Bad men problem: Gareth Ward and Mark Latham leave NSW parliament in unchartered territory

The New South Wales parliament has a problem with men behaving badly. But more to the point, it seems to have an inability to deal with it.
On Tuesday, the parliament will try to deal with two very different cases that share a common consequence: damage to its reputation as an institution.
Despite being a convicted rapist in custody awaiting sentence, Gareth Ward, the MP for Kiama, remains a member of the Legislative Assembly, drawing a base salary of more than $170,000 courtesy of NSW taxpayers.
Labor plans to move a motion to have him expelled when parliament resumes on Tuesday and the opposition has said it will support it.
Expelling Ward will almost certainly lead to more litigation, especially as the government will probably try to call a byelection in his south coast seat soon after.

But first to backtrack a little.
Most politicians being investigated or facing criminal charges choose to resign, or their parties put the pressure on the MP to draw a line under their faltering political career.
But Ward has toughed it out and continues to claim his innocence, despite being convicted for serious sex offences against two young men. He was suspended and left the Liberal party in 2022 after being charged with sex offences. He then ran as an independent in the 2023 state election and was returned by the voters of Kiama.
Now that he has been convicted, he faces a potential sentence of more than five years.
Under section 13A of the NSW constitution, a person is ineligible to be an MP if they are convicted of an offence punishable by five years or more.
But it's only counted as a conviction once the person has reached the end of the appeals process and has not had their conviction overturned, constitutional expert Prof Anne Twomey says – and Ward has confirmed he plans to appeal the verdict. The appeals process could take years.
The other route is expulsion. The NSW constitution does not give a specific power to expel a member, but Twomey says there is an inherent power for the NSW parliament to expel an MP to protect itself and its proper functioning.
This appears to be where the premier, Chris Minns, is headed – but it is relatively untested territory.
The courts have ruled that expulsion must not be as punishment, but it can be done to protect public confidence in the integrity of the parliament.
If Ward is expelled, a byelection would need to be held to replace him, which only adds to the complications. Would Ward seek an injunction to prevent the byelection while he appeals both the expulsion and the criminal conviction?
Understandably, there are few cases to guide the way – the last time an MP was expelled from the NSW lower house was in 1917.
But what is certain is that unless Ward resigns voluntarily, litigation appears inevitable. The first stop will be the supreme court, followed by a possible high court appeal.

The controversial independent upper house member Mark Latham is also under the microscope but for entirely different reasons.
The former One Nation MP is under scrutiny over his use of privilege within the chamber and his general standard of behaviour, which Labor has been calling out of late.
Has the Minns government suddenly found a new moral rectitude? Or is the premier motivated by more base political considerations? Latham has been working with the opposition and crossbench to block changes to workers compensation legislation that the government dearly wants passed.
In parliament, Minns has called him 'one of the most shameful bigots in NSW' who has an 'odious Twitter account', which he deployed for a 'disgusting homophobic attack' on independent MP Alex Greenwich.
More recently prurient allegations about Latham's personal life have spilled into the public domain due to a relationship breakdown, which have added fuel to the fire of outrage.

These are the subject of a case seeking a domestic violence order that he is vehemently contesting. As the relationship degenerated, allegations from court filings including leaked texts about female MPs and other unsavoury exchanges have found their way into the public domain.
Latham's behaviour raises questions of respect for the parliament and female MPs, and whether the behaviour is appropriate in any workplace.
Latham allegedly covertly photographed female workmates and shared the images with derogatory commentary. If true, in any other workplace, that would at the least prompt counselling, a warning or possibly dismissal.
Then there is Latham's use of parliamentary privilege. Privilege exists to allow politicians to speak freely without fear of defamation, but Latham arguably pushes its limits.
He is a blunt, borderline-rude interrogator of witnesses before committees.
In the chamber he has used privilege to attack his enemies, such as Greenwich, who won a $140,000 defamation settlement against Latham in 2024, and domestic violence campaigner Rosie Batty.
Last month Latham outraged colleagues by talking about Greenwich's medical records, which had been produced as part of a separate case Greenwich has brought against Latham in the NSW civil and administrative tribunal.
But can the upper house actually mete out a punishment or persuade Latham to alter his behaviour? The answer is probably no.
Labor plans to move two motions in the next sitting period, which starts on Tuesday: one relating to a specific breach of privilege and another more general censure.
Labor will allege that Latham breached privilege in relation to certain documents about the former police commissioner Karen Webb and investigations into gifts of gin that were produced on the basis that only parliamentarians could view them.
Labor wants Latham referred to the privileges committee for breaching the order, something he disputes.
The allegations of exposing medical records, taking covert photos and perhaps other actions are likely to be wrapped up into a censure motion condemning his behaviour.
But as for meaningful outcomes, don't hold your breath.
The privileges committee could recommend an apology or perhaps a suspension, but that is rare.
Labor lost control of this powerful committee a month ago after a dispute with the crossbench and the opposition. They combined to cut a Labor member so control of the now seven-member committee is out of Labor's hands.
And what of a censure? It is likely to be little more than a slap on the wrist for Latham, while he enjoys the notoriety and attention that this latest saga will bring.
The problem for the NSW parliament is that its rules to set and enforce appropriate standards of behaviour are hopelessly outdated, its processes are archaic and it has failed to implement many of the recommendations from a report by Liz Broderick completed two years ago.
The federal parliament has moved to establish a standards commission with real teeth to fine or even suspend parliamentarians for poor behaviour outside the chamber. It is still to be tested but it is a start.
Instead, in NSW, we will spend weeks on the immediate crises that will further lower the parliament's standing in the public eye, without dealing with the real problem of cultural change that is sorely needed.

The Australian defence force has failed to meet its latest recruitment targets despite recording the highest recruitment and retention levels in more than a decade. The ADF enlisted 7,059 full-time personnel in the 2024-25 financial year, the highest annual intake in 15 years, but still fell more than 1,000 short of its target for that year. According to the Department of Defence's incoming government brief, released under freedom of information laws, the recruitment target for the last financial year was 8,105. The figures also show fewer than 10% of applicants to the ADF in the last financial year were hired, with some dropping out due to the drawn-out recruitment process and many not meeting its strict standards. The government has acknowledged some applicants had dropped out or found other work, and that its commercial contract with the recruitment company Adecco has had 'teething issues'. 'As we've been trying to streamline that recruitment process, there were some teething problems with our new recruitment partner,' said the minister for defence personnel, Matt Keogh. 'I have lent in very hard … to get them back on track with applicant care as well as making sure that in doing the assessment of medical and psych appointments that they are able to be accessed more promptly. 'This has now seen great improvement, we're a long way there, we've still got a little bit more to go.' As of 1 July, the full-time ADF workforce was at 61,189 people. The latest data, provided by the defence department, shows retention has also improved, with separation rates dropping to 7.9%, after sitting between 9% and 11% since 2012. The defence force has a target of 69,000 personnel by the early 2030s, to respond to rising geopolitical tensions. At Senate estimates in June 2024, the chief of defence told the hearing that on 1 May that year the ADF workforce was 4,400 personnel short, with the total workforce at 58,284 people. Despite the shortfall in reaching the recruitment goal for the last financial year, the government said recruitment was now on track to meet the 69,000 target. The government said some of that improvement had come from targeted social media campaigns for Australians aged between 17 and 24 in what Keogh called 'smarter' advertising. 'Doing that advertising in games, in computer games, utilising TikTok, making sure that we're focusing on having that advertising presented where our target age groups are so they are seeing those messages,' Keogh said. 'Advertising [is also] targeted at those key influencers of our potential enlistees, our young people – so people like parents and teachers.' So far just three New Zealanders have joined the ADF, with a further 70 in the pre-enlistment stage, meaning they could be undergoing fitness tests or waiting for security clearances. Applications opened up to the other Five Eyes nations – the US, the UK and Canada – on 1 January, and more than 500 people across the four countries have applied. The ADF recruited 185 personnel from overseas militaries through its lateral recruitment program in the last financial year. That program is for members of a foreign military who can address critical ADF skill shortages. Keogh also said the government's work to deliver the recommendations of the royal commission into defence and veterans' suicides was a factor in trying to attract people to the ADF. 'Delivering on the recommendations of the royal commission … is really important for improving people's perceptions of, and therefore also their willingness to join the Australian defence force,' he said. 'We're … conscious that we have more work to do in this area as well.' The royal commission handed down its report to the government in September, with 122 recommendations, including the establishment of a body to help defence personnel transition to civilian life and access support. The government agreed in principle to 104 recommendations and has established a taskforce to implement them.

They came in full force in the pouring rain, armed with umbrellas and ponchos and waterproof prams. One man even carried a surfboard. This is Sydney, after all. At least 100,000 people marched across the Sydney Harbour Bridge on Sunday as part of a growing global call for a ceasefire in Gaza. It was double the estimated turnout, described by New South Wales police as the largest protest to descend on the city in memory. The massive column of rain-soaked marchers snaked their way across the entire 1.2km length of the bridge. Police temporarily ordered a halt over fears of a crowd crush because of the 'huge number of people taking part'. On Saturday, after the NSW supreme court had ruled in favour of the march proceeding, the Palestine Action Group had crystal ball gazed and said Sunday's bridge crossing would be an 'immense march for humanity'. The group has held a march every Sunday since 7 October 2023. But this was the first time it had taken its rally to Sydney's world-famous landmark, last closed for public assembly in 2023 for World Pride. To regulars of those weekly gatherings, Sunday felt like a tidal wave. Ali, marching with his wife and young daughter, described it as 'history in the making'. 'This is a big moment,' Ali said, as his eight-year-old daughter, Aaliyah, sat on his shoulders calling out 'Free Palestine', her cheeks painted in black, red, white and green. 'The people shut down the Harbour Bridge – the people did it.' But eventually, as scores of mobile phones buzzed on the bridge, the people were turned back. 'I'm speaking out for the Palestinian kids like me, and for all of Palestine because of the war that's been going on right now,' she said, her hair adorned with a keffiyeh. Volunteers in fluorescent hi-vis vests directed protesters away from puddles that had amassed on the concrete. Each time a train whistled past, marchers on the bridge, which links the north and south sides of the city, erupted into cheers and whistles, singing 'Free, free Palestine' to passengers going past. Tourists summiting the bridge's 1,332 steps waved down from its steel arched peak, witnesses to an unfolding moment in history that the state's premier, Chris Minns, had tried to stop. The NSW police acting deputy commissioner Peter McKenna described the protest as the largest he'd seen in his time in the force in Sydney. 'Gee whiz, I wouldn't like to try and do this every Sunday,' he said. 'We're very lucky today that the crowd was well behaved.' At the front of the march,several high-profile Australians, including Julian Assange, held a sign that read 'March for Humanity Save Gaza'. Five NSW Labor MPs were alongside Assange, defying their premier. Two of Minns' ministers were there too: Penny Sharpe and Jihad Dib. The federal Labor MP Ed Husic – dumped from the Albanese cabinet in May – was in the crowd. Husic reiterated calls for the Albanese government to sanction Israel and recognise Palestinian statehood. 'People power has come out, I think, largely because they just cannot abide the treatment that has been seen of little kids,' he said. Abib, in the crowd, agreed. She marched across the bridge carrying a Palestinian flag alongside her daughter. She said it was 'humanity' that had brought marchers out in what was truly atrocious weather. 'I think a lot of people are starting to wake up,' she said. 'We're going on two years [of war]. People that were quiet in the beginning have started to speak.' Abib, whose husband is Palestinian, was struck by the diversity of people. Middle-aged women carried a banner crocheted by volunteers. Elderly couples completed the 4km journey on walking sticks. A group of British men held a sign reading 'Gay Jews 4 Gaza'. As the day began to wind down, Josh Lees, one the main organisers of a march that will be long remembered, told Guardian Australia: 'It's even bigger than my wildest dreams. 'It's a mass march for humanity to stop a genocide, our politicians have to now listen to the will of the people and sanction Israel.'

The Young Liberals want the Coalition to distance itself from Sky News and appeal to voters through a wider variety of media outlets, blaming Donald Trump-style culture wars for Peter Dutton's historic election rout. In a submission to the party's election postmortem, obtained by Guardian Australia, the New South Wales Young Liberals division said the 'fringe right' of the Liberal membership had too much influence over policy and campaign media, causing 'a mirage of the Maga movement' which turned off women and multicultural voters. The 31-page assessment, handed to the review being led by Liberal elders Pru Goward and Nick Minchin, is scathing of the campaign run by Dutton and his frontbench team, describing them as badly outplayed by Labor and out of touch with traditional Liberal constituencies. The document has not been released publicly and was provided to Guardian on the condition of anonymity. 'The 2025 election proved that being one of the loudest media voices in the room does not mean voters are listening to you,' it said. 'Viewership data shows that most Australians do not engage with overtly political commentary on traditional media, such as evening commentators on Sky News. Yet much of our party's policy agenda and media appearances during the campaign were stuck in a conservative echo-chamber.' Pointing to Dutton directly, the submission said the parliamentary leader must 'front up' to a range of media outlets, including those not considered 'traditionally friendly' to the Liberal and Nationals parties. Ahead of his 3 May defeat, Dutton did the opposite. He was criticised for not regularly fronting the Canberra press gallery in the lead-up to the campaign and dubbed the ABC and Guardian 'hate media' in the final days before the poll. The Young Liberals called out senior figures for demonising Chinese-Australians and exacerbating division related to war in the Middle East. Frontbencher Jacinta Nampijinpa Price was criticised for declaring a Dutton government would 'make Australia great again,' echoing Trump's slogan just as the Coalition was trying to distance itself from the unpopular US president's policies and rhetoric. 'The Coalition must refrain from pursuing culture war issues and respect the intelligence of the Australian people by formulating nuanced, meaningful policy,' it said. On promises to voters, the submission was equally downcast. It said major policies should be announced with more lead time and accompanied by sufficient costings detail. It criticised Dutton's signature plan for development of nuclear power in Australia, and the decision to oppose Labor's tax cuts. 'Coalition policies such as the promise to cut 40,000 public service jobs, Peter Dutton's refusal to stand before the Indigenous and Torres Strait Islander flags, and a crackdown on 'woke' culture in schools all reinforced the perception of a party more interested in symbolic battles than addressing serious domestic and international issues,' it said. The opposition leader, Sussan Ley, has commissioned Minchin and Goward to assess the loss, and ordered a second review into the Liberal party's structure. One question being considered is how to boost female representation in Coalition ranks. The Young Liberals have called for a 2015 party review to be implemented, including an aspirational national target for 50-50 gender parity in parliament, but suggested Labor-style quotas could be required. 'Ultimately, the Liberal Party doesn't look like modern Australia. Australians notice, and it matters,' the submission said. Submissions to the review were due by Friday, with a report expected by the end of the year.
