Court of appeal dismissed former special needs student's appeal in bullying suit

PUTRAJAYA: The Court of Appeal has dismissed an appeal by a former student of a special education secondary school who sought damages and declaratory relief over alleged bullying and the failure to provide proper special education.
The appellant, now 27, had been diagnosed with Attention Deficit Hyperactivity Disorder (ADHD) and Asperger's Syndrome.
The Court of Appeal three-member bench, comprising Justices Datuk Mohd Nazlan Mohd Ghazali, Datuk Azmi Ariffin and Datuk Faizah Jamaludin, dismissed the appeal after ruling that the appellant failed to prove his claim against the school, the school principal, the Malaysian government and the Education Ministry.
The appellant, through his adoptive mother, had filed the lawsuit in 2017 at the High Court against the school, the school principal, the Malaysian Government and the Education Ministry.
He claimed the respondents breached their duty of care, which caused him to be a victim of physical and verbal attacks whilst at the premises of the school.
In the 44-page judgment, which was uploaded on the judiciary's website on Monday (Aug 4), the appellate court affirmed the Feb 2023 decision of the High Court in dismissing the suit filed by the young man.
Justice Mohd Nazlan said there was insufficient evidence that the respondents failed to ensure a proper and appropriate education and teaching facilities for the young man.
He said the appellant failed to prove the allegation of bullying incidents on the balance of probabilities, and also did not prove the actual occurrences of the verbal and physical assault as claimed by the appellant.
Justice Mohd Nazlan observed that the appellant did not testify in his case, and the testimony provided by his adoptive mother was deemed hearsay and therefore inadmissible.
"The appellants' (appellant and adoptive mother) case regarding the alleged incidents could not succeed, as the individual accused of harassing and assaulting the appellant was neither named as a party to the suit nor subpoenaed to testify as a witness,' he said.
The court stressed that bullying has no place in any civilised society, but found the evidence presented in the case insufficient to prove that the appellant had been victimised.
"In this case, we are not unsympathetic to the problems and plight encountered by the appellants.
"There may have been disagreements or even altercations, especially involving the first appellant and H (the individual in question), but the court must decide based on facts and evidence,' said Justice Mohd Nazlan.
He said school authorities, including teachers and staff, undoubtedly owe a duty of care to ensure the safety of their pupils and students within the compound and premises of the school and that they were responsible for the students' safety, welfare, and well-being.
"Schools must, in their operations, adhere to the regulations, standards, and policies issued by the education authorities, particularly concerning the provision of special education for students with special needs,' he said.
However, he added that no breaches of these duties had been established in this case.
In the statement of claim, the appellant claimed he was bullied several times at the hostel, including being spat at while he was praying, tied to his bed, punched and kicked, and his belongings were stolen.
He claimed that no action was taken by the school and its principal, despite numerous complaints lodged.
In the statement of defence filed on July 24, 2017, the school stated that the placement of the student concerned was made based on the choice made by the boy and his adoptive mother during registration. — Bernama

KUALA LUMPUR: Malaysian of all age groups have lost a staggering half a billion ringgit to phone scams in the past three years, police said. Bukit Aman Commercial Crime Investigation Department director Datuk Rusdi Mohd Isa said the department recorded 7,473 phone scam cases from 2023 to June this year, involving losses amounting to RM532,765,591.07. "These scams are not slowing down. In 2023 alone, we received 3,027 reports involving RM158.8 million in losses, and we arrested 1,139 individuals linked to syndicates," he said. "In 2024, the number of cases dipped slightly to 2,825, but losses remained high at RM142.2 million, with 1,281 arrests made." "Between January and June this year, police have registered 1,621 cases, totalling RM72.95 million in losses. We arrested 713 suspects." He said these figures show how widespread and damaging phone scams had become. Scammers prey on victims using fear, deception and false authority. YOUNG ADULTS MAIN TARGET Rusdi said the highest number of victims fell within the 21 to 30 age group, with 2,736 cases reported over the two-and-a-half year period. "This group is likely more exposed to technology and mobile phone usage, which scammers exploit." The second group of victims belonged to the 31 to 40 age group with 1,361 cases reported, followed by the 41 to 50 age group with 1,037 cases reported. He said 914 victims were from the 61 and above age group, followed by 858 victims from the 51 to 60 age group. He added that the group with the least number of victims were those in the 15 to 20 age group, with 528 cases reported. FEAR AND IGNORANCE Rusdi said scammers relied on psychological pressure, often targeting people who were unaware of official investigation procedures and those easily frightened. "The first thing syndicates do is create fear. They claim the victim has been involved in criminal offences such as drug trafficking, money laundering or hit-and-run accidents. "The victim is then threatened with arrest or legal action." He said many victims were either too afraid or ashamed to consult others, including family members or spouses, leading them to comply with the scammer's instructions. Despite ongoing public awareness campaigns, Rusdi said many were unaware that authorities, especially the police, do not conduct investigations via phone calls. This lack of knowledge remains one of the key reasons scammers continue to succeed. "The most important thing to remember is to remain calm and remember that government agencies do not transfer phone calls between different agencies. "People panic when told they are in trouble with the law. That panic, combined with not knowing the correct procedures, makes them vulnerable. "Education is still our strongest defence." Rusdi urged the public to share verified information about scams and speak openly about suspicious experiences so that others may learn and be better protected. He also advised the public to lodge a report if they receive a suspicious call or believe that they have been targeted. "Early reporting gives us a better chance of identifying and stopping these syndicates.

(Facebook pic) PUTRAJAYA : The Court of Appeal has unanimously dismissed a developer's appeal, affirming its liability to the joint management body (JMB) of a Subang condominium for loss and damage arising from defects in the common property. A three-member bench chaired by Justice Che Ruzima Ghazali upheld a judgment entered by the High Court in the JMB's favour, saying the ruling was sound both in law and fact. 'We decline to disturb the finding of liability,' said Che Ruzima, who sat with Justices Zaini Mazlan and Shahnaz Sulaiman. Che Ruzima also said the High Court did not commit any error in ordering an assessment of the damages payable. The bench also ordered the developer, Zen Estate Sdn Bhd, to pay costs of RM20,000 to Subang Parkhomes' JMB. The JMB represents some 475 condominium purchasers who had bought their respective units at between RM800,000 and RM1 million. Vacant possession to the units was delivered in 2013 and 2014. Following its formation in 2016 under the Strata Management Act 2013 (SMA), the JMB sought out the developer to hand over all documents to facilitate the management and maintenance of the units and the common property. It subsequently took out an application for discovery and, in 2020, filed a negligence suit against the developer over defects to the common property. The complaints included leaks to the roofs of its penthouses and at the complex's basement carparks, as well as damage to the tiles of its jacuzzi and swimming pools. The JMB also claimed the developer had failed to ensure that all electrical installations complied with the Electricity Regulations 1994. In its defence, Zen Estate contended that the complaint pertained to maintenance and that the 24-month defect liability period had lapsed. Accordingly, it argued that the suit was unsustainable. In the High Court last year, Justice Wong Kian Kheong ruled in the JMB's favour, holding that the loss and damage suffered were reasonably foreseeable. Wong, now a Court of Appeal judge, said the developer was aware that the JMB would eventually be constituted to assume responsibility for maintaining and managing the common property. He said Parliament had via the SMA expressly conferred statutory duties and powers on the JMB to carry out these functions. Wong held that the developer's obligations arose by operation of law and the absence of a contractual relationship with the JMB did not affect its claim. 'This is because the tort of negligence in itself is a cause of action which is independent of any contract between the plaintiff (JMB) and the defendant (Zen Estate),' he said. He also found that loss and damage suffered was reasonably foreseeable. Wong said the defects were attributable to the developer and ordered that damages — including for rectification work already carried out by the JMB — be assessed and paid. He also ordered the developer to compensate the JMB for loss of use and enjoyment of the common property in a sum to be assessed. Lawyers CK Lim, Julian Chan, David Yii and S Hemashantini represented the JMB while Cheryl Tay and Carmen Liao acted for the developer.
