
Oman: CPA cracks down on sale of used tyres
The action was taken in line with the Consumer Protection Law, which prohibits the sale of used tyres due to the risks they pose to consumers.
The seized tyres were impounded, and legal measures have been initiated against the violators. The CPA stated that the ban on used tyres is aimed at ensuring public safety.
As part of the recent amendments to the Consumer Protection Law, penalties for violating tyre sale regulations have been increased.
The fine, previously set at RO500, has been doubled to RO1,000. For repeat offenders, the penalty will be doubled again, with an additional fine of RO50 per day for continued violations, up to a maximum of RO2,000.
The amended regulations, which took effect on August 19, 2024, reinforce an existing ruling (No 257/2015) that bans the sale of used tyres in Oman.

Promoting fake products online is regarded as an electronic fraud under Article 40 of the UAE's Federal Law No. 5 of 2012 on Combating Cybercrimes, which cannot be considered a minor commercial violation but is a serious offense with legal consequences, according to Lawyer Adnan Obaid Al Shaali. Al Shaali explained that perpetrators often create fake accounts, websites, or data on social media platforms or e-commerce sites, using deceptive images or false claims about non-existent products or services at the aim of misleading consumers and unlawfully seize their money for illicit gains. He further highlighted that Article 11 of the UAE law stipulates penalties for creating a fake website, account, or email address and falsely attributing it to an individual or entity. Offenders face imprisonment and a fine ranging from Dhs50,000 to Dhs200,000, or either of these penalties. In case the fake account or website is used to defame the person it is attributed to, the punishment is escalated to a minimum of two years' imprisonment. Regarding the dud cheques, Dr. Nasr said that the cheque is considered an executable instrument under the UAE Commercial Transactions Law, which allows the holder to directly approach the Execution Judge to recover the owed amount without initiating criminal proceedings or filing a police report. Dr Nasr said that the holder has to go through several steps to obtain his money including getting bank notification or bank endorsement on the back of the cheque stating "insufficient funds" and a certificate detailing the issuer's account information. Step two can be done by submitting Execution Request to the competent civil court, attaching the bounced cheque, bank certificate, and proof of debt, while in step 3, the court will notify the debtor to pay the amount within 15 days of receiving the notice. As a precautionary measure, the holder can request a travel ban on the debtor until the debt is settled. Dr Nasr stated that under recent legislative amendments, a bounced cheque is no longer a criminal offense, except in specific cases such as: Using it for fraud, withdrawing the entire balance before the cheque's due date, forging the cheque or issuing an illegal non-payment order to the bank.

Abu Dhabi Police's Traffic and Patrols Directorate has urged motorists to avoid stopping on the shoulder of the road except in emergencies, especially around the Darb toll gate where traffic violations have been detected by the smart monitoring systems. Some drivers stop unjustifiably on the shoulder of the road while waiting for specific periods when tolls are not charged, posing a risk to the safety of road users and negatively affecting the traffic flow traffic, it said. It noted that it had observed dangerous behaviours, including sudden swerving, obstruction of traffic and unauthorised entry into public bus stops. The directorate urged drivers to abide by traffic laws and regulations and avoid committing violations such as wrong parking and obstruction of traffic, as a fine of Dhs500 would be imposed on each of these violations. Sudden deviation is considered as a serious traffic violation and a fine of Dhs1,000 plus 4 black points would be imposed on offenders, while using designated bus lanes or stops will incur a fine of Dhs400, in accordance with the provisions of the ministerial resolution no. 178 for 2017 regarding traffic control rules and procedures, it said. Abu Dhabi Police stated that these behaviours were monitored through the smart systems and legal action will be taken against offenders so as to maintain the safety of road users and ensure smooth traffic flow.
