Appeals court acquits man of drug trafficking, upholds possession conviction

Justice Azman Abdullah said Wan Efizan W Shamli's trafficking conviction was found to be unsafe due to material contradictions in the prosecution witnesses' testimonies. PETALING JAYA : A man was acquitted and discharged by the Court of Appeal of a charge of trafficking in 151.60gm of methamphetamine.
Bernama reported that a three-member bench, comprising Justices Azman Abdullah, Azmi Ariffin and Noorin Badaruddin, allowed an appeal by Wan Efizan W Shamli to set aside his conviction and sentence for trafficking in the drug.
Azman, who delivered the unanimous decision, said Wan Efizan's conviction was found to be unsafe due to material contradictions in the prosecution witnesses' testimonies concerning the location of the drugs at the time they were discovered.
However, the court upheld Wan Efizan's conviction for possession of 28.69gm of methamphetamine. He will serve five years in prison and receive three strokes of the cane for the offence.
On May 10 last year, the Shah Alam High Court sentenced Wan Efizan, 37, to 30 years in prison and 12 strokes of the cane after finding him guilty of trafficking in methamphetamine.
He was also sentenced to five years in jail and three strokes of the cane for possession of 28.69gm of methamphetamine.
The High Court ordered Wan Efizan to serve the sentences concurrently from the date of his arrest on May 2, 2020.
The offences were allegedly committed at a house in Taman Sri Bayu, Sungai Pelek, Sepang, Selangor, about 10.30am on May 2, 2020.
Wan Efizan was represented by lawyers Ariff Azami Hussein and Nur'ain Shahiera Khalid, while deputy public prosecutor Nik Fadli Nik Azlan appeared for the prosecution.

Cops shut down ‘Turun Anwar' stage at Dataran Merdeka over safety, lack of DBKL approval

KUALA LUMPUR, July 26 — Police instructed Kuala Lumpur City Hall (DBKL) to dismantle the main stage set up at Dataran Merdeka for an event today, citing safety concerns and lack of approval. Acting Kuala Lumpur police chief Datuk Mohamed Usuf Jan Mohamad said the structure was erected without permission from DBKL or a formal application from the organisers. 'The stage structure did not guarantee safety, and the police were not informed of how many people would be on the stage,' he told reporters via Whatsapp. Mohamed Usuf said that police and the organisers had initially agreed to use two Hilux vehicles as a makeshift stage. Thousands of protestors gathered in central Kuala Lumpur this afternoon to demand the resignation of Prime Minister Datuk Seri Anwar Ibrahim. The demonstration began outside Sogo and Pertama Complex and is expected to move towards Dataran Merdeka after 1pm.

Robbers break into Mirzan Mahathir's home, flee with RM1.8m in valuables

KUALA LUMPUR, July 25 — The home of Mirzan Mahathir, the eldest son of former prime minister Tun Dr Mahathir Mohamad, was broken into on Wednesday, with robbers escaping with jewellery and other valuables estimated to be worth RM1.8 million. According to The Vibes, the break-in reportedly occurred around 5pm and was discovered by a Filipino domestic helper, who noticed that the padlock on the back door had been cut and the bedroom of Mirzan's daughter, Khadijah, 29, had been ransacked. Khadijah later confirmed that several items were missing, including a Cartier bangle, gold rings, earrings, a pair of golden chopsticks, jade bangles, old passports and foreign currency. The two-storey bungalow, located on a 1.5-acre end-lot, is equipped with 24-hour security. However, despite having 16 closed-circuit television (CCTV) cameras, the system only provides live viewing with no recording function. A forensic team from the Kuala Lumpur police headquarters, comprising five officers and personnel, was deployed to the scene. They recovered three fingerprints from the bedroom, and also seized the cut Solex padlock as evidence. The fingerprints have been sent to Bukit Aman for further analysis. A K9 unit from the Police Training Centre (Pulapol) was also brought in to assist with investigations. The case is being investigated under Section 457 of the Penal Code for house-breaking.
