‘Scary stuff': Locals on crash corner fear it will take a death to get it fixed

Locals on a busy Tauranga street fear someone will die before anything substantial is done to improve safety on a bend notorious for crashes.
Three times in the past year, a car has ploughed into the retaining wall of Mike's home on Courtney Rd in Gate Pā.
Courtney Rd runs between two shopping centres on Cameron Rd and Fraser St, with Mike's house on a hill between two corners.
The street has a long history of crashes. Mike, who didn't want his surname published, said he lived there for 16 years. In that time, he said, four crashes had done damage and there'd been countless smaller accidents, including cars mounting the kerb.
Last year, before Mike moved out, he had just got out of his ute when a car came through the retaining wall. A few seconds earlier, and it would have crushed his leg.
Mike said his tenant and her child were narrowly missed by a car in one recent crash, and he is worried someone will be killed.
It was "pretty scary stuff", and Mike said his tenants lived in fear of being hit.
In an accident years ago, a car hit the wall with so much force that blocks went flying and broke house windows, he said.
"We can't get insurance on that wall, because these pricks keep going through it."
His insurance had gone up and he had to cover the cost of repairs if the driver or their insurance company didn't pay, he said.
Mike wants Tauranga City Council to extend a metal safety barrier from the corner toward his property to improve safety but has been told it's too expensive.
"Is it going to take somebody to die to do something?"

Mike's property manager, Toni Cranston, wrote to the council after the tenants threatened to leave because of the crashes.
Cranston contacted the council several times, asking it to extend the safety barrier or put speed bumps on the street, but she too was told there wasn't a budget for the safety measures.
The last three major crashes happened between 3pm and 4pm when children were walking home from school, she said. There were five schools in the area.
"There's a lot of traffic going through there, and it's a really sharp, ugly bend that can change very quickly, especially when you're not paying attention.
"The concern for the tenants, the owners, the people in that community, and obviously the schools around, is that if one of these cars does hit a child, you're calling death.
"They're always speeding, so you're almost guaranteeing a death."
Cranston also contacted the police, asking them to have more of a presence on the street to discourage speeding and dangerous driving.
Mike's neighbour Steve Kelly said he was lucky his house had never been hit.
"It's just been pure luck that nobody's actually been taken out or seriously injured."
He agreed extending the barrier would protect pedestrians and the homes.
"For the small cost that it would cost the council to stick in 10m of fence and posts - a bit of a barrier - it could be lifesaving."
Kelly said traffic had increased on Courtney Rd since 2020 as people used it as a shortcut between Cameron Rd and Fraser St, with the problem expected to worsen with a new housing development nearby.
The council's acting safety and sustainability manager, Karen Hay, said that because of the high cost of physical safety measures, the council evaluated requests based on vehicle speeds, traffic volumes, accessibility, and crash data.
This was to ensure all safety concerns were addressed fairly and equitably, she said.
"Areas where deaths or serious injuries have occurred are given higher priority."
Two non-injury crashes and one minor-injury crash had been reported on the Courtney Rd bend in the past five years, said Hay.
But the council relied on crash data from police, and they did not attend all incidents, she said.
After an investigation, lower-cost safety improvements were planned for installation in August or September, Hay said.
These were a centre line, "slow down" road markings, reflective chevron boards and a speed advisory sign of 25km/h on the downhill approach to the corner, where the issues were most prevalent.
"We are confident these will help the current situation, and the situation will be monitored."
The median barrier could be extended, but it would need to be prioritised for future consideration, she said.
Traffic volumes on Courtney Rd had steadily increased over time, Hay said.
The average daily traffic count increased from 6080 vehicles in 2008 to 7870 in 2023, with an average speed of 43.9km/h in 2023.
In 2024, it was 7272 vehicles with an average speed of 43.5km/h.
These speeds were well within a "reasonable range" of the 50km/h limit, Hay said.
Police said the local road policing team were not aware of any requests for more regular patrolling in the area.
With two of the recent crashes, police said, the drivers were not over the speed limit, but they were going too fast around a sharp corner.

Patient not drug tested hours before second killing, father alleges

Photo: RNZ A mental health patient was not drug tested on the day he committed his second killing because the staffer believed he was "acting cagey", his father alleges. The man was subject to a compulsory treatment order at the time, which meant that drug screening occurred on a voluntary basis. But if he failed the test, the clinician would then need to assess whether the patient should be re-called to hospital. RNZ earlier revealed the man - who was made a special patient under the Mental Health Act after his first killing - was recently found not guilty of murder by reason of insanity for a second time after killing someone he believed was possessed. RNZ is unable to publish details regarding either killings due to an appeal against name suppression that is due to be heard by the Court of Appeal. RNZ has obtained a copy of a letter from the man's father to the presiding judge. Do you know more? Email The man's father alleged that on the day he killed for a second time, he was supposed to be drug tested. "He turned up for the appointment but was not tested because the staff member said that he was acting cagey and she didn't want to make him feel like he was being picked on. "This is a so-called health professional who observed unusual behaviour from a person with severe mental health issues and they didn't do anything about it. She didn't test him and basically allowed him to leave. A few hours later [he killed again]." The man said his son told him he had to go have a drug test "so he was expecting it, but nothing came of it". The man's second killing "could and should have been prevented," the father says. "How can someone who has previously killed another person be able to remain free when the warning signs are right there for all to see?" In the weeks leading up to the second killing, the man's mental health was "rapidly declining", a judge earlier said. He was admitted to a mental health facility following an altercation with a relative. About a week later he was released. He was having relationship problems and was using cannabis. Five days after he was released from the mental health facility, he stabbed someone to death. In his letter, he said his son had mental health issues "for most of his life". "I have attended countless appointments and meetings relating to [him] and his treatment, and I have full knowledge of the process, his medication and it's effectiveness, the downsides and how he has responded over the years. "I have met his doctors and psychiatrists and have a good understanding of the mental health system, what services are provided and some of it's failings." He discussed his son's admission to a mental health facility before the second killing when his mental health "deteriorated". He said the staff should not have released his son. The second killing was "predictable if anyone bothered to look at the warning signs and do something about it," he said. "Predictable in the sense that [he] was on a downward spiral. Maybe not predictable with the exact date and time, but the warning signs were there for the health professionals to see. To use their judgement and training and to actually do something about what they saw instead of just letting it go because it gets too hard for them." He said the health system was "not aggressive enough to make decisions". "For more than 5 years I visited [him] every night in one of their institutions, so I know full well what goes on inside the walls. There are more questions than answers. The health system had [him] in their custody and released him. A health professional saw [him] on the day he killed [again], described him as being cagey, did not do the blood test and let him go without doing anything. How? Who is accountable? How can someone who has previously killed another person be able to remain free when the warning signs are right there for all to see?" RNZ put the allegations regarding the drug test to both Health New Zealand and the Ministry of Health. Health New Zealand (HNZ) said an external review of the care the patient received leading up to their alleged offending is in progress. They did not comment on the allegations. In most situations screening for substance use occurred on a voluntary basis and could include individuals subject to detention under the Mental Health Act on Compulsory Treatment Orders, an HNZ spokesperson said. "However, screening is very much part of an individual treatment/care plan where interventions may be put in place in the event of a positive result or refusal to be tested." Director of Mental Health Dr John Crawshaw said in a statement that in circumstances like these an independent review is triggered to investigate the incident and make recommendations for changes to services and for those recommendations to be acted on. A review was still underway. "The claim of reported drug use and delays in drug testing would be most appropriately investigated by the independent review commissioned by Health New Zealand." In relation to drug testing, a Ministry of Health spokesperson said screening for substance use occurred on a voluntary basis and can include individuals subject to detention under the Mental Health Act on Compulsory Treatment Orders. "Screening is very much part of an individual treatment/care plan where interventions may be put in place in the event of a positive result or refusal to be tested. "For further background, it also depends on whether the person is on an inpatient order or a community treatment order. If the testing is part of a condition of leave on an inpatient order it can result in the leave being cancelled. If the person is on a community treatment order, the responsible clinician would then need to assess whether there is enough concern to direct the patient to be treated as an inpatient. It's important to note that this applies to people under ordinary Mental Health Act orders and there is a separate process for special patients." Mental Health Minister Matt Doocey said any serious incident, particularly one where someone was killed was a "cause of very serious concern". "That is why it is important that reviews are triggered and recommendations for changes to services are acted on. My focus is on ensuring agencies involved are putting in place the necessary changes to help prevent these incidents occurring again. "There is an external review underway, and it would be my expectation that this review will cover the care this person received leading up to the incident." How effective has the road cone hotline been?

Photo: Ke-Xin Li More than 650 reports have been made to the road cone hotline within its first month, but how effective has it been on the streets of Auckland? It is lunchtime in central Auckland, and the Wellesley Street Upgrade project is well underway. One day it will be a connection to the City Rail Link - but right now there is construction noise and a bright orange line of road cones. "We work around here, so it's been like this forever. Just used to it now, but looking forward for them to go away," a woman who was heading out for lunch told First Up. Minister for Workplace Relations and Safety Brooke Van Velden announced significant shifts to rebalance WorkSafe's focus last month, kicking off with a road cone hotline. Photo: Auckland Transport On the streets of Auckland, attitudes towards the hotline - which is actually an online form - were mixed. Some welcomed it. "I've been tempted (to report)," said one person. "I think there are way too many of them (road cones), I think they are overused." Some opposed it. "There's an excessive focus on road cones. They are a sign of progress, I love progress so I have no problem with excessive road cones." Some were not sure whether that was the solution to their problems. "Auckland has a lot of road works, but I don't know if I would call a hotline." Since launching in June, the hotline received nearly 400 valid reports in week one, 126 in week two, 71 in week three and 70 in week four. The digital hotline collects complaints and sends reports to road controlling authorities. Among all road controlling authorities, Auckland Transport received the most complaints, with nearly 200 reported. "I think that's fairly expected because we're the largest city, we've got the most people and we've also got quite a lot of development going on. So there are a lot of work sites." Berkahn said investigating all of the complaints had created quite a bit of extra work for her team of six, but it had led to improvements. "We had one particular case in Albany where it was in a business area where there was a piece of electrical maintenance work being done. We had diggers and generators and tools on site. But when we went out, we realised that the site probably had about 30 too many cones. The work site was larger than the plan what's submitted to us for approval, and we talked to the site supervisor and they removed about 30 cones to make that site smaller, to be less disruptive on the businesses and the motorists in the area." Berkahn said on an average day, there were 2000 active sites in Auckland. There are a lot of road cones in Auckland, but do people consider it excessive? Photo: Ke-Xin Li Among the 200 sites investigated from the hotline reports, 30-40 percent of them had either too many or too few cones. "Quite often when we go out (to investigate), we find where the customer thinks there are too many cones, it might be that there's been a lane created for pedestrians. And if you're driving past in a car, all you can see are orange cones. But if you're walking down that lane as a pedestrian, you're much safer because you're kept away from the machinery on the work site and the cars on the road are kept away from you." Berkahn said Auckland Transport had an existing cone reporting system, but the hotline generated greater public awareness. "The one thing that I would like listeners to understand is that it's been really positive having this relationship with WorkSafe and being able to contact customers about their queries and explain sometimes why those sites are necessary and how they're providing safety." Wellington City Council received 57 complaints in the first week but after a month that had dropped to just 8. The council declined to be interviewed but in a statement said they believed complaints had fallen because the novelty of the hotline is wearing off, and that no cones has been removed due to a hotline report. Meanwhile, Christchurch City Council has received 40 complaints. In a statement, transport operations manager Stephen Wright sid while they found most of the sites were compliant, any issue that needed to be addressed by the contractor were discussed from an education approach in the first instance, but it was up to the contractor to decide whether the cones were needed or not. Photo: Ke-Xin Li Back on the streets, Temporary Traffic Management workers were split on whether the road cones themselves - and the hotline - worked. "I think there's too many of them and it's a great idea there is an 0800 number," a worker with four years' experience in site management told First Up. "I think that (the hotline) is an overkill. There isn't a problem unless it's blocking a car park or it's limiting businesses to customers. Now I think the problem is people like myself are kind of bending those rules - more cones have been putting out than what's needed and some don't pick up their gear after they've finished their site. But then the other flip side to that coin is gear getting stolen, so therefore what was safe before was not safe anymore because there weren't enough cones. "If it weren't for people like me, people would be driving into trenches and driving into holes," a TTM manager with more than 10 years of experience told First Up. RNZ asked another worker how he would feel if I took half of the cones away from his site. It was a definite "no" from him. He said sometimes when pedestrians saw a gap between the cones they would try to cross the road, and the closely lined up cones kept pedestrians safe and made sure they followed the rules. WorkSafe said the road cone hotline will be reviewed at the end of the year.
