
Lake County councilman outlines ways to buffer impact of Indiana's property tax changes
Senate Enrolled Act 1 was a property tax bill that will save two-thirds of taxpayers up to $300 on their 2026 property tax bill while local governments will lose $1.4 billion through 2028. Gov. Mike Braun signed the bill into law April 15 and called it a 'historic' plan to reduce property taxes for most Hoosier homeowners while limiting future tax hikes and making the tax system fairer and more transparent.
The county will feel the fiscal impact of Senate Bill 1 in the 2028 budget year, Niemeyer said, as the county is projected to lose $30 million by 2028 and $50 million by 2030. Niemeyer, R-7th, said he reviewed the proposal with local elected officials and Lake County Finance Director Scott Schmal.
Senate Bill 1 will eliminate the property tax replacement credit by Dec. 31, 2027, change the business personal property tax structure, eliminate the current local income tax expenditure rate by Dec. 31, 2027, and adopt annual local income tax rates after Dec. 31, 2030, Niemeyer said.
The Lake County local income tax was adopted in 2013, and the state legislature mandated that the county use 1% of the local income tax for property tax relief, 0.25% for community economic development and 0.25% for public safety. The new property tax law removes the requirements, Niemeyer said.
To achieve a 1% tax cut, Niemeyer said every department and service has to be modernized, every revenue source has to be used to move the county away from relying on property taxes levy and income taxes, and each spending request 'must be justified for the provision of the essential county government services.'
'We have more than enough, even cutting 1% of the LIT after 2027, to fund this government and to move it forward in a productive fashion,' Niemeyer said. 'I suspect that over the next decade we're going to continue to see the system of funding of local government move away from property tax levies and move more toward user fees, income taxes, sales taxes and the like. This is a great start for us to go in that direction.'
When Niemeyer ran for the First Congressional District in 2024, he said he visited all three counties and he could 'count on one hand' the number of people who wanted to talk to him about property taxes.
'The narrative that local government is somehow hoarding cash and ripping off taxpayers is simply false,' Niemeyer said. 'Nonetheless, we are presented with a tax reform package that creates multiple challenges for local government.'
As the council, the county's fiscal body, approaches the 2026 and 2027 budget years, Niemeyer proposed that the council conduct a detailed examination of all revenue sources and statutes to then determine which general fund expenditures could be shifted to non-levy funds.
The council should use 2025 budgets as the baseline for 2026, Niemeyer said, with any raises or office reorganizations offset by fiscal cuts. The council should also look for possible reorganization or staff reduction in all departments as the Oracle system comes online, he said.
To address staffing, Niemeyer said the council should look for instances where contractors and employees are doing the same or similar work. He'd also like the council to review all positions being paid supplemental pay from the general fund and miscellaneous funds, and to move those positions out of the general fund where possible and eliminate supplemental pay.
Further, Niemeyer would like the council to meet the first Tuesday in September for a 'budget building day' in place of the common practice of budget presentations. The only department heads that would have to attend would be those who request an increase in their budget, he said.
As the county addresses the 2028 budget, Niemeyer would like the county to eliminate 1% of its local income tax used to provide the expiring property tax replacement credit. With the remaining 0.5% of the local income tax, the county should allocate those funds for public safety to be distributed to townships for EMS and fire protection, he said.
By the 2028 budget, the county can also consider adopting a local income tax based on county government needs, Niemeyer said.
'This year is an important year to set some new budget fundamentals that will help to guide us through these next three years,' Niemeyer said. 'These are just ideas. Everybody is free to agree, disagree. I did this work as a way just to … get this process moving.'
Council President Christine Cid, D-5th, said she appreciated the hard work Niemeyer put into the outline. The council has asked department heads to stay within their 2025 budget as they prepare their 2026 budget, Cid said.
Cid said she would support eliminating the 1% income tax 'to lessen the burden on our community who would pay these additional taxes, not receive property tax relief, and the increase of the cost of living in today's economic environment.'
'But, in order to eliminate the 1% income tax which currently offers property tax relief, the county would need to continue to collect property taxes,' Cid said.
Councilman Ted Bilski, D-6th, said the council received Niemeyer's proposal ahead of the meeting, so he would review it closely in the coming days. But Bilski said he appreciated the hard work that Niemeyer put into the proposal.
'We're facing tough times. We have to do due diligence. Everything has to be considered,' Bilski said.
The council also voted unanimously to approve an increase in the county's allowance for veteran's grave markers. Before the vote, the board voted to amend the ordinance to include a 2-year deadline, from the time of the veteran's death, to receive the allowance.
The county's current burial allowance for a deceased veteran is $150, which would increase to $225 under the ordinance. The county's current burial allowance for the deceased veteran's spouse is $100, which would increase to $150 under the ordinance.
The ordinance also increases the grave marker allowance for a veteran and the veteran's spouse from $60 to $90.

More young people going into farming, but it's still few of them
At the Porter County Fair on Thursday, Ron Birky, of Morgan Township, said he retired as a farmer after 46 years. 'I was raised on a farm,' he said, but that's not a guarantee he would become a farmer. 'I was one of five kids, and I was the only one to go into farming,' he said. 'I always enjoyed it. That was really the only thing I wanted to do after high school,' Birky said. But becoming a farmer isn't easy. The average age of a Hoosier farmer is 56. Out of 94,282 producers in the U.S. Department of Agriculture's 2022 Census of Agriculture, only 1,962 were under age 25. Compared to the previous survey, conducted in 2017, there were more younger farmers going into the business, noted Todd Davis, chief economist at the Indiana Farm Bureau. 'I can say part of that is that coming out of the experience of 2020, there might be more people wanting to look at having a change,' he said. The COVID-19 pandemic has created long-lasting changes in society. 'I guess you can read into it younger people are seeing opportunities,' Davis said. 'My guess would be a lot of them would be what I call the specialty farmers, smaller scale, maybe taking advantage of farmers markets, selling to local people,' Davis said. That could include operating an on-farm store and more aggressively marketing products to local customers. 'It's a little more niche,' he said. Cody Boone, 17, a member of the Pleasant Pioneers 4-H club, raises cattle. 'I want to do something with farming. I'm not exactly sure what part,' he said. Boone is being raised on a farm, 'a lot of work all the time, especially during birthing season.' 'The farm is more my grandpa's,' he said. Cody's uncle has a farm in LaCrosse, so working for his uncle has possibilities, too. 'I definitely want to do something with them,' he said. Cody's father, Corey Boone, 42, married into farming. His father-in-law had a dairy farm, then raised feeder calves, then goats. 'I kind of got into helping him do all that,' Boone said, although his full-time job is as a collision repair technician, working on auto bodies. With a small hobby farm like his, 'you probably put in more than you get out,' Boone said. Along the way, he has learned a lot about farming. 'One of the first lambs we had, it got out and we chased it for over an hour. We chased that lamb for miles,' he said. Raising goats has been an adventure, too. 'They will climb on everything. They will eat everything,' including flowers in the garden, Boone said. Part of specialty crop production, Davis said, is being an entrepreneur and gauging what the market is. 'Some of those operations also get into a little agritourism,' like an apple orchard, Davis said, with a focus on fall tourism. 'Frankly, I think it was kind of a donut stand. That was the most popular part of the farm experience.' For the traditional corn-and-soybeans farmer, getting into the business has some barriers for a young person. Land is the first need. That means buying or leasing, renegotiating the terms of the lease every few years. 'If you want to grow your business, you have to keep expanding your land base,' Davis said. 'Commodity agriculture is known for having margins that are constantly shrinking,' he said. 'There's always a push for greater efficiency, cost management, using every input in the most efficient way possible.' Trying to support a family? You'd want off-farm income not only for the cash but also for the benefits, especially if you're raising children. Machinery is another big expense. Farmers can find used equipment or lease it, but that will require getting loans. 'Younger farmers may not have much of a credit history, and they may not have a lot of equity to help secure loans,' Davis said. That's where their parents or grandparents come in. They need a previous generation to help them get started. And, of course, they need to know how to farm. 'That's a prerequisite for every career, isn't it?' Where younger farmers might have an advantage over their counterparts nearing the end of their careers, Davis said, is that younger farmers tend to be more interested in pursuing technology and newer, innovative production practices. They're probably more comfortable with electronics, computerization and so forth. Farm Bureau provides scholarships for ag majors, primarily, to help them get started. 'There are college Farm Bureau chapters at Purdue, Huntington and Vincennes,' getting young farmers into Farm Bureau and the networking side of industry. 'They'll make more than just friends,' Davis said. They'll bounce ideas off each other, too. 'That's something that Farm Bureau helps foster in its younger farmers program.' Agriculture gets a lot of attention this time of year, what with county and state fairs allowing youngsters to show off the fruits of their labor. 'The county fair experience is really good for the younger generation,' Davis said, along with Future Farmers of America. 4-H, and living on a farm, helped Annie Martin's kids understand where meat really comes from – not just a grocery store but all the steps along the way, from farm to slaughterhouse, before reaching the grocery. Being in 4-H, 'it's responsibility all the way around. It's time with your family. It's time management,' she said. Martin also married into the farming business when she said, 'I do,' alongside husband Blake Martin. Their kids understand the rigors of farming. 'They have to be accountable at a really young age,' she said. Her son is planning to become a farmer. 'He's been able to drive a loader since he was 6,' Martin said. 'He has a work ethic that's pretty incredible.' He's heading to the state fair after winning the tractor driving competition at the county fair, the proud mom said. 'Farmers never really retire. He slowly learns to operate something new every year,' she said. Her daughter Brooklyn Martin, 11, a Morgan Sodbuster, said she wants to be a zoologist, not a farmer. 'I just like animals a lot, so I thought that would be fun.' Soon after Ron Birky graduated from high school, a distant cousin retired and leased his 165 acres to Birky. 'At one time, we had some hogs,' he said, but corn and soybeans were Birky's two staples. Birky was in 4-H for all 10 years. He's seen his kids go through 4-H, and now his grandchildren are going through it. The oldest grandchild, now entering fifth grade, thinks he wants to be a farmer. 'We still own 600 acres,' Birky said, but the machinery was all sold at auction two years ago. If that grandchild goes through with his current career choice, it won't be easy. 'Boy, it's tough,' Birky said, for a young person to become a farmer. 'There's 600 acres that we own, and that's half the battle.' But it's a fierce battle. 'If you're not raised in a farming family, it's virtually impossible' to go into farming, Birky said. 'The capital investment is unbelievable,' he said, with combines and other machinery exceeding $1 million to buy new. Then there's the risk involved. This year hasn't had much rain. 'I don't need to go to Vegas,' Birky said, because farming is its own gamble. Birky retired at 67, his dad at 80 or so. 'He basically didn't retire, I just took over everything,' Birky said. Young 4-H'ers are considering their options. Norah Grimmer, 13, of Valparaiso, tended Maverick, her grand champion steer, at the fair on Thursday. She's planning to study animal science at the University of Notre Dame to become a veterinarian. Elizabeth White, 16, a member of the Center Wildcats, plans to attend Valparaiso University. 'I'm trying to decide between mechanical and electrical engineering,' she said. After that comes law school. 'We have a small hobby farm,' White said, raising poultry and rabbits along with a few sheep not exhibited at the fair. '4-H has really, really raised my confidence,' she said. 'I know a lot of veterinarians, and they have to deal with a lot of attitudes.' Alexis Leek, 18, of Morgan Township, is a member of the Hustling Hoosiers club. 'I was thinking about working with horses,' she said, in the criminal justice field. That involves riding horses in parades and other events, not putting the handcuffs on felonious equines. 4-H 'definitely helped me with people skills and talking with people I don't know,' she said. Heather Cox, of Morgan Township, aged out of 4-H but was master showman last year, she said while visiting the horses – and people – in the horse barn. She's at Purdue University, where she's thinking of studying animal behavior. Like Leek, Cox said 4-H has polished her people skills. Now she's passing the torch to others. Shiloh Otey, 15, a member of the Hustling Hoosiers, is exhibiting horses, rabbits and poultry, and helping her sister with goats. 'I want to be a veterinarian,' she said. 'I like working with bigger animals.' Leek and Cox said although their career paths don't include farming, they wouldn't rule out raising animals on a small farm when they're older.

ACLU lawsuit over Indiana's college intellectual diversity law is dismissed
A legal challenge to Indiana's law mandating "intellectual diversity" in college classrooms has been dismissed after a judge ruled the fear behind the law's subsequent chilling effect on free expression was unproven. In his July 23 order, Judge Richard L. Young wrote that the legal complaint was premature. The case also lacks standing, he said, because universities have not taken or threatened enforcement actions against faculty members. "The court finds Plaintiffs have adequately shown they have an actual fear of enforcement that has chilled their protected speech," wrote Young, who was appointed by President Bill Clinton. "The issue is whether that fear is well-founded." Last September, the American Civil Liberties Union of Indiana filed a lawsuit on behalf of four Hoosier professors who claim the state law infringes on academic freedom and their First and Fourteenth Amendment rights. In a statement to IndyStar, ACLU of Indiana spokesperson Laura Forbes said the organization is disappointed in the decision and is considering its options. When Senate Bill 202 progressed through the Indiana Statehouse in 2024, professors decried the legislation, claiming the bill would stifle academic freedom and damage higher education outcomes, recruitment and prowess. Academic freedom is defined as the ability for an institution's faculty and staff members to build curriculum, research and pursue knowledge without interference from government officials and administrators, according to several First Amendment organizations. Several U.S. Supreme Court cases have labeled academic freedom as protected under the First Amendment. SB 202 requires the state's public universities, when evaluating a faculty member's tenure, to consider whether they have embraced free expression and "intellectual diversity" in the classroom and if they have expressed political views unrelated to their discipline while teaching. It also directed universities to stand up a process for students to report professors on those grounds. If a university finds that a professor is teaching contrary to the law, the professor may not be granted tenure or be denied a promotion. The bill, introduced by Sen. Spencer Deery, R-Lafayette, was enacted in July 2024. A year in, a total of 14 complaints have been filed at Indiana University, Ball State University, Indiana State University and Ivy Tech University. It's unclear whether any disciplinary action has been taken on them yet. The ACLU's complaint argues that the law was not adequately defined, and the professors have changed the content and pedagogy of their courses in fear of disciplinary action. An ACLU news release said the law could chill course debate over concerns that unfounded theories must be given the same credence as "rigorously studied academic analysis." The lawsuit was the ACLU's second attempt to challenge the law. It first challenged SB 202 in May 2024, but that effort was dismissed after the judge said the plaintiffs lacked jurisdiction to sue. Lakes of the Four Seasons fire department calls for aid for financial situation
The Lakes of the Four Seasons Volunteer Fire Force answered nearly 1,500 calls for help in 2024. Now it's issuing one of its own. With this year's Senate Enrolled Act 1 promising to choke revenue to the West Porter Township Fire Protection District, combined with a decline in volunteerism, fire protection and EMS service straddling the Lake and Porter County line is facing financial peril. The fire department and fire protection district jointly approached the Porter County Council on Tuesday to make its case for assistance. The cuts don't begin until 2027, but the time to cry out is when the knife first appears, not when the slashing begins. Last year, the district began offering EMS service. Fire department attorney Nathan Vis said the department's response time for EMS calls is four to five minutes, which is faster than average. With a third-party provider, it would be seven to 15 minutes, he guessed. 'We're requesting this evening as much support as you can give us,' he told the council. The department has three ambulances, two of which are staffed by full-time employees. 'We need to hire more persons to assure we have a higher response time,' he said. Providing EMS service costs about $240,000 a year, Vis said. 'We've maxed out the revenue opportunities' the department has, he said. Winfield rents space to the department for $1 a year, about a $10,000 value, he said. Until last fall, the department hadn't had a formal contract nor any government dollars from a Porter County agency, he said. The fire protection district is looking at becoming a fire protection territory, something Porter County Council members have discussed as an option for funding EMS service and fire protection throughout the county's unincorporated areas. 'Unfortunately, it's going to have to come from the (township) trustees. It's going to have to be the townships coming together,' said Council Vice President Ronald 'Red' Stone, R-1st. West Porter Township Fire Protection District Chairman Craig Klauer said aging infrastructure, increasing call volume and equipment costs are taking a toll. For now, however, capital expenditures have been put on hold to focus on providing EMS service. Porter County officials are working on providing ambulance service throughout the county. That includes determining how many ambulances might be needed to serve areas not covered by fire departments that currently provide EMS service. One option might be to add an ambulance in the Boone Grove area, Stone said. For Lakes of the Four Seasons, the closest ambulance would be from either Hebron or Wheeler if not for the fire department. 'When you're thumping on someone's chest for three to five minutes, you're saying where the hell is that ambulance. When are they going to be here,' Klauer said. The county currently contracts with Northwest Health to provide EMS service. 'I will never disrespect NW Health ambulance technicians vs. a regular fire department,' Stone said. 'They're great, but they're spread so thin. They're covering mostly northern' Porter County, Klauer said. And while Northwest Health ambulances traditionally transport patients to the hospital at U.S. 6 and Ind. 49, the nearest hospitals for Lakes of the Four Seasons are in Crown Point and Hobart. 'We've got to sit down and go over all this,' said Councilman Greg Simms, D-3rd, who serves on the EMS committee. 'Right now, we're thinking five ambulances throughout the county, but now I'm thinking maybe six.' Complicating the issue is that Lakes of the Four Seasons, which the fire department serves, straddles the county line. The department also serves the town of Winfield and unincorporated Winfield Township, as well as west Porter Township. The department and fire protection district have a spreadsheet that separates the call volume by geography to help guide financial decisions by local government entities that could help support fire protection and EMS service.
