making it clear that the tunnel is only for those rich people who can afford Rs 660 toll, not for the common man. On one hand, they talk of free bus rides; on the other, they erase bus infrastructure itself,' Mohan said. He questioned the affordability of the project for regular commuters. 'How many Bengalureans can actually afford Rs 660 a day? That's nearly Rs 20,000 a month just to use this tunnel. This is not public infrastructure but a private expressway for the privileged, funded by taxpayers. It is a discriminatory, exclusionary, and anti–public transport move,' he added. Independent urban mobility expert Satya Arikutharam pointed out that while the draft DPR included a dedicated emergency and bus lane, the final version mentions only an emergency lane. Speaking to TNIE, he said, 'It is a sign of zero accountability and lack of institutional oversight that allows the BBMP to persist with its unscientific car-only Tunnel Road idea. Reading the final DPR, it is a clear case of a bad option made even worse.' Citing examples, he noted discrepancies in the traffic projections. 'For instance, the DPR claims that more car users will opt for the tunnel after tolls are imposed. These incredulous results make the DPR unreliable. I urge the government to drop the Tunnel Road plans and instead commit fully to completing the metro and suburban rail network,' Satya said.
