
How a procedural lapse led to acquittal of Haryana doctor-couple in a 19-yr-old PNDT Act case
In its order pronounced Thursday, the HC observed the complaint against Dr Mahender Kamboj and Dr Renu Kamboj, the directors of M/s Kamboj Ultrasound and Diagnostic Pvt Ltd, was not instituted by a competent authority as required by the Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act, or the PC & PNDT Act.
Gurugram: A doctor couple from Haryana's Hisar booked under the prohibition of sex selection act 19 years ago has been acquitted by the Punjab and Haryana High Court on the grounds that proper procedures were not followed while filing the case against them in 2006.
'In the instant case, the complaint was filed by Dr S.K. Naval (then civil surgeon) alone and it ought to have been filed by a three-member Committee, appointed by a Notification under Section 17 of the PC and PNDT Act. The same not having been done, the very complaint itself is not maintainable and therefore, the subsequent proceedings and conviction stands vitiated,' Justice Bedi stated in the judgment.
The case dates back to October 2006 when, following reports in various media outlets, the then civil surgeon of Hisar constituted a team that inspected the premises of Kamboj Ultrasound and Diagnostic Pvt Ltd.
The team seized records and sealed four ultrasound machines, alleging multiple violations of mandatory record keeping requirements through Form F under the PC & PNDT Act.
Both the doctors were convicted by the Hisar Chief Judicial Magistrate in January 2008.
They were sentenced to three years of rigorous imprisonment and fined Rs 5,000 each for the alleged contravention of the Act's Section 4(3)—prohibits sex determination, read with Rule 9, which mandates keeping a record of the procedure in a prescribed manner.
The doctors received an additional two years of imprisonment and Rs 5,000 fine for violating Section 5(1)(b) of the Act, which mandates written consent from the pregnant woman in a prescribed format before conducting a sex determination test.
Although their sentences were reduced to two years by the Sessions Court in August 2008, the doctors challenged the conviction in the high court, where their sentences were suspended pending the final verdict.
The high court's ruling hinged on several earlier judgments, particularly the 2014 decision in the Help Welfare Group Society versus State of Haryana case which clarified that even when appointed for part of a state, the District Appropriate Authority must be a multi-member body consisting of three officials.
The court rejected the state's argument that this interpretation came only in 2014 and should not apply retroactively to these cases.
Justice Bedi cited Supreme Court precedents to establish that 'the interpretation of a provision relates back to the date of the law itself and cannot be prospective of the judgment'.
'When the Court decides that the interpretation given to a particular provision earlier was not legal, it declares the law as it stood right from the beginning of its promulgation,' the judgment noted, referring to Supreme Court decisions in the Lily Thomas versus Union of India and the Sarwan Kumar versus Madal Lal Aggarwal case.
The court further pointed out that the Special Leave Petition filed by the state against a similar judgment in the Dr Ritu Prabhakar versus State of Haryana case had been dismissed by the Supreme Court in November 2016, reinforcing the interpretation that complaints under the PNDT Act must be filed by a properly constituted three-member authority.
With this judgment, the 19-year-old case against the doctor couple finally comes to a close, establishing an important precedent regarding procedural requirements for prosecution under the PNDT Act.

Street vendors demand action against zonal officials for demolishing 41 authorised shops near Ripon Buildings
The Chennai Street Vendors Federation and the Centre of Indian Trade Unions (CITU) submitted a petition to the Greater Chennai Corporation (GCC) requesting disciplinary action against officials of Royapuram zone responsible for the demolition of more than 40 authorised shops near Central railway station and Ripon Buildings and allot space for the vendors who were evicted from the spot recently. According to the petitioners, 41 vendors had been legally authorised by the GCC to run shops at the spot. They had received a written approval in December 2024. During the eviction drive, carried out in the early morning of July 12, the GCC and police officials demolished the shops without prior notice or presenting any official order, the CITU alleged. The union members cited sections under the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014, which outlined the procedures and safeguards against eviction and urged the GCC to take action against the officials responsible for the 'wrongful eviction'. Street vendors have planned further protests if the GCC takes no action, said G. Selva, Chennai Central secretary of the Communist Party of India (Marxist). Katta Ravi Teja, Regional Deputy Commissioner (North), said an inspection would carried out soon to ascertain the reason for the eviction, and if the vendors were authorised by the GCC.

Prostitution racket running under the garb of spa service busted in Palam Vihar, 1 held: Police
An alleged prostitution racket — running under the garb of a spa service at Palam Vihar — was busted on Wednesday with the help of decoy customers, said the Gurugram Police. The operation led to the arrest of a spa manager. A special team, led by Inspector Vijender, sent decoy customers to the two spa centres, where managers allegedly agreed to provide prostitution services. At one of the two spas, police said, a woman at the reception allegedly admitted to facilitating prostitution. During questioning, police claimed, the manager and the woman admitted to running an alleged sex racket. Cases have been registered against the spa owners and operators under relevant sections of the Immoral Traffic (Prevention) Act at Palam Vihar police station. Further investigation is underway, police said. This latest development comes a day after the police cracked down on another similar alleged prostitution racket operating under the guise of a spa. Three accused were arrested and subsequently remanded to two weeks of judicial custody. The Gurugram Police have busted similar rackets in the past as well. Last year, in May, the city police arrested 10 people, including foreign women, from a hotel in Sector 57. Among the six women arrested, two each were from Bangladesh and Uzbekistan, who allegedly admitted to having engaged in prostitution. In January 2023, 11 people were arrested, including owners and managers of two spa centres in Gurgaon, for allegedly running a similar operation in the garb of a massage parlour.

‘Digital arrest': Six of gang arrested for cheating Ahmedabad man of Rs 1.36 crore
The Cybercrime Police in Ahmedabad on Thursday said it arrested six members of a gang, which was allegedly duping people of large sums of money by falsely identifying themselves as government officials, claiming to place them under 'digital arrest'. The arrested include were identified as Nishant Ashokkumar Rathod (43), Yash alias Chuchu Suresh Patel (25), Kuldeep Jetharam Joshi (20), Hitesh Mafa Chaudhary (26), Siddhraj Ranji Chauhan (22), and Jagdish Jiva Chaudhary (27). The Cybercrime Police, in a statement on Thursday, said they had received a complaint from a victim who alleged that between May 31 and June 6, an unknown person called him, identifying himself as an officer from the Central Bureau of Investigation (CBI), Mumbai. He said that the person, who made a video call, was in police uniform and showed him a letter 'bearing a stamp of the Supreme Court Bar Association, and the name of Judge Gogoi'. Another letter, also bearing a Supreme Court stamp, was signed by Niraj Kumar, Assistant Director, ED. The called allegedly told the complainant that an arrest warrant had been issued in his name, and intimidated him by claiming that black money worth Rs 2 crore had been found in his bank account. The complainant also alleged that the accused 'questioned' him and demanded a total of Rs 1.36 crore from him that he eventually paid. A case was registered at Ahmedabad city Cyber Crime police station under Sections 61(2), 204, 308(2), 316(2), 318(4), 336(3), 338, 340(2) of the BNS and Sections 66(C), 66(D) of the IT Act, and a case was filed against the then unidentified accused. ACP H S Makadiya and Inspector C T Desai and their teams, using technical analysis, later identified the accused who were subsequently arrested.
