Shadow of Mordor's innovative Nemesis system is locked behind a patent until 2036

Warner Bros Discovery recently shut down a trio of game studios, including the well-regarded Monolith Productions. This has put one of the coolest game mechanics of the 2010s in limbo. Middle-earth: Shadow of Mordor's excellent Nemesis system is locked behind a patent owned by Warner Bros all the way until 2036, according to reporting by Eurogamer.
The Nemesis system was featured in both 2014's Shadow of Mordor and the follow-up Middle-earth: Shadow of War. Simply put, it's a gameplay mechanic in which enemies remember previous encounters with the protagonist. These antagonists, typically orcs in the LOTR games, would use these humiliating memories to fuel their thirst for revenge as they rose through the ranks. This mechanic also worked both ways, so enemies would remember besting you in a previous encounter.
It was the best part of those two titles and Monolith had planned on bringing back the mechanic for a now-cancelled Wonder Woman game. Now the system is lying unused, locked behind a patent vault in David Zaslav's mega-yacht or whatever. Gigantic multinational corporations are awesome!

Warner Bros Discovery patented the system in 2016, which you can read right here. The patent is active until 2036, so long as the company keeps up with the associated fees. It's worth noting that in the nine years since patenting the system, it's only been used in a single game. That's Shadow of War, which came out in 2017 and was already in development when Warner Bros went ahead with the patent.
It remains to be seen if Warner Bros Discovery will do anything with the Nemesis system. It had nine years of heavy game development to make use of it across its entire IP portfolio, but didn't. In that time period, plenty of Batman games and Hogwarts Legacy all came out. Those would have surely benefited from the unique mechanic. Oh well.
WB will still focus some resources on game development, but the company's efforts will be primarily spent on four franchises. These include Harry Potter, Mortal Kombat, the DC universe and Game of Thrones. Three of those four seem like good fits for the Nemesis system to me.

Stock Movers: Tesla, Warner Bros., Constellation

Listen for comprehensive cross-platform coverage of the US market close as heard on Bloomberg Television, Bloomberg Radio, and YouTube with Romaine Bostick, Scarlet Fu, Carol Massar and Matt Miller. - Tesla (TSLA) shares fell today as investors expect vehicle deliveries to decline for the second consecutive quarter. CEO Elon Musk has assumed oversight of Tesla's sales in Europe and the US following the departure of longtime deputy Omead Afshar, people familiar with the matter said. Afshar was responsible for Tesla's sales and manufacturing operations in North America and Europe before leaving the EV maker late last month. Following his exit, Musk and Tom Zhu, a senior vice president, are divvying up reporting lines as Tesla looks to recover from another quarter of declining vehicle deliveries. Tesla likely delivered around 389,400 vehicles in the three months that ended in June, according to analysts' estimates compiled by Bloomberg. That would be down roughly 12% from a year earlier, following a 13% drop in the first quarter. - Warner Bros. Discovery (WBD) shares were lower after Advance/Newhouse sold 100 million shares for about $1.1 billion via a block trade, according to a recent filing. - Constellation Brands (STZ) reported earnings and profit trailed expectations in the first quarter due to weaker consumer demand for alcoholic beverages and higher costs from aluminum tariffs .Earnings excluding some items were $3.22 a share in the period, missing the average analyst estimate by 10 cents. The company's beer margins were hit by President Donald Trump's 25% tariff on imported aluminum cans — a key packaging material for its Mexican-made beers such as Modelo and Corona. Constellation is navigating multiple headwinds including tariffs, muted beer sales, and more drinkers cutting back on alcohol and turning to alternatives such as cannabis. The company has also cited a pullback among Hispanic consumers — who make up more than half of Modelo drinkers — amid concerns about inflation, immigration and job security.

Streaming Surpasses Linear TV For First Time In Latest Nielsen Report

The Netflix Epic building in Los Angeles, California, US, on Thursday, Oct. 3, 2024. Netflix Inc. is ... More scheduled to release earnings figures on October 17. Photographer: Kyle Grillot/Bloomberg © 2024 Bloomberg Finance LP Nope, streaming hasn't slowed its relentless takeover of the TV viewing universe. According to a recently released Nielsen report, streaming viewing has surpassed linear TV (broadcasting and cable) for the first time. Despite a May boost from the NBA playoffs and to a lesser extent the NHL and global news turmoil, there's no great silver lining for traditional TV. Those hoping for a 'man bites dog' story here are just going to have to keep waiting for the video equivalent of Godot. Nielsen started The Gauge report in May 2021 to report on broad monthly TV usage across broadcast, cable, streaming and gaming platforms as well a look inside those platforms for specific service performance and trends. The latest Nielsen report comes in a mind-numbingly complex media environment for studios, networks, major media companies and advertisers. There was certainly an atmosphere of optimism – and a great deal of partying – surrounding the annual Cannes Lions media ad industry gathering last week. But uncertainty abounds about the structural future of the media business, with massive corporate reorganizations under way at Comcast with the Versant cable networks spin-off, a similar separation at Warner Bros. Discovery, and the agonizing drama of the proposed Paramount-Skydance Media merger. And by the way you've got the ups and downs of the Trump global trade policy, the Federal Reserve's wait and see on interest rates, shaky consumer confidence, multiple wars, and a ceaselessly vitriolic political environment in the U.S.. This is no Johnny come lately story. In the last 10 years streaming subscriber growth is up 70% to now reach over 80% of the U.S. population. Streaming usage is up 71% since 2021. Overall streaming TV revenues grew by one estimate from $16 billion in 2015 to $55 billion in 2023, and spending on connected TV advertising alone is estimated to be $33 billion in 2025, growing to nearly $47 billion in 2028. Maybe the most surprising element of The Gauge findings was that it took this long for streaming viewing to actually surpass linear TV. According to Nielsen's May report, streaming accounted for a record 44.8% of all TV usage in May. By comparison, broadcasting (20.1%) and cable (24.1%) falling just short at 44.2%. In the last year alone, streaming's share of TV viewing has increased by 25% while shares for broadcasting and cable have fallen 15% and 10%, respectively. This is the first time the lines of streaming and linear usage have crossed. And with a summer ahead of no Olympics, no playoffs in any major sport, no college football or basketball, and no other major event programming, the trendlines aren't turning around any time soon (if ever). In terms of where the overall viewing is going, the dynamic duo of YouTube and Netflix rolls forward. In May YouTube garnered 12.5% of all TV viewing. What Nielsen calls 'YouTube Main' alone (excluding YouTube TV) has grown 120% in its viewing size since 2021. Netflix is next at 7.5%. Disney led all major media companies with 5% share of viewing. In its report release Nielsen's CEO Karthik Rao praised the traditional media world - all key Nielsen customers - noting that they 'have deftly adapted their programming strategies to meet their viewers where they are watching TV – whether it's on streaming or linear platforms.' But the competition is brutal. If there is a particularly major surprise within the Nielsen numbers it might be that the Roku Channel actually has a slightly higher audience share than those from Paramount, Fox (Tubi), Warner Bros. Discovery (mostly Max) or Comcast's Peacock. Quick, name a hit show from the Roku Channel. Yeah, I didn't think so.

WWE Night Of Champions 2025 Results As John Cena Plays Babyface, Beats CM Punk

CM Punk and John Cena face off on SmackDown in Saudi Arabia. John Cena faced CM Punk at WWE Night of Champions 2025, presumably for the last time, as WWE embarked in a bold storyline where CM Punk—like every human being who ever lived—had to confront his hypocrisy. In CM Punk's case, Punk faced the 'hypocrisy' of criticizing Saudi Arabia's human rights issues while still competing in a Saudi Arabian PLE. Is that hypocrisy? That doesn't seem any more hypocritical with an American criticizing the United States for the human rights violations that built this country, only to continue living in America. But I digress. CM Punk apologized to a Saudi fan for an old tweet after being booed during Friday's kickoff event, and it seemed to work as Punk was massively over with fans at Night of Champions. Cena seemed to join CM Punk in turning babyface for this crowd. First, Cena declined using the belt as a weapon after fans begged him not to with chants of 'No!' Then Cena stopped a Money in the Bank cash-in, only to be attacked by Seth Rollins' goons. Both Cena and Punk fought them off. The match ending, however, suggested otherwise. Everything That Happened With John Cena Vs. CM Punk Fans unanimously cheered CM Punk and sang his theme music. He received a mixed reaction during the ring introductions. Saudi chanted 'John Cena sucks!' as Cena marched toward the ring. Fans said Cena's intro, line for line, along with Mark Nash and he was cheered. There was a lot of posturing early on with Cena and Punk exchanging holds. Fans broke into 'Ole' chants, which seems to be a chant in appreciation for a main event-level match. This was the case during the opener between Randy Orton and Cody Rhodes. Punk enveloped Cena in a Black Widow hold, shades of AJ Lee, who was mentioned on commentary. The pace quickened a bit as Cena hit his signature comeback, punctuated by a Five Knuckle Shuffle. Punk cut Cena off before he could hit an AA and hit a comeback of his own with a running knee and a flying elbow. Cena fought out of the GTS and locked in an STF. Punk fought out of the Attitude Adjustment but ate a GTS for his troubles. Punk kicked out, planted Cena with a DDT and slapped on an STF of his own. After a second running knee, Cena countered the bulldog with a side slam and a second AA for a nearfall. Cena countered a cross body from Punk and hit a third AA for another nearfall. A desperate John Cena grabbed the WWE Championship belt in a familiar scene. Cena prepared to strike CM Punk with the belt as fans chanted 'No!' Cena tossed the belt to the side and went for the AA. Punk countered with a GTS for the nearall. Heel Cena going babyface for Saudi Arabia and almost losing because of it was certainly a choice. Michael Cole suggested Cena allowed the fans to get to him. Cena and Punk went back and forth with strikes, and Riyadh cheered for both. Cena accidentally took out the referee Dan Engler, leading to a GTS and a visual pinfall by Punk. Punk called for another referee, but he got Seth Rollins and his unnamed faction. Rollins sicced Bronson Reed and Braun Strowman against CM Punk. The pair hit an ugly double-spinebuster on the Arabic announce table. Fans chanted 'OTC" as Rollins called for an official. As Robinson sprinted down the ramp, he was pounced by John Cena, who continued to act like a babyface and was cheered for it. Cena hit the AA on Rollins as Breakker and Reed attacked John. This brought out Penta and Sami Zayn to even the odds. Both Cena and Punk fought off Rollins' goons as they had no choice but to attack the heels to prevent Rollins from cashing in. Cena was basically a full babyface at this point. Cena and Punk embraced in the ring, but Cena reverted to his heel ways and kicked Punk in the groin. Rollins hit the ring with a Stomp and Cena stole the pin for the win.
