Man caught with ganja gets jail term, but will walk free in Ghaziabad

Time of India3 hours ago
Ghaziabad: On Saturday, Sahibabad resident Nitin got a jail term, but soon he was declared a free man as well — the term of the sentence awarded to the convict was exactly the same as the period already spent in jail.
Accordingly, his release was ordered by a court.
Additional sessions judge Sushil Kumar (4th) sentenced Nitin to one year, 10 months and 11 days in jail with a fine of Rs 10,000 for keeping 1.6 kg of ganja, which had been recovered by police nine years ago.
He was arrested by Sahibabad police on March 15, 2016 near Mohan Nagar. The prosecution informed the court he was arrested on suspicion. "When a police team under sub-inspector Radheshyam Yadav was on its patrol duty, one man coming from Rajiv Colony tried to escape on seeing police, so he was stopped for questioning.
He confessed to carrying ganja and he was informed about his right to be frisked before a magistrate, but he refused and allowed the police team to do so," the prosecution said.

The court took cognisance of the case under Section 18 read with 20 of the NDPS Act on Oct 9, 2023, following which the hearing started and the prosecution completed recording evidence on Feb 18.
In a sudden turn of events, instead of cross-examining prosecution witnesses, defence sought permission for recording the statement of the accused under Section 313 of CrPC.

The accused supported the prosecution narrative and confessed to carrying the said quantity of ganja for his personal consumption. He, however, denied the prosecution theory that he used to sell ganja to the factory workers to earn a living and urged for leniency.
The court decided to award a term of sentence that the convict had already spent in custody. "Though arrested in March 2016, the accused spent one year, 11 months and 10 days in jail to date, so he is being sentenced with the same term under Section 18 read with 20 of the NDPS Act and is directed to deposit a fine of Rs 10,000, failing which he must spend 30 more days in judicial custody," the court said.

HC grants relief to man facing extradition for theft in Thailand

New Delhi: An Indian citizen fearing arrest or extradition for committing an offence abroad can seek anticipatory bail, has said, granting relief to a man facing extradition proceedings for alleged theft in Thailand. Tired of too many ads? go ad free now Justice Sanjeev Narula, in a recent order, said the man remained accessible and demonstrated his willingness to cooperate with the inquiry. He added that the extradition request could be processed within the statutory framework without forfeiting his right to personal liberty. "Since the alleged offence occurred in Thailand, there is hardly any possibility of the petitioner tampering with evidence or intimidating any witness.... It must be noted that pursuant to the directions of this court, he submitted his passport to the custody of the registrar of this court," the court said. The court said he could be subjected to a conditional order under Section 438 instead of a custodial interlude. "Section 438 of the CrPC is not merely a statutory remedy; it is a procedural safeguard flowing directly from the constitutional command that no person shall be deprived of liberty except by just, fair, and reasonable procedure established by law," the court observed. The court was hearing the plea of Shankesh Mutha challenging a trial court's order rejecting his anticipatory bail plea under BNS read with the Extradition Act. The plea said Mutha worked at a firm in Bangkok in 2013 and returned to India after eight years. However, the company filed a complaint against him in 2021, alleging that he stole eight diamonds worth around 15.16 million baht (Rs 3.89 crore) and fled. The Southern Bangkok Criminal Court issued an arrest warrant, and Thai prosecutors commenced extradition efforts. The high court found merit in Mutha's submission of not having knowledge about any criminal proceedings. "The petitioner has joined the inquiry... and there is no allegation of non-compliance or obstruction on his part," the court said.

Conned at first sight! 21 held in wine-&-dine dating scam

Mumbai: A lot can happen on a date. Why, one could even get scammed by the partner. In a dating scam case, 21 people, six of them women, have been arrested. The women would scout for targets on dating apps, call the men to restaurants on a "date", connive with restaurant staff to con the man by generating inflated bills. Tired of too many ads? go ad free now The scam came to light when a man on one such date sensed something amiss at a restaurant in Borivli and called up the police. The man had matched with a 22-year-old woman, Disha, on a dating app on April 11. They exchanged phone numbers and agreed to meet at a restaurant in Eksar locality a day later. When the man reached the venue around 6 pm, Disha was already waiting for him. The two ordered liquor, a hookah pot, and energy drinks. Eventually, a bill of Rs 35,000 was presented to the man. He refused to pay the "excessive" amount when a restaurant staffer started to threaten him, said an officer from MHB Colony police station. The man dialled up police helpline '100' and called the cops to the restaurant. The staff reduced the bill to Rs 30,000, and the woman offered to pay half of it. Later that day, the complainant realised that the UPI payment of Rs 15,000 he had made was to a personal ID, not that of the restaurant. The police tracked down the UPI ID and also scrutinised the woman's phone call records. They traced the woman, and after inquiring with her, busted the racket. A team led by deputy commissioner Anant Bhoite and senior inspector Ganesh Pawar arrested 21 people. The police said that the women had been conniving with restaurant staff who generated inflated bills. The man was threatened into paying up, and the woman later got her cut from the restaurant staffer. The woman, Preeti, called him to a restaurant at Malad where he was forced to pay Rs 32,000. The police said they are are now investigating if the same gang is involved in this case too.
