Major Australian retailers fined for dodgy Black Friday sales
Jeweller Michael Hill, homewares retailer Global Retail Brands Australia, and Hairhouse Online have each paid a $19,800 fine following infringement notices from the Australian Competition and Consumer Commission (ACCC), the regulator says.
Paying fines does not amount to an admission of breaking the Australian Consumer Law.
The consumer watchdog issued the infringement notices after finding the retailers were selling non-discounted items despite their website homepages spruiking 'sitewide' sales or sales on 'everything'.
The discrepancies were found during a sweep the ACCC did of Black Friday sales, the period at the end of November where retailers typically have large discounts.
'Businesses that make false discount claims not only risk misleading consumers, they also compete unfairly against other businesses which correctly state the nature of their sales,' ACCC deputy chair Catriona Lowe said.
ACCC analysis shows that while Michael Hill had a prominent banner on its homepage promoting a 'member event' 25 per cent off sitewide sale, some items were not discounted.
'Michael Hill's statement may have misled consumers, and contravened the Australian Consumer Law, because some of the products in its online store were not part of the sale and were not discounted,' Ms Lowe said.
Global Retail Brands Australia owns MyHouse, which has 28 physical stores in Australia, plus a range of similar homewares businesses.
Splashed across the MyHouse e-store late last year was an ad saying 'everything' was subject to a Black Friday sale with discounts up to 60 per cent. The ad also promised an 'extra' 20 per cent off.
'We say this was misleading because the extra 20 per cent discount was not available on all of its products,' Ms Lowe said.
'Retailers need to ensure that their advertising makes it clear to consumers which products are discounted and by how much.'
Hairhouse Online promised 20 to 50 per cent off 'sitewide' for Black Friday sales. More than one-quarter of items on the site were not discounted at all, the ACCC says.
The haircare retailer is owned by Melbourne-based The Hairhouse Warehouse.
Australians spent about $7bn on the Black Friday sales in 2024.

A child has died after being struck by a tree in the Northern Territory. The Territory's Police force says the seven year old girl was playing in the yard of a house in Tiwi before being struck by a falling palm tree. They say an 11-year-old boy was also hit by the tree, but sustained non-life-threatening injuries. Tasmanian Labor leader Dean Winter says he's begun discussions about possible powersharing arrangements, after Saturday's election. Neither major party has won enough seats in the lower house to rule as a majority government, but the Liberal Party has so far secured 14 to the ALP's nine. Liberal Premier Jeremy Rockliff says he will be asking the governor to recommission his government on the basis that there's been a roughly three per cent swing to the Liberals. But Mr Winter has refused to officially concede, saying he is keeping his options open. "At this stage, we've had - we've opened the line of discussion with the crossbench. A man is being charged with assault after a car ramming incident outside a nightclub in Los Angeles that's injured around 30 people - including the driver himself. At least three people are understood to be in a critical condition after the 29 year old suspect allegedly drove his car onto the footpath outside the Vermont Hollywood Club on Santa Monica Avenue, just eight minutes after he had been thrown out of the venue. Los Angeles police say members of the crowd quickly attacked the man after the incident - which investigators already believe was intentional. Captain Adam van Gerpen of the Los Angeles Fire Department says that the driver was also shot by a bystander. "As part of our triage when the paramedics were loading up one of the patients that was considered immediate, on their secondary inspection of him, they did find that there was a gunshot wound." Three more bodies have been found after a tourist boat capsized in northern Vietnam's famous Halong Bay, raising the death toll to at least 38. The Department of National Defence Search and Rescue says the trio were crew members. The boat, carrying 48 tourists and five crew members, capsized as Storm Wipha approached the country across the South China Sea. Storm Wipha is the third typhoon to hit the region this year, and is projected to make landfall along Vietnam's northern coast early next week. Authorities say contact tracing is underway for hospital staff who may have been exposed to a man admitted with a rare strain of mpox. The patient was diagnosed with the Clade 1 mpox variant after he presented to Logan Hospital, south of Brisbane following his return from a trip to Africa. Queensland Health Minister Tim Nicholls says the patient was not contagious during his journey to Australia. But he says officials believe a limited number in the community and hospital may have been exposed. "Those close contacts that he has been in contact - including at the emergency ward and in other locations - are being contact traced right now and identified. Right now we think there are 19 community contacts and 40 hospital contacts that have been in contact with the patient." The Ineos-Grenadiers team has been fined after one of its team cars hit a spectator on stage 14 of the Tour de France. The penalty of just under $10,000 against the team's sports director Oliver Cookson has also come with a yellow card, which can result in a suspension if they're accumulated over a defined period of time. TV footage shows the team car knocking down the fan, who was holding what looked like a mobile phone, close to the top of the Col de Peyresourde, as it followed riders on the steep ascent. It's not known what the current condition of the spectator is. Australian welterweight boxer Tim Tszyu has lost his much-hyped rematch to American Sebastian Fundora in Las Vegas. The loss is the 30-year-old's third from his past four bouts, after going unbeaten for his first 24 professional fights. After a tough start against Fundora, Tszyu looked to be getting back into the fight, but stayed on his stool when the bell rang for the eighth round and opted not to continue. Mushroom lunch survivor Ian Wilkinson returns to church after Patterson guilty verdict
Mushroom lunch survivor and pastor Ian Wilkinson has made his return to the Korumburra Baptist Church for the first time since Erin Patterson was convicted of murdering his wife. A Supreme Court jury found Patterson guilty of three counts of murder and one count of attempted murder after serving beef wellington dishes laced with death cap mushrooms at her Leongatha home in July 2023. In his sermon on Sunday, Mr Wilkinson gave everyone a warm welcome, including those visiting from interstate and watching online, and was applauded by the congregation. "Somebody's come all the way from Brisbane to be with us today," Mr Wilkinson said. "And we have some other visitors too. "I should introduce myself… my name is Ian; I used to lead services here. The light-hearted moment was met with laughter from the congregation, before it was straight back to business for Mr Wilkinson, who began the service by reading psalms and announcing upcoming events in Korumburra. Later in the service, a church member delivered a prayer. "We pray especially for the Wilkinson and Patterson families," she said. Mr Wilkinson did not break his silence on the outcome of the Erin Patterson trial. After eating the beef wellington at Erin Patterson's house, Mr Wilkinson spent a number of weeks recovering in hospital. Patterson was found guilty of murdering her parent-in-laws Don and Gail Patterson, Gail's sister Heather Wilkinson, and the attempted murder of her husband Mr Wilkinson by a jury earlier this month. Patterson, 50, had pleaded not guilty to the charges, telling the court the poisonous mushrooms were accidentally included in the meals she served to four relatives in 2023. Patterson, who was expected lodge an appeal of the guilty verdict, will be sentenced at a later date. The trial lasted more than two months, and the jurors heard from more than 50 witnesses.

Fatal crash under investigation after police chase south of Newcastle
A 20-year-old man has died following a police pursuit in Lake Macquarie. Police say officers attempted to stop a motorbike on King Street, Hamilton, about 7:30pm on Saturday after noticing its number plates were "obscured". When the rider failed to stop as directed, a pursuit began. The chase continued through five suburbs, with police alleging the man was speeding. Five minutes later, the male rider came off his bike and crashed into a traffic pole on the Pacific Highway at Charlestown. Officers and paramedics performed CPR, but the man could not be revived. The rider is yet to be formally identified, but police say he was known to them in relation to previous traffic matters. Assistant Commissioner David Waddell described the incident as a "tragic situation". "His family are suffering and are traumatised … as are our police," he said. A critical incident investigation is now underway to review the circumstances of the pursuit, including the actions of both the rider and police. Assistant Commissioner Waddell said the pursuit was monitored by a senior officer and conducted under firm guidelines. "Our safe driving policy puts some really strict protocols around pursuits," he said. "The operation will be investigated and reviewed as part of the investigation." A GoPro camera was recovered at the scene of the crash. It is not yet known whether it was recording at the time of the incident. Police said they would investigate whether the incident involved "post and gloat" behaviour, a trend where riders film and share dangerous behaviour online. Investigators are urging anyone with CCTV or dash cam footage to come forward. The formal investigation is expected to take several months.
