Private Health insurer Bupa agrees to repay $35 million over incorrectly rejected claims

One of Australia's largest private health insurers has agreed to pay back tens of millions of dollars to thousands of members who had hospital claims incorrectly rejected.
Bupa has admitted to engaging in misleading or deceptive conduct and making false or misleading representations by advising members they were not entitled to private health insurance benefits when they were.
Bupa reached an agreement with the ACCC on a proposed penalty of $35 million for incorrectly assessing thousands of mixed coverage and uncategorised item claims and related eligibility checks over a five-year period.
The company also admitted to engaging in unconscionable conduct relating to its assessment of 388 mixed coverage claims, which included treatment that was covered under a member's private health insurance policy as well as treatment that was not covered under their policy.
In a statement, Bupa APAC CEO Nick Stone said the issue should "never have happened" and the company was "deeply sorry for failing to get things right for our customers".
Bupa, is Australia's second largest private health insurer and has more than four million members.
It has already started compensating affected members, medical providers and hospitals and has so far paid $14.3 million with more than 4,100 affected claims.
ACCC Chair Gina Cass-Gottlieb said the consumer watchdog had accepted Bupa's undertaking to continue compensating affected parties.
"Bupa's conduct ... caused harm to consumers some of whom delayed, cancelled or went without treatment for which they were, at least partially, covered under their health insurance policies," Ms Cass-Gottlieb said.
Bupa said the errors occurred as a result of inaccurate or unclear instructions, training or guidance which meant Bupa didn't always make correct assessments of claims and eligibility checks or act quickly enough to fix issues.

'The wining bidders even booked a building inspection the day before the auction and made their decision within hours. It was a big moment for them.' 'Despite what some have said about a downturn, every auction we've taken to market recently has sold. 'We're seeing some of the strongest winter numbers since Covid.' Mr Kudruj added that more Sydney and Queensland investors were circling Wyndham in particular and warned local buyers holding out for more rate cuts that it could cost them. 'Waiting could mean paying $30,000 to $50,000 more for the same home in six months,' he said. 'The market's already shifted since the last two cuts.' As for the sellers, who had previously been listed with three other agents without success, the turnaround came as welcome relief. 'We ran a four-week campaign and sold it under the hammer. They were over the moon,' Mr Khudruj said. Other notable results in Wyndham last weekend included $816,000 for a four-bedroom home at 5 Broadlands Crt, Hoppers Crossing, and $655,000 for a similar-sized property at 4 Chloris Crt, Tarneit.

The humble pub shout is tipped to be a thing of the past as younger Australians shy away from it thanks to the help of a simple technology. Australians are using QR codes as a way of individually ordering drinks at the table, ending the classic pub shout, research released by payments platform Tyro shows. 'Both (millennials and Gen Z) are more accustomed with modern ways of paying – these consumers are now used to paying individually at the table while they socialise rather than relying on one person to order for the whole group at a crowded bar,' he said. According to the findings, millennials are the least likely to buy a friend a drink, with 42 per cent opting against that tradition, followed by Gen Z and Gen X. Baby boomers are the most likely to shout a friend, but still one in three use QR codes as a way to avoid buying drinks. The report also highlights cost-of-living pressures are clearly having an impact on Australians' spending patterns, with nearly one in two Aussies changing their alcohol consumption due to costs, while one in 10 have quit the drink altogether. Beyond drinking, more than half are now comparing prices, delaying non-essential purchases or hunting for discounts. Not only are millennials the least likely to buy a drink for their friends, they are also the most annoyed at having to pay a holiday surcharge. Australians say QR codes are making it easier to avoid a shout. The Agrestic Grocer and Cafe owner Beau Baddock said these charges were essential for business. 'Holiday surcharging isn't about making a profit, it's about ensuring I can pay my hardworking staff their wages … I also want to provide visitors and locals with somewhere to go. If we don't on-charge our extra wage costs, we'd have to close,' Mr Baddock said.
