
I'm worried my neighbours' leaning 6ft garden wall will fall and hurt someone: What can I do?
I live in a village in the East of England where lots of the properties are very old.
The problem is that some of the garden walls of these homes are staring to lean towards the pavement.
The walls are typically 6ft high, and at least double that in length. I worry that they could collapse and someone could get hurt if they are not sorted.
They also block my way when walking, as I usually have a buggy with me.
I think the walls should be replaced. Can I alert the council – and does it have the authority to make the homeowners take action?
Ed Magnus, of This is Money, replies: We've heard from readers complaining about their neighbours garden fence collapsing in the past, but your predicament notches things up on the danger scale.
You would hope any responsible homeowner or land owner might also be keen to avoid their wall collapsing and potentially seriously hurting someone.
That said, they may be trying to pretend the problem doesn't exist or isn't their responsibility. After all replacing a section of a brick or stone boundary wall won't be cheap.
But the owner may also not be aware, particularly if the property is rented out or they live elsewhere, so it could be worth being a responsible citizen and telling them about the danger. They may also consider the wall to be perfectly safe, even it it is leaning.
If that doesn't work, alerting the council is the next best option.
For expert advice we spoke to Kathryn Cooling, an associate in the property disputes team at law firm RWK Goodman and Olivia Egdell-Page, partner and head of property department at Joseph A Jones & Co LLP.
What can be done about a dangerous wall?
Kathryn Cooling replies: You are right to be concerned. Leaning garden walls, especially ones of that size, could pose a real risk if they were to collapse.
You can certainly alert the local council and in many cases, they do have the power to step in.
The key thing here is public safety when using footpaths. If a structure like a garden wall is next to a public footpath and it appears unsafe, the local council has a duty to investigate.
However, they depend on the public to report these things. Most councils will have a team who deal with these kinds of problems and have sections on their websites where you can report dangerous structures or highway obstructions issues.
If the council agrees the walls pose a risk to public safety, then they can usually serve a notice on the homeowners that they must make the walls safe. In some cases, the council may even step in and do the work itself.
It would be worth taking some photographs to show how much the walls are leaning and where they are. This can help you making the report.
At the end of the day, public footpaths should be free from obstructions. You can definitely report this to your local council.
Olivia Egdell-Page adds: In most cases, the council cannot force homeowners to maintain a property boundary.
The council's role is generally limited to addressing hazards and nuisances related to boundary structures, not enforcing routine maintenance.
The responsibility for maintaining boundary structures will be dealt with in the title documents for the property, and typically will be the responsibility of the homeowners.
If a boundary structure falls into disrepair and causes damage or injury due to neglect, the owner could be held liable.
Property owners are primarily responsible for maintaining the boundary itself, whilst the council or highways authority in the area will be responsible for maintaining the surface of the public footpaths and highways.
You may still wish to contact the council to see if there is anything they can do, as you may find the boundary walls in question are on council land, or that they are already aware of their deterioration.
It just may be that if the council states that it cannot take action, you may be limited in the further action you are able to take.
What if the danger was a leaning tree?
Olivia Egdell-Page replies: Where a property boundary is formed by a hedge or trees, the highways authority can ask you to cut these back if they are causing an obstruction in the road or a public footpath.
If the homeowners refuse, the highways authority can access the properties without obtaining permission to undertake the work and they may also charge the homeowners for this.
That being said, the Court of Appeal ruled in the case of Sumner v Colborne that a highways authority owed no duty of care to users of a highway in respect of overgrown vegetation on land adjacent to the highway, which affected visibility at a junction.
The case was brought following an accident at the junction, and it was claimed that the highway authority had breached their statutory duty and were liable for negligence.
Whilst it was held the highways authority held a duty of care to users of the highway in respect of dangers that exist on the highway, no such duty was owed in respect of the dangers on land next to the highway.
The court further confirmed that individual landowners of properties which abut (touch or lean on) the highway do not owe a duty of care to the road users in respect of the maintenance and upkeep of their land.
How to find a new mortgage
Borrowers who need a mortgage because their current fixed rate deal is ending, or they are buying a home, should explore their options as soon as possible.
Buy-to-let landlords should also act as soon as they can.

What if I need to remortgage?
Borrowers should compare rates, speak to a mortgage broker and be prepared to act.
Homeowners can lock in to a new deal six to nine months in advance, often with no obligation to take it.
Most mortgage deals allow fees to be added to the loan and only be charged when it is taken out. This means borrowers can secure a rate without paying expensive arrangement fees.
Keep in mind that by doing this and not clearing the fee on completion, interest will be paid on the fee amount over the entire term of the loan, so this may not be the best option for everyone.
What if I am buying a home?
Those with home purchases agreed should also aim to secure rates as soon as possible, so they know exactly what their monthly payments will be.
Buyers should avoid overstretching and be aware that house prices may fall, as higher mortgage rates limit people's borrowing ability and buying power.
What about buy-to-let landlords
Buy-to-let landlords with interest-only mortgages will see a greater jump in monthly costs than homeowners on residential mortgages.

Staff left 'heartbroken' over Hull Sutton Fields pub fire
Staff at a pub in Hull have said they have been left "heartbroken" after a fire in the early hours of the morning caused serious damage to the crews were called to the Sutton Fields pub on Oslo Road at about 02:25 BST, according to Humberside Fire and Rescue pub's occupants had left the property and were all accounted for by the time the crews arrived, a spokesperson said.A statement from pub staff which was posted on social media said the blaze had been a "devastating event for the whole team" and it would remain closed until further notice. EXPERTS have revealed the common household appliances that are draining your wallet while you sleep. And most homeowners aren't even aware of the high costs associated with these items. 6 A survey from Utilita Energy found that 42% of energy account holders are unaware of the running cost of these everyday high-power electrical items. Chris Madikian, an electrical expert at The Local Electrician, rounded up the devices that run continuously or use standby power, which could be costing your household a significant sum over time. He explained that many appliances draw power even when appearing inactive, with some older models often being even less efficient. "When thinking about big energy consumption, many people focus on the usual suspects, washing machines or tumble dryers, but overlook the constant drain from devices that run 24/7," he said. The expert highlighted the most common unexpected energy consumers found in most homes. Old fridges and freezers 6 He revealed that certain fridge and freezer models may be racking up your energy bills. "Your fridge runs constantly, and older models of 10 years old or more use substantially more electricity than newer ones," he said. "Fridge freezers often draw between 100 and 250 watts, with older models costing households almost £300 a year. "So making sure what you have is running efficiently is a top priority, and this can be done by checking the energy rating." The expert also recommended making sure your fridge door is sealed properly and cleaning the appliance as well. "However, many set-top boxes and gaming consoles draw around three to five watts of electricity even when not actively used." Chris noted that disconnecting these devices or using smart plugs could save households between £40 and £60 annually. Vampire appliances that are draining your money Appliance expert Ian Palmer-Smith revealed the eight electrical products that may be increasing your household bills, even when they are left on standby. "Motion-activated security lights can use surprising amounts of electricity if poorly adjusted," he said. "If your lights get triggered by passing wildlife or swaying branches, this can waste energy throughout the night." He recommended making changes to your sensitivity settings or changing them to LED bulbs, which are generally more energy efficient. 6 Electric towel rails While electric towel rails are a nice touch in the winter months, they can significantly inflate your energy bills. "Electric towel rails often run continuously in bathrooms, and it's not something many of us think about in terms of energy consumption," the expert pointed out. "Many can use between 60 and 200 watts an hour." Installing a timer or thermostat can help manage their operation and reduce unnecessary energy consumption. 6 Chargers and power adapters And finally, the chargers for your various electrics could also be racking up your bills, even when not in use. "You may have several chargers plugged in around your home that continue drawing small amounts of power even when nothing is connected to them," Chris said. "Even though one charger not in use can only amount to just a few pence a year, having multiple chargers around the house can make this number build up." He suggested unplugging chargers when not in use or using power strips that can be switched off completely. 6 The expert advised people to search their homes to find anything that can be secretly adding to their energy bills. "Walk through your home and note anything that stays plugged in continuously," he said. "Consider upgrading older appliances, especially fridges and freezers, to more efficient models." Smart meters can help identify usage patterns and find unexpected energy guzzlers. Many UK energy suppliers now offer these devices free of charge to customers. New research shows that messy or neglected homes next door can wipe as much as £89,000 off your house price, according to Churchill Home Insurance. 1 From overgrown lawns and broken fences to rubbish-filled drives and shoddy DIY jobs, a scruffy property next door can seriously sabotage your sale. According to a survey of estate agents by Censuswide, homeowners across the UK could lose £43,000 on average, or 16 per cent of their property's value, thanks to untidy neighbours. Matt Lanniage, from The Property Expert, also pointed out that having a messy neighbour could put a buyer off completely. He said: "A neighbour's garden is not only a matter of first impressions; it's also an indicator of the type of person you are about to move next to. "I've sold homes on the same street as much as 10% more if it can be highlighted that the neighbours are nice and considerate. With permission we often use the neighbours first names as part of our marketing strategy." But can you order a neighbour to tidy up? we spoke to experts to find out. Can I make my neighbour tidy up? Almost all estate agents, 97 per cent, in fact, say you should try talking to your neighbour first. A polite conversation can go a long way. Some people might not even realise their home is putting off potential buyers. Sarah Khan, Head of Churchill Home Insurance, said: "Sometimes, a simple, friendly conversation with your neighbour could be the most valuable step you take before putting your home on the market." You could even offer to help, especially if your neighbour is poorly or elderly. Patrick Ansell, head of litigation at Taylor Rose, said: "In most cases, the cause is unintentional. The owner could be elderly or unwell, or the property might be vacant due to probate etc." "A respectful conversation is usually the best first step. Most people are reasonable and may already be aware of the issue, but unable to resolve it without help." If you've tried and nothing's changed, you might need to contact Citizens Advice or your local council. But this should be a last resort. If you do need to go down this route, then it's worth being prepared, Mr Ansell added. He said: "Before escalating, it's wise to document everything first. Keeping a diary of conversations and key events (e.g. incidents) and taking photos can be vital evidence if legal action becomes necessary. You should also consult an estate agent to understand how much the problem is affecting your property's value, although there is no guarantee that a successful claim will result in this amount being awarded to you. "Disputes must be disclosed when selling a property, which can deter buyers, so resolving the issue early is normally in everyone's best interests." How to boost your home's value While you can't control your neighbour's mess, you can make your own home irresistible to buyers. Property expert Liv Conlon, who stages hundreds of homes each year through her business says first impressions count - and fast. 'You've got 10 seconds to impress a buyer. Make it count,' she says. Start by giving your entrance a glow-up: a fresh coat of paint on the front door in a smart shade like black or navy, two matching potted plants, and a spotless doormat can totally transform your kerb appeal. Inside, focus on the living room — clear clutter, pull sofas away from the walls to create cosy conversation zones, and use a large rug to define the space. Statement accessories like oversized lamps or chunky vases also give the impression of a polished, show-home finish. And don't forget the bathroom. Fresh towels, a matching soap dispenser and a clean bath mat can make even a basic space feel more luxurious. Simple styling updates can cost just a few quid, but add serious value when it's time to sell.
