Opposition must tell govt — no support in Varma matter till inquiry set up against Yadav: Kapil Sibal

Opposition must not support any move by the government to impeach Justice Yashwant Varma till an inquiry is set up under impeachment proceedings against Justice Shekhar Yadav for his "communal" remarks, Rajya Sabha MP Kapil Sibal said on Saturday (July 12, 2025).

In an interview with PTI, Mr. Sibal contended that the case of Justice Varma, who is embroiled in a row following the discovery of burnt wads of currency at his residence after a fire incident, was not one of corruption and so the parties thinking that they should support action against the judge as it is graft matter should review their position.
The Independent Rajya Sabha MP claimed there could be two motives of the government in moving ahead with bringing an impeachment motion against Justice Varma — they are unhappy with with him because he is "one of the most independent High Court Judges" and alternatively they may be thinking that this is a "great opportunity to put pressure on the courts" and try to bring another form of the National Judicial Appointments Commission (NJAC).
"I think the institution has broad enough shoulders to withstand such moves of the government," he said.
Asked if the situation arises, would he be ready to defend Justice Varma in Parliament during impeachment proceedings, Mr. Sibal, who is also a senior advocate, said, "This is just an academic issue, first the judge has to ask me." Mr. Sibal's remarks come amid the government beginning the exercise of collecting signatures of MPs to move a motion in Parliament to remove Justice Varma.
Sources said signatures of many MPs from the Lok Sabha have been collected for the impeachment exercise, an indication that the motion may be moved in the Lower House.
Parliamentary Affairs Minister Kiren Rijiju has said that a motion to remove Varma will be brought in Parliament's next session, beginning from July 21.
Slamming the government for moving ahead with collecting signatures, Mr. Sibal said, "First of all, what has the government got to do with this? Under the Constitution, either 100 members of the Lok Sabha or 50 members of the Rajya Sabha can move a motion for impeachment. The Constitution process dehors the government."
The fact that the government is collecting signatures means that it is interested as an entity to move the motion and impeach him, whereas the Constitutional process dehors the government, he said.
"I am a bit surprised, but this is what happens when you have governments moving impeachment motions. Obviously, they don't want the judge for reasons that they know best," Mr. Sibal said.
Asked what his message would be to Opposition parties, Mr. Sibal said this is not an issue of parties at all, and even the government is erroneously moving through by collecting signatures.
"It has nothing to do with the government, it has nothing to do with Opposition parties. It is something to do with members of Parliament. If the opposition parties give a diktat, fifty MPs will sign. And if a government gives a diktat, a hundred will sign. But the question is, this itself is constitutionally impermissible," he contended.
Mr. Sibal said the Opposition should get together and say what he has been saying -- "before an MP appends his signatures on the motion, there should be an investigation".
And because the judge belongs to the higher judiciary and there is a special constitutional procedure for impeachment, it is the Supreme Court that should actually move the matter and lodge an FIR for finding out as to who put the money there, he said.
He also said that the Opposition should first seek the setting up of an inquiry against Justice Yadav under impeachment proceedings after the Opposition MPs in December 2024 submitted a notice in the Rajya Sabha to move an impeachment motion against him for allegedly making "communal remarks" last year at a VHP event.
"Otherwise, it seems that this (action against Justice Varma) is being selectively done by the government, and the BJP is after this judge and is protecting the other judge. That should be the right stand of the Opposition parties," Mr. Sibal said.
"I think, leaders of the Opposition should take a position that no question of us supporting this motion till such time as the inquiry (against Yadav) is completed or you (at least) set up the inquiry against Justice Yadav," Mr. Sibal said.
Delving into the Justice Varma case, he said it is a very peculiar one but is "not a case of corruption".
"I think some political parties are thinking that because it is a case of corruption, therefore, we must support. They must get it out of their minds because this has nothing to do with corruption," he said.
Detailing the sequence of events, Mr. Sibal said, "Where is the cash?...the fire happened about 11:30 p.m. on March 14, and the fire services department reached there and doused the fire.
"It is between 11:59 PM and 12:11 AM that certain videos were taken, and the police were present there. The police as well as the fire services personnel were present at the site till 1:56 AM (March 15). Between 12:11 AM and 1:56 AM, we have no idea as to what happened to the cash." The police could have also lodged an FIR against unknown persons because they did not know who placed the cash there, Mr. Sibal said.
"They should have seized some currency and if you got a few notes that were complete and not burnt, the police could have found out which bank it came from, when it was recovered, what is the source of it, some investigation would have been done," he said.
Mr. Sibal claimed that the Delhi police "completely failed" to do its job. "The fire services department don't do their job, the Delhi police don't do their job the committee doesn't do its job in finding out as how that money was placed there and the entire burden is shifted to the judge who says 'the money does not belong to me and I did not know how it came there'.
"So, how do you move an impeachment motion against this evidence?" Mr. Sibal asked. He said the Supreme Court committee's findings have no constitutional relevance because it is part of an in-house procedure.

(Bloomberg) -- A federal judge in Los Angeles issued an order temporarily blocking US authorities from using racial or ethnic profiling during immigration sweeps in the region and requiring that detainees get access to lawyers. The order Friday by US District Judge Maame Ewusi-Mensah Frimpong is the latest fallout from the Trump administration's controversial crackdown on migrants in California and across the US. It came in a lawsuit by a group of Southern California residents, workers and advocacy groups who accused President Donald Trump's administration of terrorizing the population with heavy handed and unconstitutional tactics. 'Today's historic ruling means the federal government cannot fence off the Constitution from Los Angeles and surrounding communities,' said Mark Rosenbaum, a senior lawyer at Public Counsel, which represents the plaintiffs. 'The question now for our federal government is whether it is prepared to conduct its operations under the rule of law. To date, the answer has been no.' The judge said she will hold a hearing later on the groups' request for a longer-lasting preliminary injunction that would block the alleged conduct while the lawsuit proceeds, which could take months or longer. The judge barred agents in the Los Angeles area from stopping and questioning individuals without reasonable suspicion that they're in the US illegally. The order forbids the agents from basing their suspicion on race, ethnicity, speaking Spanish, speaking English with an accent, the type of the work they do or where they are located. Tricia McLaughlin, a spokeswoman for the Department of Homeland Security, said 'a district judge is undermining the will of the American people.' 'America's brave men and women are removing murderers, MS-13 gang members, pedophiles, rapists — truly the worst of the worst — from Golden State communities,' she said in an emailed statement. 'Law and order will prevail.' The government didn't provide evidence in the case that the people being detained in the area had committed such crimes. The order by Frimpong, who was appointed by former President Joe Biden, is a rebuke to the administration's raids by Immigration and Customs Enforcement agents in public spaces to make mass arrests. It comes as a wide swath of the most populous state's Democratic elected officials, from Los Angeles Mayor Karen Bass to Governor Gavin Newsom, have slammed the Trump administration over its alleged conduct. The disputed tactics include using National Guard troops to protect ICE agents during immigration sweeps and deploying US Marines in downtown Los Angeles to help quell protests, both of which triggered separate lawsuits. But the targeting of suspected migrants by masked and armed immigration agents has been a focal point of Democratic criticism. 'Armed to the hilt, masked, and driving unmarked cars, they have adopted a central strategy of grabbing people first and asking questions later,' the groups said in their request for a restraining order. Trump has argued that his tactics are in line with the president's constitutional authority to carry out immigration policy and that voters elected him to follow through on his vow to deport millions of undocumented immigrants. Trump has frequently portrayed migrants as criminals who pose a threat to Americans, but court records show many law-abiding noncitizens have been swept up across the country. The groups that sued in Los Angeles, the second-largest US metropolitan area and a focal point of Trump's effort, argued in court filings that federal immigration agents are violating the Constitution by conducting stops 'without reasonable suspicion' that the individuals were in the US illegally. The agents are trying to meet 'an arbitrary quota for 3,000 daily arrests imposed by the White House,' the groups said. 'But while defendants may believe that immigration enforcement can be a numbers game, the Fourth Amendment requires that seizures be reasonable,' they said in a filing. The filings cite detailed examples of alleged wrongdoing by federal agents, including a man who says he was 'grabbed' at a car wash and interrogated by agents who knew 'nothing more at the time than that he had brown skin and was present at the car wash.' Another man, a plaintiff in the suit, was detained at a tow yard where he was working on his car. 'He told them he was American, but they violently persisted in their questioning, demanding that he tell him what hospital he was born in, and only let him go after he showed them his Real ID, for which they had not even asked,' according to the filing. The plaintiffs argue that 'roving patrols' targeting day laborers, street vendors, farm workers and other were 'expressly directed' by White House Deputy Chief of Staff Stephen Miller, who told high level officials at ICE to 'just go out there and arrest' unauthorized noncitizens by rounding them up in public spaces like 'Home Depot' and '7-Eleven' stores, according to court filings. The groups allege that similar racial profiling has been underway at raids in agricultural sites, bus stops, packing houses and churches. In 1766, Sweden enacted the world's first law recognising a people's right to access information from their government. Interestingly, its advocates employed a tailored image of governance mechanisms in Imperial China to support their campaign for a law that guaranteed the freedom of the press to report on governmental actions and curbed State censorship of public debate. Citing the Peking Gazette, whose origins can be traced to the Tang Dynasty's regime, they argued that it was the vehicle for communicating information about governmental action to the people and conveying their feedback to the Emperor – characteristic features of transparent and accountable academics have exposed this propagandist, though noble-intentioned, portrayal of pre-Communist China's administrative practices. Information flows from the capital to the populace were strictly controlled by a conservative bureaucracy, and commenting on the Peking Gazette's contents invited corporal punishment or even the death penalty. While eulogising the Chinese model in support of their democratising aspirations, Sweden's transparency champions had turned a blind eye towards the highly centralised and control-obsessed administration's efforts to gather more information about subjects of the recent order of our own Election Commission of India (ECI) requiring every voter in Bihar to prove one's place and date of birth as a bona fide Indian citizen by furnishing documentary evidence, or risk disenfranchisement, smacks of similar imperiousness. Yet, after 20 years of implementing the RTI Act, which emphasises records maintenance, the ECI has shockingly claimed that it is unable to produce a copy of a similar order for the intensive revision of voter lists in Bihar issued in 2003. While the ballot has been digitised, old paper-based files containing a record of the ECI's work seem to have escaped that destiny. Two years ago, its staff told me, a lot of information sent from the states and the districts about recent elections, simply cannot be traced in the multi-storeyed Nirvachan readers dismiss my words as hearsay, here is a sample of election-related records which the ECI claimed, in RTI replies, it does not hold or never received from the states relating to the 2024 Lok Sabha polls. When asked for the complete list of Returning Officers (ROs) of the constituencies (as they are not displayed on the website), the ECI replied nonchalantly that no such list is available with it and refused to transfer the request to the states and the UTs!.In response to my RTI application seeking a list of expenditure-sensitive Lok Sabha constituencies that must be monitored more closely for campaign spending, the ECI replied that it does not have a readily available list and compiling it would disproportionately divert its resources. It also rejected a proactive disclosure of the expenditure observers' quizzed about the suspicious transaction reports (STRs) received from banks that are required to monitor large-sized monetary transactions during the campaign, the ECI claimed that no such information is available with it. Refusing to disclose even the number of STRs it received, ECI instructed me to approach the district election officers asked for a copy of the reports ROs send after scrutinising all documents created during polling, the ECI replied that the records sought do not even fall within the definition of 'information' under the RTI Act! In the wake of the controversy about voter turnout figures in Maharashtra last year, the ECI told me, in writing, that it does not have information about the number of voters who were issued pre-numbered tokens to cast their vote after 5 pm even though its election manual requires ROs to submit such reports through their Chief Electoral asked to publish reports sent by the states after mapping Lok Sabha constituencies, or pockets within them, where voters are vulnerable to intimidation and illegal inducement, the ECI claimed that it does not have such information in its records. This lie stands exposed. An RTI activist successfully obtained these vulnerability mapping reports from Maharashtra's Chief Electoral Officer. They were dispatched to the ECI on March 27, 2024!.Much like the no-data-available governments holding fort across the country, the ECI is turning crucial election-related information into sarkari secrets, especially that which is required to establish its accountability. The citizen-State relationship envisioned by the Constitution to guarantee the dignity of every individual is in danger of becoming a master-servant fetter. Bihar seems to be the laboratory for an iniquitous experiment that might soon be repeated across the country.

Noting Babasaheb's efforts to put women and the marginalised on the societal map, Sinha said that it must be the responsibility of every section of society to give priority to the 'deprived'. 'Through the creation of the Constitution, Babasaheb had laid the foundation of the reconstruction of the nation through values like selfless service, perseverance and sacrifice. I believe it is the responsibility of every section of society to give the highest priority to the deprived. He did a great job to ensure that women get their rightful place in society,' Sinha said while addressing a gathering at the Women Empowerment Program at Organized At Army Goodwill School. He remembered Babasaheb for his struggles in eradicating all social and economic discrimination decades ago. 'I believe that Babasaheb Bhimrao Ambedkar was a shining star in the galaxy of thousands of great men in India. The way he had resolved to eradicate all social and economic discrimination seven decades ago through his struggle, sacrifice, dedication and loyalty, those values are still guiding the entire country,' Sinha said. 'It is definitely necessary to remember that the Constitution made by Babasaheb was the first Constitution in the whole world, which gave equal rights to women without any discrimination,' he added. Earlier on July 10, Sinha inaugurated the grand exhibition Bharat Sanrachna Jammu & Kashmir in Srinagar and highlighted the transformative journey of the region in recent years. LG Sinha said that Jammu and Kashmir was witnessing a transformation that, according to many, is unprecedented even in the past fifty years and is a precedent to the fact that 'terrorism will not sustain here.' He said, 'A significant and profound transformation has taken place in Kashmir. I have completed five years, but people say that even in the last fifty years, such a change has never occurred. On April 22, when innocent civilians were targeted in Pahalgam, the way Kashmir rose against the barbarism, against terrorism, against Pakistan, I believe such a moment has never occurred in history. This clearly shows us that terrorism will not be able to sustain itself here.' He also added that while police and security forces are carrying out their responsibilities, it is the people's rejection of terror that signals a decisive shift. (ANI)
