Sabah seeks law reforms to boost industrial investment

Kota Kinabalu: The State Government is currently engaging with its federal counterparts to review and reform key legislation related to industrial development and investment incentives, said State Industrial Development and Entrepreneurship Minister Datuk Phoong Jin Zhe. He said the review was necessary as some existing laws and policies may no longer be relevant in today's rapidly evolving global investment landscape. 'We are negotiating with the Federal Government to re-evaluate several Acts, including those concerning industrial development and trade incentives. 'The global investment ecosystem has changed significantly, and some of the current legislation may be outdated or no longer applicable,' he told the State Assembly, on Tuesday. Phoong was responding to Moyog Assemblyman Datuk Darell Leiking during the question-and-answer session, who had asked about the minimum infrastructure standards required by investors, whether Sabah could meet those expectations, and if state sales tax revenue could be utilised to overcome infrastructure shortcomings. Darell also queried the timeframe the ministry could commit to in upgrading infrastructure to match investor needs once a major project is approved. In reply, Phoong said the aim of the ongoing legislative review was to ensure that less developed states such as Sabah receive stronger focus and incentives to close the development gap with more advanced states. 'As a matter of principle, states that are less advanced in the manufacturing sector should be given priority and stronger incentives. 'We want to ensure that all states in Malaysia can develop in a fair and balanced manner,' he said. Phoong said a comprehensive plan involving both tax and non-tax incentives was being drawn up to position Sabah as a more attractive and competitive investment destination. 'YB Moyog is well aware of this matter. These negotiations are ongoing and involve a wide scope of reform,' he added. Phoong also said the ministry was being cautious with regard to investments that have high infrastructure demands such as data centres, which require large amounts of electricity and water. He said a well-planned approach was necessary to avoid overstressing Sabah's infrastructure. This was in response to Darel's question on why Sabah could not develop data centres like Sarawak, pointing out Sabah's abundant water supply and its strategic location to serve markets such as the Philippines, Papua New Guinea, Australia and New Zealand. Nga said the Ministry of Local Government and Rural Development (KPKT) had taken proactive steps by inviting the MACC to investigate the project following various allegations labelling it a 'white elephant' and other claims of mismanagement. 'There were previously various allegations labelling this project a white elephant and so on. Because of that, the KPKT took the initiative to invite the MACC to investigate. 'When the MACC didn't come to us, we went to them and handed over all the documents for their review,' he said during a question-and-answer session in the Dewan Rakyat. Nga said the MACC subsequently issued a statement confirming that there was no abuse of power, no criminal elements, and no signs of corruption related to the project. 'So to those who threw stones, don't hide your hands. On behalf of all the hardworking KPKT staff who have been tirelessly helping the people, I demand that those who made slanderous accusations apologise,' he said. Nga added that the MyKiosk initiative, which aims to provide standardised, low-cost business premises for small traders, remains part of the government's agenda to support grassroots entrepreneurs. In May, Parti Pribumi Bersatu information chief Datuk Tun Faisal Ismail Aziz claimed that the MyKiosk project was wasteful and had turned into a white elephant. Selangor MCA Youth also lodged a complaint with the MACC, urging an investigation into the funding and implementation of the RM150 million MyKiosk project. Its chief, Tan Jie Sen, claimed that despite the large allocation, just over half of the kiosks were occupied. Chief Minister Datuk Seri Hajiji Noor, who chaired the meeting, stressed the need for balanced, cost-conscious decisions aligned with economic and industrial growth. He noted that earlier fast-track projects helped raise the power reserve margin from 10pc in January 2023 to 17pc currently, with a target of 30pc by year-end. Power outages have also reduced, with the system average interruption duration index dropping from 363 minutes (H1 2023) to 162 minutes (H1 2025). Speaking at the Madani Entrepreneurs Seminar in Penampang, Ewon stressed that digitalisation is essential for business resilience. The seminar, part of a 23-stop nationwide tour, has already engaged over 11,000 entrepreneurs. Ewon said agencies like Insken and SME Corp are working with LHDN to prepare businesses for the e-Invoice rollout. He added that 13MP will also support inclusive business and social enterprise models for more equitable growth. Sabah and Sarawak, he assured, won't be left out, citing rural-focused programmes and grants for Borneo entrepreneurs.
