Indonesian gets 34 years' in jail, 14 strokes of rotan for sexually abusing brother's teen stepdaughter
The 25-year-old pleaded guilty before Sessions Court Judge Zaini Fisher @ Fisal, who also ordered him to be whipped 14 times for committing the offence between July 7 and 9 this year at an unnumbered house at an oil palm plantation quarters in Sandakan.
Zaini also handed down an additional four months' jail on the accused for staying in the state without a valid document, and ordered him to be referred to the Immigration Department for deportation to his country of origin after serving the sentences.
According to the facts of the case, the incident came to light on July 9 when the accused's brother noticed that his 14-year-old stepdaughter was experiencing unusually heavy bleeding.
He also found her clothes in the bathroom stained with a significant amount of blood.
When asked, the teenager said that she had been molested and raped by her uncle since July 7, which prompted the stepfather to take her to the Duchess of Kent Hospital for treatment before lodging a police report.
The medical examiner found tear marks in her private parts, and no external body injuries.
The accused was later arrested at the police station at Ulu Dusun, Jalan Labuk in Sandakan at about 12.30pm on July 11.
He was charged under Section 14 of the Sexual Offences Against Children Act 2017 for committing the crime, which carries a jail sentence of not more than 20 years, and liable to whipping.
Zaini handed down eight years jail on him for the offence.
The accused also admitted to raping his niece twice, the first at 11pm on July 8 and again at 3am on July 9 at the same unnumbered house.
For the second and third offences, he was charged under Section 376 (1) of the Penal Code, which carries a jail sentence of up to 20 years plus whipping.
The court handed down a sentence of 13 years jail and seven whippings for each charge.
Deputy Public Prosecutor Muhammad Azizi Hamil conducted the prosecution, while the accused was unrepresented.

Hulu Selangor district police chief Supt Ibrahim Husin said the victim's identity has yet to be determined, and the case is being investigated under Section 302 of the Penal Code for murder. "There were strangulation marks on the victim's neck, believed to have been caused by a rope. The marks are suspected to match the rope (resembling a chain) worn around the victim's neck,' he said in a statement today. The man's body was discovered by a member of the public at around 10.30 am yesterday, with his hands and feet bound, and his head wrapped in cloth and secured with black and white tape. According to Ibrahim, preliminary investigations suggest the body was likely thrown off the Kampung Sungai Serian bridge, which is 11.15 metres high. Checks also revealed that the victim had been dead for more than four days, and no identification documents were found on him. Unemployed man gets death penalty for murder of 3-year-old in Langkawi
KUALA LUMPUR: The Alor Setar High Court has sentenced a 44-year-old unemployed man to death for the murder of a three-year-old girl in Langkawi six years ago. Ramlan Abdul Rashid was found guilty of killing Nur Aisyah Aleya Abdullah at a hospital staff quarters between 9 am and 10 am on Feb 23, 2019, under Section 302 of the Penal Code. Justice Evawani Farisyta Mohammad, in her written judgment published on the judiciary's website on July 31, stated that the victim died from prolonged physical abuse. The court noted the accused showed no remorse and callously disposed of the child's body in a forested area at Gunung Raya without proper burial rites. Forensic evidence confirmed the skull and two teeth found at the scene belonged to the victim. The judge emphasized that the accused, entrusted with the child's care, failed in his duty to protect her. The victim's mother had left her daughter in Ramlan's care while working at a food stall. In January 2019, she moved to a hostel, leaving the child with the accused. A month later, she reported her daughter missing after failing to locate her during a visit. Ramlan initially claimed he handed the girl to another person but refused to disclose details. Police later discovered the remains in March 2019. Deputy public prosecutor Mohd Rizal Fadzil led the prosecution, while the accused was represented by lawyer Ai Cha Ran. - Bernama
