Whales could one day defend themselves in court—and in their own words

Scientists are closer than ever to deciphering sperm whale communication. Their breakthroughs could open the door to expanded whale rights and even legal personhood. Two summers ago, in the turquoise waters off the coast of a small Caribbean island called Dominica, a sperm whale named Rounder began to give birth. Eleven members of her clan slowly gathered around to support her, converging from miles away in their home waters. They called to one another in choruses of Morse code-like clicks as they waited for the baby to arrive and in the hours that followed, when they held the calf above water so that she could breathe, only lowering her when her fins finished unfurling. Soon after, they departed.
Scientists are developing innovations in recording and analyzing sperm whale communications that could someday make it possible to understand at least some of what whales say to each other in these extraordinary moments. People might translate what they only now surmise: expressions of care and joy, arrangements of duties, cries of pain and discomfort. With those translations would come profound and surprising legal questions.
Might a richer understanding of what sperm whales say breathe new life into laws that presently offer only incomplete, often-unenforced protections? Could legal systems recognize whales as persons, their interests so important as to be accorded formal rights? 'I think we're just now on the cusp of this immense legal world,' says David Gruber, a marine biologist and National Geographic Explorer. Gruber is the founder and president of Project CETI (Cetacean Translation Initiative), which has gathered dozens of linguists, biologists, roboticists, and experts in artificial intelligence to document the lives and communications of Dominica's sperm whales. Their work builds on several decades of findings in the field of animal communication—not only in sperm whales but throughout the animal world, from songbird syntax to chimpanzee gestures and river turtle repertoires. Gruber's team is working to translate whale conversation with an unprecedented richness and detail. They hope to eventually develop a quasi–Google Translate for cetaceans, which would convert sperm whale sounds into human language and vice versa.
Already, Gruber and his colleagues are beginning to anticipate some of the legal implications of this work. In a new working paper that is expected to be published later this fall in the journal Ecology Law Quarterly, they note that one result might be a world in which humans 'undeniably understand' these creatures' experience from their own perspective. 'Such insights could provide a groundwork for new laws and inform how existing laws regulate actions that impact cetaceans.'
To explore what might become possible, Gruber tapped a leading team of experts, including César Rodríguez-Garavito, director of the More-than-Human Rights Project at New York University; Ashley Otilia Nemeth, an attorney at NYU's TERRA Clinic; and CETI linguistics lead Gašper Beguš of the University of California, Berkeley. They offer a new framework for thinking about the law that is rooted in the way whales experience the world. Consider, for instance, the problem of ocean noise pollution. For creatures like sperm whales, who rely upon echolocation to find food and to navigate, and who remain in near-constant vocal contact with family and friends, sound is paramount. Humanity's growing aquatic din—oil and gas exploration, construction, military sonar, and most of all ship engine noise—is a clear harm, disrupting the basic activities of sperm whale life. 'We have very good evidence of the impacts,' says Rodríguez-Garavito, yet that evidence has yielded piecemeal progress. The federal Marine Mammal Protection Act and the Endangered Species Act—the bedrock of cetacean protections in the United States—provide a legal framework for preventing harms, but government agencies have mostly neglected to apply rules against harming cetaceans to cases of noise-induced harm. The same toothlessness holds for other attempts to curb underwater noise, such as new regulations passed in the European Union and by the International Maritime Organization.
But what if whales were documented not only straining to make themselves heard above the racket, but actually talking about it? Were a sperm whale heard articulating the pain and difficulty caused by a ship's eardrum-rattling, echolocation-scrambling engine noise, their words would likely carry more weight in a court of law than do human descriptions of the problem. Being able to present the whales' own testimony, so to speak, might move—or shame—government agencies and judges to action. It 'would help us make more of a convincing case,' says Rodríguez-Garavito, and a deeper understanding of sperm whale communication could inspire even farther-reaching legal claims.
Animal advocates and conservationists might be able to argue that near-constant physical and psychological stress caused by chronic noise pollution actually violate the spirit of international prohibitions against torture. Sensory deprivation and overstimulation are already recognized as torturous for humans; recognizing the same for whales could lead to new, more urgent protections.
Advocates could also assert that by disrupting communication and social activities, noise pollution interferes with sperm whale culture—and that the whales should qualify, again in spirit if not in letter, for recognitions afforded by the Universal Declaration of Human Rights, which enshrines a right to participation in cultural life.
After all, culture—socially transmitted information that is passed between generations—is already known to be a significant feature of sperm whale life. Different clans have different dialects, lifestyles, and social customs. Even when their waters overlap, clan members often keep to themselves, and their structure resembles that of human tribes. But those are coarse descriptions; to learn about the whales' cultures through their own words would provide a finer understanding of them. It would put a sharper point on what is lost when humans destroy those cultures or remove individuals from them—by hitting them with ships, hunting them for profit, or capturing them for entertainment.
Perhaps that deeper, first-person understanding could again lead to new protections or reinforce existing ones. Maybe advocates will be able to call not merely for protections, but true rights: the explicit legal recognition of an interest as profoundly, inviolably important.
That leads to the topic of legal personhood, defined by the late Steven Wise, founder of the Nonhuman Rights Project, as the capacity to have any rights at all. In the United States, rights are exclusively human. No animal has ever been accorded a full legal right; although laws against cruelty and the mistreatment of animals provide some protections, they have neither the force nor versatility offered by rights. The Nonhuman Rights Project has tried to cross that legal divide by filing lawsuits seeking the release of captive chimpanzees and elephants. The lawsuits draw on scientific research showing how those species share the mental capacities—including rich forms of self-awareness, emotions, and society, and the ability to plan for the future and make choices—that in humans give rise to autonomy and thus underlie our right to be free from arbitrary imprisonment. As a matter of equality, Nonhuman Rights Project lawyers argue this right should be extended to chimpanzees and elephants as well.
Courts have so far rejected that argument, and among their stated justifications is the idea that in order to have rights, one must also be able to bear social responsibilities and legal duties: the right to liberty comes with a duty not to break the law. Rodríguez-Garavito and his co-authors suggest that Project CETI's work could illuminate how sperm whales negotiate their own social responsibilities, such as helping mothers deliver and protect their babies, thus establishing them as duty-bearers in the law's eyes. Translating the caregiving arrangements whales make with each other will not likely satisfy reluctant judges, though. Spencer Lo, an attorney with the Nonhuman Rights Project, noted that judges already dismiss scientific evidence of social responsibilities fulfilled by chimpanzees and elephants. Instead those animals are found wanting in their inability to explicitly understand human legal codes—an expectation that is not applied to babies or people with severe dementia, who are similarly unable to understand laws but still have rights. That double standard speaks to the essential discomfort most judges have with the idea of animal personhood. And even when courts don't cite the 'rights and duties' standard, they have found other rationales.
Those rejections are ultimately rooted in the belief that 'humans are qualitatively—and thus morally and legally—distinct from all nonhuman animals,' says Lo. He thinks that Project CETI's work, and that of other researchers deciphering complex animal communication, has 'transformative potential,' but not because it will reinforce any particular legal argument. Rather, that potential resides in its power 'to undermine human exceptionalism and thereby bolster the case for personhood.'
Yet despite their courtroom struggles, the Nonhuman Rights Project has arguably triumphed in the court of public opinion. Understanding sperm whale communication may not lead directly to new laws or precedents—but it should still nourish empathy and care. Even as U.S. courts have refused to recognize animals as persons, however, jurisdictions elsewhere have been more open-minded. In recent years, judges in several countries have declared that some animals should be considered persons; in Panama, for example, sea turtles now have a federally recognized right to freedom from human harm, and Ecuador's highest court took the extraordinary step of declaring that all animals are legal persons. Discussion is now ongoing about the rights that each species deserves.
Kristen Stilt, faculty director of Harvard University's animal law program, used the analogy of fluid flowing through pipes to illustrate how better understandings of animal communication could lead to legal change. In the United States, she says, new information flows through 'a couple little straws,' but in places that are open-minded to animal rights, 'it's like you've got this massive pipe, and all this [information] can flow in all these different directions.'
Leading scientists and legal scholars are already considering the potential harms of this technology. 'In the miraculous event that we do eventually 'crack the code,'' says Philippa Brakes, a behavioral ecologist at Massey University in Australia, 'there are issues such as the potential for communications with wildlife to be used for nefarious purposes.'
Gruber agrees and adds that technology developed by Project CETI and other researchers could be turned to ill not only by people who want to harm whales, but by well-intentioned yet careless people. He is especially troubled by the thought of people 'racing to try some of these fancy new AI tools"—tools that not only translate whale communication but mimic it—without fully understanding what is being communicated.
'We must still grapple with the potential impacts of its research and what its findings may equip others to do,' write Gruber's team. Stilt has even more fundamental reservations. If complex animal communication and our ability to translate it becomes the basis for ethical regard, a bar that animals must clear for their interests to be recognized, it would 'take us backwards,' she says. That would give people an excuse for failing to act on what is already known about animals, the harms we cause, and how we should treat them, regardless of whether they speak in a suitably human-like way.
The Project CETI team shares those reservations too. 'Why must nonhuman animals resemble humans for us to empathize with their pain and safeguard their well-being?' they write. 'Must they articulate their suffering when we already possess a clear understanding of the injuries we cause?'
The quest to find and translate complex animal communication should not diminish the worth of creatures who don't appear to have those capacities, says Rodríguez-Garavito. We may simply fail to appreciate their intelligence; and the lack of rich communication does not make any life less special. But it would still be incredible, and perhaps transformative, to know what sperm whales say—and this could be seen as an entry point, a beginning rather than a destination, on the journey to appreciating all creatures.

Scientists find tomb of a Maya king and his ancient treasures. But who was he?

Found in the ancient city of Caracol, the tomb contained a rare jade mask, ceramics, and jewelry often linked to the Maya ruling class. Photograph Courtesy Caracol Archaeological Project/University of Houston Deep in the dense jungles of Belize, archaeologists excavating the ancient Maya city of Caracol have unearthed what they believe to be the 1,700-year-old tomb of a ruler. If confirmed, the discovery would mark the site's earliest known royal burial, and possibly the resting place of its founding king, Te K'ab Chaak. 'This is an extremely important discovery,' says Francisco Estrada-Belli, an archaeologist at Tulane University and a National Geographic Explorer, who was not involved in the research. 'It is extremely rare to find the burial of a known Maya king, let alone of a dynasty founder.' The researchers say the tomb, along with other finds at the site, may offer evidence that ties between the Maya and the distant metropolis of Teotihuacan began earlier than previously thought. But without inscriptions naming the tomb's occupant or DNA analysis confirming his identity, some experts caution that the claims remain speculative. The discovery, announced Thursday by the University of Houston, was made by Diane and Arlen Chase, two married archaeologists who have spent nearly four decades uncovering secrets from Caracol. Jade death masks and bones Arlen Chase and the team found this latest tomb earlier this year while digging at the site's northeast acropolis, or palace complex. While reopening an excavation trench from 1993, he stumbled upon a large, undisturbed chamber with walls coated in a red mineral called cinnabar. Finding tombs at Caracol is not unique, says Arlen Chase. They've dug up over 850 burials and about 175 tombs at the site. But this newest find stuck out from all the rest. That, along with the large size of the tomb—about 6.5 feet in height and 13 feet in length—'tells us that it was somebody important,' he says. Lithuania's timeless city Inside, Chase came across the skeletal remains of a man and a treasure trove of Maya artifacts, including: a jade and shell mosaic death mask that had been smashed to more than a hundred pieces; three sets of jade ear ornaments; four jade beads with the faces of spider monkeys; decorative pottery, some adorned with animal motifs and another painted with a ruler holding a spear; and a skull upside down in a pottery vessel, as if it had rolled away from its body. The individual's jaw also showed signs that it had resorbed the teeth, indicating that it likely belonged to an elderly person. The researchers think the deceased man was likely laid out or seated on a pallet that eventually decayed, causing his skeleton to collapse. This ceramic bowl is modeled in the form of an owl. The style matches other vessels from the Early Classic period of Maya history, and based on this, the researchers estimate that the tomb is from A.D. 350. Photograph Courtesy Caracol Archaeological Project/University of Houston 'Everything about it says ruler,' says Diane Chase. The realization, she says, gave her goosebumps. 'It was clear that, Whoa! This really is probably a ruler–it's probably Te K'ab Chaak.' Hieroglyphic texts found elsewhere at Caracol refer to Te K'ab Chaak as the founder of the dynasty that ruled the city for more than 460 years and say that his reign began around A.D. 331. The tomb itself contains no writings identifying who was buried there, so the researchers rely on timing to make this claim. The team dated the newly discovered tomb to between roughly A.D. 330 and 350, based on two key observations: The type of pottery inside was typical of the Early Classic period, which spans from about A.D. 280 to 380, and radiocarbon dating of a nearby cremation burial they previously excavated in Caracol in 2010. That cremation, also dated to around A.D. 330 to 350, was placed above the tomb in the site's stratigraphy, suggesting the newly found tomb came around the same time or slightly earlier. Taken together, the team argues, these clues point to a ruler's burial that aligns closely with the period when Te K'ab Chaak sat on the throne. Photograph Courtesy Caracol Archaeological Project/University of Houston The pair both say they are '99.9 percent' confident that the tomb belonged to Te K'ab Chaak. 'Are we going to still keep looking to double check? Absolutely,' says Diane Chase. Stephen Houston, an archaeologist from Brown University not involved in the work says the tomb was an intriguing find and agreed that it belonged to royalty. But he added that he needed more convincing to conclude that it contained Te K'ab Chaak. 'Perhaps, at some point, a glyphic text will appear and confirm the identity of the deceased,' he says. Maya-Teotihuacan connections Diane and Arlen Chase also argue that their finds at Caracol sheds light on the power dynamics between the Maya and Teotihuacan, an ancient civilization located near present-day Mexico City that is neither Maya nor Aztec (or Mexica). 'The discovery also shines light on the sorts of relationships the Teotihuacanos and Mayas had in the early fourth century, which seem based on trade, pilgrimages to Teotihuacan, and diplomacy,' says David Carballo, an archaeologist from Boston University who was not involved in the research. The journey between the two Mesoamerican cities would have required walking some 750 miles on foot. (This 1,700-year-old sacrificial monkey has a surprising backstory.) In A.D. 378, individuals from Teotihuacan staged a coup or military incursion in the Maya city called Tikal, known as the 'entrada.' This is when some archaeologists argue that Teotihuacan influence began to appear in Maya culture. Diane and Arlen Chase say their findings make the case that the Maya and Teotihuacan interacted at least 28 years earlier, around A.D. 350. One of their strongest pieces of evidence to this connection, they say, is the cremation burial from between A.D. 330 and 350. Cremation burials were common among the Teotihuacan elites, while the Maya buried their dead. So, the researchers argue that the cremation at Caracol suggests that the people were already being influenced in some way by Teotihuacan decades before the entrada. They also found green obsidian blades at the cremation site, which the researchers say most likely came from north of Teotihuacan. But not everyone agrees that the researchers have made a strong enough case to support their argument about earlier Mesoamerican connections . A similar motif appears in imagery from another tomb in the same area—burials that span within 30 to 50 years of each other, researchers estimate. Photograph Courtesy Caracol Archaeological Project/University of Houston 'I'm not sure what particular thing at this particular site or excavation actually links it to Teotihuacan,' says Anabel Ford, an archaeologist at the University of California, Santa Barbara. 'Lots of this is not really falsifiable, just their feelings of the associations.' Sharing the science The archaeologists have not yet published their findings from the 2025 field season in a peer-reviewed journal, but they plan to present them in August at the Santa Fe Institute's Maya Working Group conference in New Mexico. The researchers shared a draft of their results with National Geographic that describes the 2025 tomb discovery, as well as burials found in 2009 and 2010 that they say support their arguments about Maya-Teotihuacan interactions. 'Normally we would publish first and then a news release,' says Diane Chase, 'but the find was really so spectacular that we felt like we had to let it out somehow, because people were asking to see pictures and photographs.' She added that their next steps include attempting to extract ancient DNA from the bones as well as conduct isotope testing on the remains. These tests could provide insights into the individual's diet and whether he lived most of his life in Caracol or moved around a lot, she says. Such clues, she says, would be key to confirming whether the man buried in the tomb is indeed Te K'ab Chaak.

Fireflies are flourishing in places you wouldn't expect

Pesticides, habitat loss, and light pollution are threatening firefly populations worldwide, but even in urban areas, some lightning bugs continue to shine. Photographs by Sriram Murali For many people across the United States, summer doesn't truly begin until the soft glow of electric yellow and green fireflies can be seen drifting through the night. But you don't have to travel to the deep woods or open prairie to experience these otherworldly insects. In fact, several firefly species can be found quietly blinking in the heart of some of the United States' largest cities. 'It's the last place you would expect to see fireflies,' says Sriram Murali, an International Union for Conservation of Nature Species Survival Commission firefly specialist and National Geographic Explorer. This summer, Murali traveled to New York City and Washington, D.C. to photograph urban fireflies as a way to show how resilient some species are in the face of one of their greatest threats—light pollution. Areas closer to light pollution show reduced firefly activity, with noticeably shorter streaks. 'Where I live in a small town in India, people hardly think about the impacts of lighting, because we can close our curtains and sleep peacefully at night,' he says. 'But there's so much nocturnal wildlife, even in towns and cities, such as owls, frogs, and snakes, that need darkness.' And yet, even in cities that never sleep, some fireflies, such as the common Eastern firefly (Photinus pyralis) have found a way to make do. Murali even discovered a rare population of the vulnerable dot-dash firefly (Photuris pensylvanica) lighting up the night during a photoshoot on Roosevelt Island in Washington, D.C. Where guests are guardians 'To me, it's more philosophical, and it's about how much change we've done to our environment,' says Murali. 'That an insect which has evolved over hundreds of millions of years has had to adapt to so much. 'They deserve their rightful place as much as we do,' he says. Also known as big dippers for the J-shaped flash pattern they make, common Eastern fireflies are one of the most frequently spotted fireflies in eastern U.S. cities, says Gabriel Willow, an urban naturalist living in Brooklyn. From Central Park's rolling greens and pollinator meadows to soccer and baseball fields, Willow says the best way to see these bioluminescent beetles is to go looking in late June. 'It has to be warm enough, and they have to have enough time to metamorphize from the larval stage to the adult stage, which is when you start seeing them flying and flashing and looking for a mate,' says Willow. Fireflies of this species are notable for the "J" shape they make while they glow. Grassy areas are a particularly good place to look for fireflies. Pesticide use in grassy urban areas is generally less of a problem than in suburbs—although cities often do spray for mosquitoes, which likely affects firefly populations too. As someone who regularly conducts urban wildlife tours, Willow says he likes to remind people that many major cities sprouted up around areas that were exceptionally biodiverse. 'New York City is located within an estuary, and that means you have lots of sea life, but also migrating birds,' he says. 'Los Angeles was built on a former wetland, and if you look at London or Paris, they're built on estuaries, too.' Of course, the nation's capital is often derided as being a swamp, but its wetlands are home to an incredible diversity of wildlife—including fish, insects, and even newly-arrived large predators, such as coyotes. But to find fireflies in a city, experts say, it's also important to look for the dark corners where they have the best chance of surviving. (Will we still see fireflies this summer?) Survival in the city While it's inspiring that creatures large and small can be resilient enough to still call our cities home, they often do so at great risk. Many animal species shy away from the bright lights of human-dominated areas, but for fireflies—also called lightning bugs—the problem with lights is more direct. 'Fireflies and glowworm species all use bioluminescent light to court one another. This is how they speak to each other,' says Candace Fallon, senior conservation biologist and firefly lead at the Xerces Society for Invertebrate Conservation. 'When you have a site that's filled with artificial light at levels they didn't evolve with, it can just really have an impact on the productive success of that population.' Despite the threat of light pollution, urban green spaces like this one help fireflies continue to thrive. Imagine being out in the dark and trying to zero in on one specific point of light, says Fallon. Then imagine trying to do the same thing in a world awash with streetlights, billboards, and dusk-to-dawn lights. Of course, light pollution is just one threat among many. 'When we did our [IUCN] Red List assessment a few years ago, the biggest threats to fireflies were definitely things that impact a lot of other insect and wildlife populations,' says Fallon. 'So, things like habitat loss and degradation, pesticide use, and climate change.' Unfortunately, there isn't much historical data to contextualize where numbers are today, but most experts remain worried about firefly population declines. While only 150 of the world's 2,600 firefly species have been assessed, scientists say 20 percent of firefly species are threatened with extinction. Given how important light is to the lightning bug life cycle, one easy way to help wild firefly populations is to turn off outside lights. 'Even simple things like closing your curtains at night so that light isn't spilling out into the habitat outside,' says Fallon. Another boon is to let patches of lawn grow 'a bit more wild and unruly,' she says. This is because fireflies need moisture and native vegetation. Finally, reducing pesticide usage can be helpful for insects of all kinds—especially the grub-killing pesticides people use for their lawns. 'Fireflies are beetles, so that can have an impact on their larva,' says Fallon. If you'd like to get even more involved with firefly conservation, the Xerces Society runs a citizen science project called Firefly Atlas that seeks to get a better grasp on how lightning bug populations are changing. After all, no matter where these insects are found, they are worth saving. 'Aside from their own intangible value that they have just by existing, I think fireflies serve a really special place in human society,' says Willow. 'They're a portal that connects people to the wonder of the natural world around them.'
