A bill to rein in Medicaid fraud could push out eligible Louisianans, critics warn

A bill aimed at strengthening oversight of Louisiana's Medicaid program unanimously passed the state's senate Tuesday.
Senate Bill 130, sponsored by Sen. Heather Cloud, R-Turkey Creek, seeks to implement a series of data-driven checks and technological tools to ensure that only eligible residents receive Medicaid benefits.
The bill requires the Louisiana Department of Health (LDH) to conduct regular cross-checks with state and federal agencies, including the Department of Revenue and Social Security Administration. LDH must also review death records monthly, verify incarceration status quarterly and independently determine eligibility.
It also limits automatic (ex parte) renewals unless required by federal law, with a phase-out of current waivers by January 2026.
The bill is part of a broader effort to curb waste and fraud in the program, which provides health coverage to more than 1.8 million low-income Louisianans. But critics of the bill warn that the proposed changes could create administrative hurdles for eligible individuals and lead to disenrollment of vulnerable residents due to paperwork errors or data discrepancies.

'We know that any time that there is any additional step for verification, it's an opportunity for someone to lose coverage,' said Courtney Foster, senior policy advisor for Medicaid at Invest in Louisiana, a nonpartisan policy research organization. 'A lot of what this bill says will be savings is for people getting kicked off of Medicaid.'
That doesn't necessarily mean that all of those people that are getting kicked off are ineligible, Foster said. It could just mean that they didn't respond to official correspondence. Sen. Gerald Boudreaux, D-Lafayette, brought up these concerns on the senate floor.
'If for whatever reason I don't answer the first time, or I think it's junk mail, it gets thrown out,' Boudreaux said. 'How do we have comfort knowing that on the certification process, that we're going to go above and beyond before we drop people off of the Medicaid rolls?'
Cloud responded saying the bill doesn't change the current process for removing people from Medicaid if they don't meet eligibility requirements.
The removal process, as she explained it, starts when LDH identifies a possible issue with a person's Medicaid eligibility — such as needing to verify income or address — they begin by sending a letter requesting more information. This initial letter follows federal guidelines and allows five days for delivery.
After that, LDH gives the person an additional 15 days to respond. During this combined 20-day window, the department also tries to contact them through other means, including phone calls, emails and text messages, to make sure they know what's needed to keep their coverage.
If there's still no response after 20 days, LDH sends an official 'advance notice of termination' letting the person know their Medicaid coverage will end. This notice must be sent at least 15 days before the termination takes effect. Because Medicaid coverage usually ends at the end of a month, this timing can sometimes give people a bit of extra time — potentially another full month of coverage — before they're removed from the rolls.
Cloud added that even after someone is dropped from Medicaid, they have another 90 days to provide the needed information and get their coverage reinstated retroactively.
'So theoretically, they have up to 125 days after the first [letter] was sent out to get their coverage reinstated if they are terminated,' Cloud said. 'It would be as if they'd never lost coverage. So that gave me a lot of comfort.'

The fiscal note says reducing enrollment of ineligible recipients could save $74.9 million by 2026 and $941.5 million over five years, including state and federal dollars. The methodology for this savings includes the state assuming a majority of applicants won't respond to requests for more information, and only a fraction will attempt to re-enroll.
Foster said most of the savings would come from procedural denials, not necessarily policy improvements. And the cost-savings associated with the bill are 'questionable,' she said, because most of the time, when someone loses Medicaid coverage, they don't realize it until the next time they go to the doctor or emergency room. That could mean people who are disenrolled from Medicaid for procedural reasons, but do qualify for coverage, may simply get back on Medicaid.
'A lot of people who will be kicked off are likely eligible and may roll back on within a couple of months,' Foster said.
Implementing the bill would also cost money, including operating expenses of $139,297 for printing and postage, $4.5 million for professional services, like system modifications and subscription services, and $104,050 for equipment, like computers and phones.
It also calls for creating 50 new positions with salaries and benefits, which Foster said adds additional layers of bureaucracy dedicated to 'kicking people off of Medicaid.'
It's also important to remember, Foster said, that Medicaid beneficiaries are not the ones getting paid. The program gives low-income people access to consistent health care coverage.
'It's people that are showing up to the doctor and then maybe the doctor should be getting paid from one source versus another,' Foster said. 'But the patient themselves is just going to the doctor.'
If signed into law, the bill would go into effect Jan. 1, 2026.

It's only been a few days, but Cooper is already giving the national Democratic Party a masterclass in how to run a successful campaign in battleground states. Cooper, who has never lost an election, has the popularity and experience needed to flip a seat for the Democrats, who haven't won a U.S. Senate race in North Carolina since 2008. As a born and raised North Carolinian, I have seen these qualities firsthand. North Carolina has been MAGA country since 2016, when President Donald Trump first won the state. The past two U.S. Senate races were expensive and disappointing for Democrats. Within the state, partisan gerrymandering and a voter ID law make it harder for Democrats to win. While Cooper isn't the singular answer to slowing Republican dominance in the state, he is the first candidate in a long time who seems to have a fighting chance. Roy Cooper's economic track record is good for everybody North Carolina's economy, once burdened by the decline of factory and agriculture jobs, thrived under Cooper's leadership. During his two terms as governor, the state added more than 640,000 jobs from companies like Toyota, Apple and Eli Lilly. The state was also ranked America's Top State for Business by CNBC for two consecutive years based on economic investments, its workforce and the state's debt management. 'For too many Americans, the middle class feels like a distant dream,' Cooper says in the video announcing his campaign. 'Meanwhile, the biggest corporations and the richest Americans have grabbed unimaginable wealth at your expense.' If his first ad is any indication, the Senate candidate seems to be running on a populist message that is likely to resonate. It's a move that Democrats have been shy to make as they crumble under the MAGA reign, but it's a move that could fare well in a state dominated by Republicans. Republicans cut Medicaid. Cooper expanded access for North Carolinians. A crowning achievement of Cooper's tenure as governor is the state's expansion of Medicaid in 2023, which brought coverage to an additional 600,000 North Carolinians. He fought for that expansion for years. Considering that Medicaid is one of the things Republicans in Congress placed on the chopping block recently, Cooper's hand in bringing access to more North Carolinians is sure to bode well for the former governor. Democrats, again, could learn from this: It's not enough to talk about social issues. Medicaid just got cut in the federal spending bill, and hundreds of thousands of North Carolinians will likely lose coverage, including those who benefited from Medicaid expansion. This is an issue they can win on, and one that would show they care about what everyday Americans are facing. The simplest reason? Roy Cooper's actually likable. Cooper's biggest draw, however, may be how deeply his roots are in the state. He grew up in Nash County and attended the University of North Carolina at Chapel Hill. He was a lawyer and Sunday School teacher in Rocky Mount before entering politics. He spent several Halloweens dressed up as Sheriff Andy Taylor from 'The Andy Griffith Show." He's taken other Democrats to Cook Out for fast foods on the campaign trail. He's such a North Carolinian, in fact, that I wondered if he'd ever take the plunge into national politics. 'I never really wanted to go to Washington,' Cooper says in his announcement video. 'I just wanted to serve the people of North Carolina right here, where I've lived all my life. But these are not ordinary times.' Opinion: Tillis' departure signifies troubling shift. Can any Republican stand up to Trump? It's a reminder to the national Democratic Party that a quality candidate is also a candidate who loves where they're from. A candidate with deep roots in the community is a candidate who can win elections. There's still merit to the idea that a good candidate is someone you can imagine drinking a beer on the front porch with, especially in the South. Cooper is clearly a promising candidate who could break through the Republican stronghold in a state that's gone for Trump three elections in a row. But he'll face an uphill battle in the form of Republican National Committee Chairman Michael Whatley, who was selected by Trump. Republicans are already on the attack, accusing the former governor of "dragging North Carolina left," criticizing his vetoes and complaining that he competently handled the COVID-19 pandemic. Still, this is the same governor who got more votes than Trump in the 2020 election – his odds are better than one might expect for a purple state. Cooper's finances are already showing the promise of his Senate campaign, as he raised $3.4 million in the first 24 hours, setting a fundraising record. If people can get behind a liberal Democrat from rural North Carolina, imagine what would happen if there were candidates of this caliber in all battleground states. Sen. Catherine Cortez Masto, D-Nev., clashed with Sen. Cory Booker, D-N.J., this week when Booker, in a fiery floor speech, tried to block a package of police funding bills as he called for greater resistance to President Donald Trump's policies. Afterward, Booker alluded to his efforts in the face of criticism from Cortez Masto saying, 'What's bothering me right now is we don't see enough fight in this caucus.' In an interview, Cortez Masto had her own message. 'I don't need a lecture from anybody about how to take on and push back and fight against Donald Trump,' Cortez Masto said. She took a shot at 'long speeches' as a form of resistance, calling them ineffective as Democrats seek to win back Congress and eventually the White House. In April, Booker broke a Senate record by speaking for 25 hours, warning of the 'grave and urgent' threat Trump's administration posed to the country. He posted a personal record fundraising haul after that speech. 'If we really are going to take on Donald Trump, we need to win. It's not long speeches on the floor,' Cortez Masto said. 'It's showing the American public that we're there fighting for them, that we're passing commonsense legislation that they care about.' Booker's office declined to comment. The whole spat, a rare intraparty clash that played out in public, is indicative of a larger question vexing Democrats as they look toward the midterms and 2028: Is the party hankering for a fight, or does it just want its lawmakers to get the nuts and bolts done for their communities, even if it means working with Republicans? Cortez Masto, who also heads ModSquad, a political action committee that works to elect moderates to the Senate, is leaning into a Sen. Lisa Murkowski-like strategy that makes bringing home the goods priority No. 1. Murkowski, R-Alaska, was the deciding vote on Trump's 'big, beautiful bill' because of provisions she believed benefited her state — even as she said she didn't overall like the legislation, which heavily cut Medicaid. Just this week, Cortez Masto and fellow Sen. Jacky Rosen of Nevada were the only Democrats to vote to confirm Republican Sam Brown as undersecretary of veterans affairs. Cortez Masto then asked Brown for an update on the construction of a national cemetery in rural Nevada to benefit veterans and their families. Cortez Masto said the path to a Democratic majority is paved by moderates, those who oppose Trump but still work across the aisle to specifically address their states. She pointed to former North Carolina Gov. Roy Cooper's Senate candidacy and the new ad her group just released. It focuses on Cooper's getting 'stuff done' and doesn't even mention Trump. "In North Carolina, it's not about Republican or Democrat. It's about what you'll do for our families," the ad says. To Cortez Masto, who faces re-election in 2028 in a battleground state that Trump won in November, the answer is less about taking hard-line stances against Republicans or disruptions on the Senate floor than about sticking to 'kitchen table' issues that drove the narrative in the last presidential election. The state of the economy, public safety and health care are among the issues dominating conversations with constituents in her home state of Nevada, Cortez Masto said. Some small-business owners fear closing or facing debilitating losses due to Trump's tariffs, grocery prices haven't relented, and gas prices — nearly $4 a gallon in the Reno area — are still too high (though lower than their peak in 2022), she added. "Yes, we want to fight Trump and push back on him and hold him accountable and take him on," she said. "But that doesn't mean at the same time we are doing that we are stopping and harming the people in our states." She didn't think the humanitarian crisis in Gaza or the release of the Jeffrey Epstein files ranked high on the list of issues she would talk about back home. 'If you're asking me is it the No. 1 issue I hear in my state, no, it's not, but do some of my voters care about it? Yes, they absolutely do,' she said of the war in Gaza. On Epstein, she called for transparency while protecting victims but reiterated that she didn't hear her constituents asking about it. Cortez Masto was among a group of senators who sent a letter to the White House calling for greater action to get aid to people starving in Gaza. But in a sign of support for Israel, she voted against resolutions put forth by Sen. Bernie Sanders, I-Vt., that would block the sale of weapons to Israel. 'The arms sales all already occurred. So it was, most importantly, a symbolic gesture. At the same time, I understand why they're doing [it]. … I don't think we all have to be on the same page for everything,' she said in explaining her vote. To Cortez Masto, the moderate path means supporting border security but taking a stand against raids by Immigration and Customs Enforcement that she described as 'absolutely extreme.' 'There's fear in my community. I see it. I talk and visit with them all the time. Rightfully so; we have less people going to church, going to school. Some of our workforce are gone. They're too afraid to come forward,' said Cortez Masto, whose state is roughly one-third Latino. 'These aren't hardened criminals. These are people who came to our country for a good life and opportunity. They're paying taxes. They want a better life for their kids. They haven't committed violent crimes, but they're being swept up intentionally by this administration because that's what they want to do, and that's where I think this administration has gone too far.' Separately, Cortez Masto said she fully supported any Democratic efforts to redistrict and create additional seats in Congress for her party the same way Republicans have done in Texas. 'Right now the process is Republicans are going to redistrict so that they can gain control. The Democrats should, too. Why wouldn't we fight to take control?' she said. 'Does the general public, do we all like the way that redistricting is played for that power? No, we don't, and we should change the laws, ultimately. But they're not changing now." "The Republicans aren't going to change them," she added. "Republicans are going to benefit, and so until we can gain control and win some of these races, we should be playing by the same rules that the Republicans are using against us and fight back.'

When Congress passed President Trump's signature domestic policy bill last month, Republicans voted to take health care coverage away from about 10 million people. In the past, Republicans have typically shied away from promoting plans to end health benefits for millions. But in this case, they openly boasted about part of it. About half of the 10 million will lose coverage because of a new requirement that people who enroll in Medicaid prove that they are working, looking for work or unable to work. The new policy will cut Medicaid spending by $325 billion over the next decade, funds that will be used to finance President Trump's tax cuts for the wealthy. 'They are choosing not to work when they can,' House Speaker Mike Johnson told CNN earlier this year, describing the people who would lose coverage. 'That is called fraud; they are cheating the system.' John Thune, the Senate majority leader, said in June that 'Democrat senators here in Washington are melting down because Republicans are daring to focus limited Medicaid dollars on American citizens and those most in need.' He described work requirements as a 'common-sense reform.' The idea of requiring Medicaid enrollees to work barely registered eight years ago, the last time Republicans debated deep health care cuts as part of their effort to repeal Obamacare. They failed to pass a law that time. This time they were successful. That's in part because Republicans have put more stock in an idea that has long been a part of the American conversation about health insurance: that it is a benefit one earns by working.
