SCA overturns acquittal in R25 million Gupta-linked Nulane Investments case

The Supreme Court of Appeal (SCA) has overturned the Free State High Court's decision to acquit all the accused in the R25 million Nulane Investments fraud and money laundering case.
The SCA set aside the High Court ruling that ended in eight accused walking free on April 2023, after the court ruled that there was no case to answer under Section 174 of the Criminal Procedure Act.
This was after the National Prosecuting Authority (NPA) filed an appeal to reverse the judgment.
The SCA ordered that the accused be tried before a different judge.
The matter relates to the payments that the Free State government made to Nulane to conduct a feasibility study that led to the controversial and failed Gupta-linked Vrede Diary farm project.
The suspects included government officials and Gupta-linked associates.

Iqbal Sharma and his company Nulane Investment, former head of the Free State Department of Agriculture (FSDoA), Peter Thabethe, former head of FSDoA Limakatso Moorosi, former FSDoA Chief Financial Officer Seipati Dhlamini, Ronica Ragavan and the company she represents owned by the Gupta's Islandsite Investment, and Dinesh Patel who is Sharma's brother-in-law and a representative of Nulane Investment.
'It is ordered that the first to seventh respondents may be retried for the same offences in respect of which they were acquitted by the Free State High Court on April 21, 2023, as if they had not previously been arraigned, tried and acquitted: provided that a different judge shall preside over the trial,' read the judgment.
NPA spokesperson, Mthunzi Mhaga, said this judgment confirms their view that the acting judge, Nompumelelo Gusha, misdirected herself in applying the relevant principles with regard to the case and erred in her strong criticism of the prosecution team.
Mhaga said the judgment paves the way for the NPA's Investigating Directorate Against Corruption (IDAC) to reinstate the case within a reasonable period, adding that the NPA remains resolute in its stance of effectively prosecuting and holding accountable those responsible for state capture-related corruption.
'Beyond this important case, IDAC has made significant progress in its efforts to ensure accountability for serious and complex corruption and related crimes stemming from the state capture era. It has enrolled 50 cases, declared 133 investigations and partnered with the Asset Forfeiture Unit to obtain freezing and preservation orders amounting to R14.3 billion with R8.2bn in confiscation orders deposited to the Criminal Asset Recovery Account (CARA),' Mhaga said.
He said IDAC has made progress on several other matters and aims to enroll several new cases in the coming months.
"Since becoming permanent and with requisite criminal investigative powers in August 2024, IDAC has expanded its capacity to enable it to deliver effectively on its prosecution-led mandate. It also has established an innovative partnership giving it access to a world-class digital evidence unit that bolsters its ability to extract data from encrypted digital devices to be used as admissible evidence in its cases.'

Tragic end: Missing mother and toddler daughter found beheaded
The 34-year-old mother and her two-year-old daughter vanished in May and their bodies were discovered this week, decapitated. Gareth Cliff speaks out on 'murdered' black farmer
Gareth Cliff has spoken out about Tshwane farmer Jerry Boshoga, who was kidnapped last year. This week, reports emerged that the businessman had been murdered, claims police have labelled 'misinformation'. Cliff's comments come weeks after he spoke to Piers Morgan on a panel discussion about allegations of 'white genocide' and concerns of farm murders in South Africa. He also addressed legislation he believes 'discriminates' against white South Africans. In an X post, Gareth Cliff reacted to a post about Tshwane farmer Jerry Boshoga. In allegations that authorities have since disputed, X user @Lebona_cabonena posted: 'Jerry Boshoga, a prominent farmer and businessman who went missing in November, has been found dead'. Cliff retweeted the post, adding: 'Tragic. Our government needs to take farm murders seriously.' Unbeknownst to Gareth Cliff, the South African police have cautioned South Africans about reposting 'fake news' about the farmer. It shared in a statement this week: 'Unverified social media accounts have shared misleading and false information claiming that Mr Boshoga has been found deceased. 'The SAPS can confirm that the investigation into his kidnapping is still at a very sensitive stage, and the businessman has not been found alive nor deceased. We therefore call on all social media users to STOP THE SPREAD OF UNVERIFIED INFORMATION'. According to the SABC, Tshwane farmer Jerry Boshoga was reportedly kidnapped on 18 November last year. After his disappearance, videos of the 46-year-old being gagged and tortured went viral. His alleged kidnappers initially demanded a ransom of R25 million, but reduced it to R10 million. In one distressing clip, Boshoga pleaded with his mother, 'Please pay, pay now so they can release me. It is too bad. I really need you, please, mother. Please come and pay. Please pay everything that they want. I am begging you …' Police have confirmed that the investigation into Boshoga's disappearance is active and 'sensitive'. Image: Supplied Child murderer and self-confessed cultist Daniel Smit's bakkie, used in the kidnapping and brutal murder of 13-year-old Jerobejin van Wyk, has been seized by the Asset Forfeiture Unit (AFU). National Prosecuting Authority (NPA) spokesperson Eric Ntabazalila welcomed the order following the application for the vehicle's preservation and forfeiture. Smit had used the vehicle to pursue Jerobijn, knocked him over, and kidnapped him before brutally murdering him. Ntabazalila said the vehicle was an instrumentality of the offences of which Smit was convicted of and sentenced on November 5, last year. Smit is currently serving his life imprisonment sentence. Next Stay Close ✕ The AFU is governed by the Prevention of Organised Crime Act 121 of 1998 (POCA). POCA provides for two types of civil forfeiture mechanisms - in terms of Chapter 5, which is a criminal forfeiture and is dependent on a conviction, and in terms of Chapter 6, which is a civil forfeiture and is not dependent on a conviction. In this application, the unit utilised Chapter 6 and applied for a preservation order in terms of Section 38 of POCA. Image: Supplied Ntabazalila said: 'During the criminal trial, the AFU successfully applied for a preservation order, and Judge Hayley Slingers, who presided over the trial, granted it on 19 March. In its application, the unit argued that Smit used the vehicle to pursue the deceased, knock him over, kidnap, and murder him, and that it was an instrumentality of the offences listed in items 1,3 and 7 of Schedule 1 of POCA, that being murder, kidnapping, assault, and child stealing. In terms of Section 40 of POCA, AFU had 90 days to file a forfeiture application, failing which the preservation order would lapse,' said Ntabazalila. On Thursday Judge James Dumisani Lekhuleni granted the unopposed forfeiture order. The application was served on the accused in prison on April 10, confirmed Ntabazalila. In November last year, Smit was sentenced to an effective life imprisonment following his conviction on attempted murder, kidnapping, murder of Jerobejin, violation of his corpse, and defeating the administration of justice. The court ordered that Smit must serve two-thirds of his sentence before he could be considered eligible for parole. During trial, the court heard that on February 2, 2022, Jerobejin and his friend entered the accused's property in Matzikama Street, Klawer, and stole fruit from his garden. He claimed he became angry as the two boys mocked him when he spoke to them. 'After pursuing them with his vehicle and catching Van Wyk, he took the boy home, broke his neck, put his body in the freezer, and later dismembered it. He burnt it using tricks he claimed he learnt from a Chinese occult he joined when he was a teenager. He also claimed the occult had an influence on him and used that mitigation of sentence, as well as diminished responsibility. He asked the court to sentence him to 30 years of direct imprisonment,' said Ntabazalila.
