Senate Bill to outlaw AI deepfakes within 60 days of an election gets House hearing

Montana is looking to join 20 other states with a bill to ensure candidate 'deepfakes' don't become part of elections in the state.
A bill regulating usage of artificial intelligence in elections received a hearing last week and is awaiting executive action.
Senate Bill 25, brought by Sen. Janet Ellis, D-Helena, adds definitions and disallows so-called 'deepfakes' within 60 days of an election. There is an exception — if the media is marked as being artificially generated or edited, they would be allowed and the bill has a long list of stipulations depending on the media type.
'This isn't something attacking free speech,' Ellis said in a March 25 hearing before the House State Administration Committee.
Candidates have two options for dealing with deep fakes — they'd be able to file an injunction and have the option of filing a complaint with the commissioner of political practices.
The injunctive relief for a candidate targeted by a deep fake is supposed to be immediate, with the bill going so far as to say it 'must be expedited by the district court and given preference over all other matters currently before the district court upon showing of present or ongoing harm.'
A second offense would be a misdemeanor. The bill did generate some discussion over the specifics of the exceptions, with Ronda Wiggers of the Montana Broadcasters Association providing some soft opposition.
Her opposition boiled down to who would be accountable for running the material. The bill contains language that says 'the person, corporation, committee, political party, or other entity knew or should have known (the material) is a deepfake of a candidate or political party on the ballot.'
Wiggers said she'd like to see that language removed.
'So we would like you to strike the words 'or should have known,' that's all,' Wiggers said. 'So that we don't have to try to figure out how we should have known that something was a deep fake.'
There are 20 states with laws on the books regarding artificial intelligence in elections, according to the National Conference on State Legislatures. It's a rapidly developing field and there's worry it will continue to be an issue in upcoming elections.
SB 25 seeks to address the problem before it becomes one in Montana, like much of the tech and artificial intelligence legislation this session.
'I don't know how much of that is going on in Montana, but it's a real problem in this country,' said Sen. Pat Flowers, D-Belgrade, at a press availability Tuesday. 'And I think we're trying to get out in front of all those kinds of bad behaviors when it comes to AI.'
Elections have changed, Flowers said. Campaigns are getting 'icky' House Minority Leader Katie Sullivan added.
'We've opened the flood gates, and campaign spending and the social media component is outrageous and is used more and more and more by campaigns,' Sullivan, D-Missoula, said.
She said the technology to make 'deepfakes' of candidates is accessible to a lot of people.
'I would anticipate people would absolutely use that if they could. We should absolutely outlaw it,' Sullivan said.

The US research team has been working to keep track of Ukrainian children that have disappeared since the start of Russia's 2022 war on Kyiv and has identified dozens of these camps — at least 13 in Belarus and 43 in Russian-annexed Crimea and across mainland Russia. 7 Two Ukrainian children at a camp in Russia. AP There, the kids are being indoctrinated into Russian strongman Vladimir Putin's vision, raised to speak Russian — not Ukrainian — and forced to sing the Russian national anthem daily. Some of the children forcibly removed from their homes were as young as four months, according to researchers. Other kids have reportedly been sent to Kremlin-backed military boot camps, training to fight for Moscow in the brutal war against their own country. 7 Shocking footage on Russian TV showed Ukrainian children assembling weapons. The Kremlin, meanwhile, has claimed to have abducted a staggering 700,000 Ukrainian children from the occupied territories. 7 The Kremlin paraded children taken from Mariupol to mark the first anniversary of the start of Putin's war. Russians have been open about what they've called 'rehoming' Ukrainian children, who have been portrayed as having been abandoned by their families. Moscow's state television has aired news segments where kids arriving from Ukraine are gifted teddy bears by their adopted Russian families. Even the Kremlin's Children's Rights commissioner, Maria Lvova-Belova, has publicly bragged about adopting a boy from the city of Mariupol, which was seized by Russian forces in 2022 following a bloody, months-long siege. 7 Ukrainians have protested for the release of the children taken to Russia. Any attempts to recover the children has been met with stiff resistance from the Kremlin, which has even refused to give Ukrainian authorities a list of their names, according to the Yale team. Is Chinese Pres. Xi Jinping on his way out?
Over the past few months, unprecedented developments point to the potential, and potentially imminent, fall of China's 'Chairman of Everything' Xi Jinping. Chinese Communist Party elders — including Hu Jintao, Xi's immediate predecessor, whom Xi humiliated at the 20th Party Congress in 2022 — are now running things behind the scenes. Xi is in poor health and likely to retire at the CCP Plenary Session this August or take a purely ceremonial position. Xi's downfall has been rumored before. But never have we seen the recent purges (and mysterious deaths) of dozens of People's Liberation Army generals loyal to Xi; all replaced by non-Xi loyalists. Advertisement 6 There are increasing signs that Chinese President Xi Jinping is being edged out of the leadership position he has held since 2013, according to reports. Also, the 'un-naming' of Xi's father's mausoleum last month was unprecedented. The mausoleum, which Xi has built to honor his late father, was larger than the mausoleums of either Mao's or Deng's. There was no explanation for Xi's disappearance for almost two weeks in late May and early June while foreign dignitaries were hosted in Beijing by other CCP Leaders. Xi has also been conspicuously missing from the pages of the People's Daily, the CCP organ that until recently ran fawning front-page stories on Xi daily. 6 Xi appeared tired, distracted, and generally unwell at a meeting with the Belarusian President Alexander Lukashenko in early June. Advertisement The meeting location was a low-key family-style area of the CCP leaders' compound (Zhongnanhai) in Beijing that had never before hosted a state visit. Stripped of the pomp and circumstance that used to accompany every Xi gathering, the entire entourage was a mere handful. None of Xi's translators or senior aides were present. Compare that to the state visits recently hosted by other CCP leaders; large, extravagant affairs in prestigious CCP conference halls. And following his recent call with President Trump, Chinese state media, including state TV, referred to Xi without any formal title at all. This has never happened before. 6 Wang Yang, recently appointed to lead the Chinese Communist Party, has been spoken of as a successor to Ji Jinping, reports claim. Getty Images While this was later partially corrected, it is inconceivable that such a glaring oversight was an accident. Recently, professors at some of China's most prestigious universities have published articles directly criticizing Xi, which was unthinkable previously. Advertisement These are just a few of many unusual signs from Beijing that signal major changes in the CCP power structure. Although not yet certain, it appears that Zhang Youxia and CCP elders have chosen Wang Yang, whom Deng Xiaoping lifted out of obscurity and who served as a successful technocrat until his forced retirement in 2023, to be the next CCP chairman. He is known as a soft-spoken reformer who supports more free-market policies, more decentralized decision making, and a much less confrontational foreign policy. 6 Residential homes line a deserted street in the Kangbashi district of the town of Ordos in China's Inner Mongolia Autonomous Region. REUTERS To paraphrase Churchill, China is a riddle wrapped in an enigma surrounded by a mystery. So no one can know anything with absolute certainty. But given the disastrous results of Xi's one-man rule, his ouster would be no surprise. With over $50 trillion in total debt (national, local and private sector debt is larger than the combined economies of the US and EU), well over 50 million unused (and mostly unusable) apartments due to government policy failures (enough for all of Germany), wealthy Chinese emigrating en masse with their assets and an unemployment rate in depression territory . . . it is not surprising that local riots, factory arsons and anti-government protests have flared all over China. One CCP elder recently lamented China's complete isolation on the world stage under Xi, except for a handful of countries that are 'good for nothing.' Vladimir Putin, take note: You lost Syria last year, you are on the brink of losing Iran, and you may soon lose China. Excellent news for all democracies, and especially for Israel, America, and the brave people of Ukraine. 6 The author's new book on Ukraine. May his replacement learn from the success of the global West (including Asia's most successful countries) and lead his nation onto the oftentimes messy but ultimately rewarding path of free markets, free people, real democracy, and the rule of law.
