Activist's conviction for Hillary Clinton memes tossed by appeals courts

A social media influencer who was sentenced to seven months behind bars two years ago for posting anti-Hillary Clinton memes federal prosecutors deemed election interference for misleading voters had his conviction overturned.
Douglass Mackey, 36, posted satirical memes of a fake ad in 2016 falsely indicating voters could stay home and simply text 'Hillary' to a phone number instead of showing up at the polls.
But a three-judge panel for the US Court of Appeals for the Second Circuit concluded that prosecutors failed to prove Mackey was knowingly partaking in a broader conspiracy to hoodwink voters.

'The case has been remanded to the district court with orders to immediately dismiss. Hallelujah!' Mackey later cheered on X.

Mackey had initially been sentenced in October 2023, but was out on bail amid an appeal. His 2016 meme, which was posted shortly before the election, told voters to 'Avoid the line' and 'Vote from home' by texting a phone number.
At the time, Mackey made the post via an alias, 'Ricky Vaughn.' Notably, his account at the time featured a man wearing a MAGA hat and a Bane mask.
Prosecutors claimed some 4,900 unique phone numbers texted the number in the meme.

Twitter, as it was then called, eventually shut down his account, and he had garnered a spot on MIT's top 150 influencers of that election cycle.
Mackey posted multiple memes that federal prosecutors in Brooklyn cited in the case, accusing him of attempting to suppress votes. Some of the memes included bogus claims that they had been paid for by the Clinton campaign.
Some of the memes deployed the 'Vote from home' line but targeted specific blocs of voters, such as Latinos and African-Americans.

The 36-year-old was accused of conspiring with other social media users in various chat rooms to chart ways to push President Trump's message, prosecutors said.
However, the panel on the US Court of Appeals for the Second Circuit was unconvinced.
'The mere fact that Mackey posted the memes, even assuming that he did so with the intent to injure other citizens in the exercise of their right to vote, is not enough, standing alone, to prove a violation of Section 241,' Chief Judge Debra Ann Livingston wrote in the majority opinion, referring to the statute defining conspiracy against rights.
'The government was obligated to show that Mackey knowingly entered into an agreement with other people to pursue that objective,' the panel added. 'This, the government failed to do.'
Judges on the panel of the US Court of Appeals for the Second Circuit unanimously decided to overturn the charges and sent the case back to the district court with instructions to acquit Mackey.

'Its primary evidence of agreement, apart from the memes themselves, consisted of exchanges among the participants in several private Twitter message groups—exchanges the government argued showed the intent of the participants to interfere with others' exercise of their right to vote,' the judges noted.
'Yet the government failed to offer sufficient evidence that Mackey even viewed—let alone participated in—any of these exchanges,' they added, noting 'the government's remaining circumstantial evidence cannot alone establish Mackey's knowing agreement.'

Tucker Carlson has claimed that deceased child sex trafficker Jeffrey Epstein was working for the Israeli government and that 'every single person in Washington D.C.' thinks the same. 'I've never met anyone who doesn't think that. I don't know any of them that hate Israel. But no one feels they can say that,' the former Fox News host told an audience in Florida on Friday. Carlson also suggested that the disgraced financier may have been running 'a blackmail operation' as he discussed new information recently released by the Department of Justice. A two-page memo from the DOJ and FBI said that Epstein had no 'client list,' and that the convicted pedophile died by suicide in his jail cell in 2019, shortly before going to trial – angering some among the MAGA faithful. Speaking about the development at a Turning Point USA summit in Tampa, Carlson slammed the findings of the administration.'The real question is, why was he doing this, on whose behalf, and where did the money come from?' he said. 'I think the real answer is Jeffrey Epstein was working on behalf of intel services, probably not American. And we have every right to ask, on whose behalf was he working? 'Now, no one's allowed to say that the foreign government is Israel because we have been somehow cowed into thinking that's naughty. There is nothing wrong with saying that. There is nothing hateful about saying that, Carlson said. 'There's nothing anti-Semitic about saying that. There's nothing even anti-Israel about saying that. 'And you have the right to expect your government will not act against your interests, and you have a right to demand that foreign governments not be allowed to act against your interests.' Carlson has become one of the the big names on the list of MAGA luminaries who are irate over the DOJ's conclusions and previously insisted there was an 'obvious' reason why Attorney General Pam Bondi was 'covering up' the 'client list.' In addition, footage capturing Epstein's final hours – also released by the DOJ – has fuelled further conspiracy theories, after it appeared to have a minute of footage missing. A digital clock visible on the bottom left corner of the footage jumps from 11:58:58 p.m. to 12:00:00 a.m. Officials have not yet offered an explanation for the time gap to The Independent or the New York Times.

President Donald Trump furiously blasted convicted sex offender Jeffrey Epstein being brought up during his Cabinet meeting at the White House. The subject of the disgraced financier was raised in a question to Attorney General Pam Bondi, as she has come under fire from MAGA world over the administration's handling of the release of information related to the case. However, before Bondi could answer the reporter's question, the president jumped in. 'Are you still talking about Jeffery Epstein?' Trump asked. 'This guy's been talked about for years.' 'We have Texas, we have this, we have all of the things, and are people still talking about this guy, this creep? That is unbelievable,' the president continued. 'Do you want to waste the time, and you feel like answering?' he asked Bondi who confirmed she would answer. The president did not appear to realize some of his biggest supporters are among those still pushing for answers about Epstein. 'I can't believe you're asking a question on Epstein at a time like this where we're having some of the greatest success and also tragedy with what happened in Texas,' the president continued. 'It just seems like a desecration.' It comes after a Justice Department and FBI memo concluded that Epstein did die by suicide in 2019 and was not murdered, disputing conspiracy theories that have floated for years. It also found that no Epstein 'client list' exists. The president's frustration over the Epstein question came as he has been haunted by old images of him with Epstein back before he ever ran for office. Trump has denied he had ever went on Epstein's plane or been to his private island. During the 2024 campaign, the president also vowed to release more documents from the Epstein case exciting his base. Bondi did eventually answer the question about Epstein and she became defensive about the administration's release of information, as some MAGA allies have accused the administration of botching it and over-promising. The attorney general had been asked whether Epstein had, in fact, been working for an American or foreign intelligence agency and why the tape released from the prison had a minute of missing footage. Bondi said she did not know whether Epstein was an agent and claimed the missing minute of video from the release was missing because a minute is missing every night as the old video system reloops. 'We released the video showing definitively, the video was not conclusive, but the evidence prior to it was showing he committed suicide,' Bondi said. Bondi also defended comments she made to Fox News in an interview in February where she was asked specifically about the release of a client list. 'My response was 'it's sitting on my desk to be reviewed,' meaning the file along with the JFK, MLK files as well,' Bondi claimed. 'That's what I meant by that. Also to the 10s of 1000s of videos, they turned out to be child porn downloaded by that disgusting Jeffrey Epstein. Child porn is what they were, never going to be released.' Her response was similar to that made by White House Press Secretary Karoline Leavitt when grilled about it on Monday. Among those who have rejected the Justice Department's claim that there was no client list was Trump ally Rep. Marjorie Taylor Greene, who posted about Epstein's partner Ghislaine Maxwell on X on Tuesday. 'What about her little black book? The 97-page book, contains the names and contact details of almost 2,000 people including world leaders, celebrities and businessmen. No one believes there is not a client list,' Greene wrote.

Megyn Kelly is going after MAGA's own Attorney General Pam Bondi, who the conservative host predicted won't last much longer in her job after her handling of the Jeffrey Epstein case. 'Her days are numbered as a member of the Trump administration,' Kelly declared on her show Tuesday as the internal MAGA fallout over the Epstein files continues. Bondi had previously declared that the alleged child sex trafficker's client list was 'sitting on her desk' in February, before backtracking this week to declare that there was no list and the case was no closed. Kelly slammed Bondi over the inconsistencies Tuesday, pointing to the supposed Epstein bombshell binders Trump loyalists posed with months ago. 'Pam Bondi knew she was about to embarrass some of his most loyal surrogates out there, and did that willingly, or she didn't take the time to make sure what was in those binders,' Kelly said. 'It was all publicly released information that had already been out there…She was too lazy to actually figure out none of this is new, and yet she called a meeting with the influencers that included Kash Patel, the head of the FBI, and the sitting vice president.' 'Then she acted indignant. She didn't know. It was the sleazy FBI who had withheld the real documents from her,' Kelly ranted. 'She was going to get to the bottom of it. Then she said further release would come. One did not come. Then she was caught on tape saying there are tens of thousands of kiddie porn or child pornography material that we found, which again, is like, a third issue over here. And next thing we know there's no there there.' Despite her misgivings about the way Bondi handled the case, Kelly insisted there is no conspiracy afoot. She said, 'I believe it's government incompetence as opposed to big government machinations against us,' but 'in this case, I don't know what's happening. Bondi has confused me. I don't know what she's doing.' And that, according to Kelly, is why Bondi's days in Trump's administration will come to an end soon. 'If you look at conservative Twitter, she's right in the crosshairs.'
