
Cal HC starts mediation drive to settle more than 2L pending cases

Kolkata: The Calcutta High Court has embarked on an initiative to settle pending cases through mediation following Supreme Court guidelines. Currently, there are 17,046 pending cases on the high court's original side.
The number of cases filed with the original side so far this year is 2,712. Last year, 4,750 original side cases had been filed at the HC.
There are 355 original side cases that have been going on for over four decades. In addition, there are 1,416 cases that have been going on for three decades while 2,143 have been going on for the past two decades. According to the Calcutta HC website, the pending case figures on appellate side are 1,85,602.
Cases running for over four decades number 5,472, those for over three decades are 19,709 and over two decades are 38,000.
Last year, 61,693 cases were filed with the HC appellate side. So far, 33,000 cases have been filed this year.
In the Jalpaiguri circuit bench, there are 3,740 pending cases. Port Blair circuit bench has 485 pending cases. The pending cases in the district courts of Bengal are at a whopping 35,69,293.

Among them, 14,755 are three-decades old, 74,000 have been going on for two decades while 5.5 lakh cases have been running for over a decade. On Tuesday, 3,429 new cases were filed in district courts in the state. So far this year, 5.9 lakh cases have been filed.
In 2024, the figure was over 10 lakh. There are also nine cases pending in the special court of MP/MLA at Bidhannagar, where the nine people's representatives are facing trial.

Justice Surya Kant, who is the executive chairman of NALSA (National Legal Services Authority) and of MCPC (Mediation & Conciliation Project Committee) of Supreme Court, will hold a meeting with the judges of the high courts on Wednesday to push for a 90-day long 'Mediation for the Nation' campaign to settle suitable pending matters. The Calcutta High Court has already started a people-friendly approach in dispute resolution, and for this, the district courts have been directed to stress on mediation, said Sudip Banerjee, member-secretary of the Mediation and Conciliation Committee, Calcutta High Court.
Banerjee said: "We are trying to identify cases of matrimonial disputes, accident claims, domestic violence, cheque bounce, commercial disputes, compoundable cases, and land acquisition matters to settle them through mediation." The special mediation drive started on July 1. He said that Supreme Court gave consent to hold mediation even through the hybrid mode.

Ensure ashram-like compassionate atmosphere in jails: Gujarat HC to authority
Ahmedabad: The Gujarat high court on Friday directed the Inspector General of Prisons to ensure that "a friendly and compassionate atmosphere, akin to an 'ashram' is required to be created within the jails". Justice H D Suthar, while ordering the release of a convict detained in Vadodara's central jail for over two months longer than his punishment and awarding him compensation, stated in his order, "It is hoped that the jail authorities will treat all inmates with humanity and sensitivity, following the Model Jail Manual, and do the needful for the rehabilitation of convicts and prisoners. The Inspector General of Prisons shall ensure that a friendly and compassionate atmosphere, akin to 'ashram,' is required to be created within the jails. " Expressing this hope, the judge quoted Mahatma Gandhi's statement, "The best way to find yourself is to lose yourself in the service of others." This happened in a petition filed by a prisoner, Raju Ninama, through advocate A A Zabuawala, who complained that his client was not released from prison even after he served his sentence. The HC summoned the jail officials, including the superintendent Usha Rada, and reprimanded them for this lapse. It ordered the immediate release of the prisoner and said, "In this case, the jail authorities, instead of following the clear directions in the warrant, unilaterally reduced the set-off period, resulting in the petitioner undergoing an additional 2 months and 8 days of illegal detention, which amounts to wrongful confinement and a violation of Articles 19 and 21 of the Constitution of India. Such wrongful confinement, stemming from arbitrariness and highhandedness, reflects a complete disregard for the fundamental rights of the convict." The HC further stated, "Article 51A of the Constitution enjoins all citizens to show compassion toward living beings. Jail inmates, although convicts, do not lose their fundamental rights. Despite repeated opportunities, the authorities failed to act with empathy and continued with their illegal and arbitrary approach." The HC directed all judicial officers, who are jail visitors, that "…they must verify jail records to ensure that no undertrial prisoners or convicts remain illegally detained even for a minute beyond the completion of their sentence or granting of bail." Further, the authorities are directed "to undertake a comprehensive exercise to recalculate the set-off period for all convicts as per their respective conviction warrants. After due verification, updated admission cards/tickets of convicts and relevant jail records shall be prepared in accordance with the circular dated Aug 1, 2025."

Top court junks plea to bring political parties under PoSH
The Supreme Court Friday refused to entertain a plea seeking to bring political parties under the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013.A division bench headed by Chief Justice of India (CJI) BR Gavai said the issue would fall "only in the domain of the parliament". The bench refused to entertain the plea. Eventually, the petitioner was given the liberty to withdraw his plea. The petitioner, Supreme Court advocate Yogamaya MG, had moved the court highlighting non-compliance with the PoSH Act by political parties, particularly when it comes to constitution of internal complaints committee (ICC) to deal with sexual harassment complaints. The petitioner sought that the definitions of "workplace" and "employer" under the PoSH Act be harmoniously interpreted to make the Act applicable to political parties. The petitioner had earlier also approached the apex court over the same issue. However, the court had then asked the petitioner to first approach the Election Commission of India (ECI).
