
Judge Mbenenge's conduct at tribunal sends chilling message to women in SA workplaces
Masimanyane Women's Rights International, the Women's Ikhwelo Network and women's groups nationwide are appalled by the misogynistic and patriarchal statements made by Eastern Cape Judge President Selby Mbenenge during his sexual harassment tribunal.
We note the lack of accountability for the harm that has been done, not just to the complainant but to women across South Africa. Gender inequality is a key feature of the tribunal and is being perpetuated by the accused and his legal team.
This case is a vivid display of patriarchy, with the power dynamics favouring the judge and dehumanising and humiliating the complainant. We call for an end to the culture of sexual harassment in South Africa's legal system and our society as a whole.
Mbenenge's contemptuous dismissal of the complainant and invocation of 'cultural norms' to justify sexual misconduct are an affront not only to women but to the integrity of the Constitution and the judiciary. His actions violate the core values enshrined in the Constitution, the Judicial Service Commission Act and international commitments such as the Convention on the Elimination of All Forms of Discrimination Against Women.
Culture can never be a defence for conduct that amounts to gender-based violence and workplace misconduct, as espoused in Convention 190 of the International Labour Organization, to which South Africa is a signatory. Instead of showing accountability, Mbenenge weaponised culture to justify and excuse harassment, thereby revealing contempt for women's rights and reinforcing the very systems that silence survivors.
This is one of the key drivers of gender-based violence in South Africa. Invoking culture to excuse misconduct reinforces harmful gender norms and misuses heritage to shield perpetrators from accountability.
The judge's conduct has led to secondary victimisation of the complainant, where institutions and processes re-traumatise survivors rather than protect them, with their ordeal played out publicly on international platforms, including YouTube — which has garnered almost 3,000 views per day — as well as to millions of viewers on television.
Relentless trauma
This subjects the complainant to continued, relentless trauma and humiliation. This is part of a documented and persistent culture of sexual harassment and gender-based misconduct festering within the legal profession and our society. The fact that it emanates from the highest level of the judiciary in the Eastern Cape makes it so much more heinous.
We have noted with concern that precedents set by past judicial scandals, such as the Nkola Motata matter and numerous complaints reported to the Legal Practice Council, expose a sector deeply resistant to accountability.
In the matter of Gaga v Anglo Platinum Limited, the Supreme Court of Appeal placed the following premium on how a manager or person in authority in the workplace should conduct themselves:
'The rule against sexual harassment targets, amongst other things, reprehensible expressions of misplaced authority by superiors towards their subordinates. The fact that the subordinate may be present as ambivalent, or even momentarily flattered by the attention, is no excuse; particularly where at some stage in an ongoing situation she signals her discomfort. If not initial behaviour, then, at the very least, the persistence therein is unacceptable.'
Arrogance
This case law indicates the responsibility that falls upon a senior manager in workplace situations and is critical to the review of this tribunal. This rot cannot continue. The arrogance displayed by the Judge President and his visible disdain for the complainant's rights constitute secondary victimisation and send a chilling message to women working within the legal system and nationally, that the very institutions meant to protect justice will become perpetrators of their abuse.
South Africa is failing to address the pervasive levels of gender-based violence driven by gender inequality in our society. Women have had enough.
To the legal community — judges, magistrates, attorneys, advocates, legal scholars, regulators — we issue this call to action: Demand fairness and justice in the disciplinary proceedings of the tribunal on the alleged sexual harassment currently under way. Silence equals complicity. Establish independent, transparent mechanisms to investigate sexual harassment claims in all sectors of the legal system and broader society. The judiciary cannot police itself. Overhaul codes of conduct to explicitly sanction and criminalise misogynistic speech and conduct by legal practitioners.
Words have power — and consequences. Create safe reporting structures that protect complainants from retaliation and career sabotage. Survivors deserve justice without fear. Masimanyane Women's Rights International and the Women's Ikhwelo Network, supported by the women's movement nationally, stand in unwavering solidarity with all women who have endured sexual harassment and gender-based violence across all sectors.
We refuse to allow patriarchal attitudes to remain entrenched in spaces where justice is expected to prevail. We urge every legal professional who claims to serve justice to act immediately. Root out this culture of impunity or stand exposed as enablers of misogyny and abuse. DM

He said the country has to come together at every important moment in the history to define a shared vision and forge a path into the future in dialogue with one another. Citing one of successes of the GNU, he said they have together adopted the Medium Term Development Plan, which outlines clear actions to be undertaken over the next five years in pursuit of three strategic priorities. He also said across all ministries, all departments and all national entities, there was a commitment to implement the agreed actions and to move with urgency and purpose to address the needs of South Africans. 'Most importantly, there is a shared understanding that we need to rise above our differences and to work together to make progress on our most important challenges. The approach of the GNU is to enhance national cohesion and nation building and to build partnerships across society to advance the common interests of all South Africans.' Ramaphosa further said the formation of the GNU has inspired new hope in South Africans that they can make progress in addressing the most urgent challenges. He said their task was to grow the economy, create jobs, reduce poverty, tackle corruption and crime, and build a state that worked with institutions that will stand the test of time. 'While we will always have differences and disagreements, we are all committed to staying the course and seeing these reforms through to the end. MK party sets deadline for Ramaphosa's resignation, threatens nationwide action

Image: Doctor Ngcobo The uMkhonto weSizwe (MK) party has formally delivered a letter of demand to Cyril Ramaphosa, calling on him to resign from office by 9am on Friday, July 18. In the letter seen by IOL, among other things, the MK party tells Ramaphosa that the decision to appoint Professor Cachalia as Acting Minister of Police is in contravention of the Constitution, because the academic is not a member of Cabinet or the National Assembly. MK party national spokesperson, Nhlamulo Ndhlela, said Ramaphosa must resign in honour of Nelson Rolihlahla Mandela, the founding commander-in-chief of uMkhonto weSizwe - the military wing. 'Should Ramaphosa fail to heed this call, the MK party will pursue a range of lawful and peaceful actions, including constitutional litigation, a motion of no confidence in Parliament and rolling mass action nationwide,' said Ndlela. 'These steps reflect the will of the people, who, through democratic means, delivered a decisive electoral verdict against the African National Congress under Ramaphosa's leadership.' He said, despite the 'clear message' from the electorate, the will of the people has been undermined by opportunistic political alliances. 'The so-called Government of National Unity (GNU), formed by the Democratic Alliance, Freedom Front Plus, and their collaborators, has effectively reinstalled the very ANC that South Africans voted out. This betrayal has sparked widespread public outrage and represents a direct affront to democratic accountability,' said Ndlela. 'The recent explosive revelations by General Mkhwanazi further expose the GNU as a deeply compromised arrangement, more aligned with criminality than with the constitutional mandate to serve the people.' He said the MK party views the GNU as 'the most dangerous political fraud' in post-apartheid South Africa, adding that the political arrangement enables the continued theft of land, resources and dignity. 'The MK party calls on Cyril Ramaphosa and the GNU to respect the voice of the people before irreparable damage is done to South Africa's democratic institutions. The time for accountability and ethical leadership is now,' said Ndlela. Marching from Thokoza Park to the Kliptown police station, the small group lamented the recent deaths of councillors and other activists whose murders have not been resolved, while crime continues to spiral out of control. Political tensions rise as ANC defies IFP-led cabinet decision in KwaZulu-Natal

Image: IOL / Independent Newspapers A political clash which may threaten the stability of the Government of Provincial Unity (GPU) in KwaZulu-Natal is looming between the ANC and IFP. Parties have traded public blows over the IFP-led cabinet's decision to place the ANC-led Umkhanyakude District Municipality under administration. Although ANC's three MECs were part of the meeting that approved the decision, the party provincial task team leadership has publicly defied the cabinet decision and called on its deployees in the municipality to defy the order. On Monday, the Cooperative Governance and Traditional Affairs MEC Reverend Thulasizwe Buthelezi returned without introducing the appointed administrator Bamba Ndwandwe after he and his team were prevented from entering the municipality premises in the north-east of the province. The mayor and senior officials did not attend the meeting. The angry MEC has vowed to ensure that the cabinet decision was implemented. On Wednesday, he said he warned the ANC and threatened to take legal action should it continue to defy the government's decision. 'We will not allow anyone to prevent the government from doing its work. If the ANC continues preventing me from executing my constitutional duties I will take legal action. Advertisement Next Stay Close ✕ In a statement, the ANC said it vehemently rejects the unwarranted and politically charged decision by the MEC Reverend Thulasizwe Buthelezi, to invoke Section 139(1)(b) of the Constitution in the uMkhanyakude District Municipality. It said the so-called intervention is nothing short of abuse of constitutional provisions for political gain, adding that it lacks merit, rationale, and integrity. 'The ANC is appalled by the continued misuse of Section 139(1)(b) by the MEC, who has turned what should be a last-resort mechanism into a political weapon, one that is selectively and cynically deployed against ANC-led municipalities, regardless of their performance. "The uMkhanyakude District Municipality has made tangible progress in governance, financial recovery, and service delivery. There is no objective basis for this draconian step, which appears designed not to improve governance, but to score narrow political points and destabilise a functional administration,' read the statement. The party said it stands with the Council of uMkhanyakude District Municipality in resisting the opportunistic, mischievous and dangerous actions of a power-mongering MEC who is hell-bent on destabilising a functional municipality and undermining service delivery to communities, vowing to actively mobilise its supporters and communities to resist the advances of an MEC who the party described as having clearly defined himself outside of the GPU. There are fears that the continued souring of relations between these two major partners of the GPU may create instability in the province which is known for its political complexities.
