
Anti-MPRP group considering legal response to PSEG court order filing for land access
The Public Service Enterprise Group (PSEG), an energy company based in New Jersey, announced Wednesday its intention to file a court order asking for access to properties on or near the route of the Maryland Piedmont Reliability Project (MPRP).
The MPRP is a proposed 500,000-volt transmission line that could cut through northern Baltimore County, central Carroll County and southern Frederick County, ending at the Doubs substation.
PSEG has a contract with PJM Interconnection, the company that coordinates the movement of electricity in 13 states and Washington, D.C., to build the MPRP to address anticipated power demand on the regional grid.
PJM has predicted a significant increase in power demand partially due to new data centers to be sited in Maryland and Virginia, which could require up to 7,500 megawatts of power.
Additionally, more than 11,000 megawatts of power generation have been recently deactivated, meaning less power is being created as the demand rises.
PSEG said it needs access to the hundreds of properties along the route to conduct environmental studies and field surveys to move the MPRP forward.
In order to obtain a certificate from Maryland authorizing the company to build the MPRP, the state is requiring PSEG to conduct these studies to verify the scope of the project's environmental and socioeconomic impacts.
PSEG plans to file a court order on Tuesday asking for temporary access to about 90 properties to conduct these surveys. This could be the first of many filings if PSEG can't successfully negotiate voluntary rights-of-entry with other property owners.
Jason Kalwa, the project's director, said in an interview that gaining temporary access to properties through a court order would not be the same as PSEG using eminent domain.
Eminent domain is a governmental power to seize private property for public use with just compensation.
PSEG will not have access to the properties anymore after completing the field surveys. A judge would decide how much time to grant the company access.
"The property owners are not giving up any other rights. This is temporary access. This is effectively to allow our experts, environmental and otherwise, to walk on the property, take an assessment of what they see there,' Kalwa said.
"... It's not eminent domain. It gives us no permanent rights to the property. It merely gives us access to the property to conduct surveys, which are necessary for many types of permits out there."
PJM has set a deadline of June 1, 2027, for PSEG to finish the MPRP and start operating it.
'We're going to stand together'
Since the project was announced in June, thousands of residents have joined to form a fierce wave of opposition to the project.
At public meetings, they've yelled at PSEG representatives and expressed frustration and fear of how the MPRP cutting through private properties could destroy businesses or drive people out of their homes.
Stop MPRP, which has members from all three counties the MPRP would be in, was formed for the purpose of stopping the project and advocating on behalf of people who will be affected by the transmission line.
Its website, stopmprp.com, includes resources like how to access the proposed route map and what actions people can take to oppose the project.
It also sells items like shirts, bumper stickers and yard signs so people can show their opposition to the project.
When cars drive on areas where the MPRP would go in Frederick County, several properties may have yard signs stuck at the edge of their properties.
They say "No eminent domain for corporate gain" and "Stop Maryland Piedmont Reliability Project," next to a picture of a power line tower being crossed out.
Stop MPRP also has a Facebook group, which had about 10,300 members as of Wednesday afternoon.
After PSEG announced the MPRP's final path in October, it sent out about 800 letters in the fall to the owners of about 600 tracts of property who will be impacted by the route. Some of the land parcels have multiple owners.
Joanne Frederick, president of Stop MPRP's Board of Directors, sent a statement after the final route announcement that said the organization's members are committed to stopping the project completely, regardless of the proposed route.
Land agents on behalf of PSEG have been reaching out to affected property owners to discuss rights-of-entry to properties.
Some owners have been offered compensation of $1,000 for a temporary right-of-entry. Most people have either not responded or denied PSEG's requests.
When Frederick learned about the news of the requested court order Wednesday morning, she said, she wasn't surprised.
Although Stop MPRP doesn't know yet what specific legal response it may pursue — they need to see PSEG's court order filing first — she said the organization "won't sit idly by" and does plan to respond.
She questioned a court's ability to compel people to give up land rights and said PSEG has acted aggressively, now "threatening to take land owners to court," she said.
"These people are scared," Frederick said. "... We're going to stand together."
Frederick County spokesperson Vivian Laxton said the county's stance on the MPRP is still the same in light of news of the court order filing, such as that PSEG should've had a more transparent public engagement process before moving forward with the project.
In September, County Executive Jessica Fitzwater and the Frederick County Council signed a letter urging the state to reject any certificate application from PSEG for the MPRP.
The letter criticized PSEG and PJM for not providing enough information or prior notice of the project to the public. It also said the MPRP "will directly and negatively impact current homes, businesses and farms ... historical preservation sites, and will diminish the property values of thousands of Frederick County residents.'

ComEd bills jump in June due to heat wave, wholesale electricity cost increase
Many Northern Illinois residents got sticker shock upon opening their ComEd electric bills for the month of June. A record heat wave and a rise in wholesale electricity prices drove up costs. Unfortunately, things could get even worse next year. The watchdog group the Citizens Utility Board says on Tuesday, PJM — a company that controls the electric grid regionally —set a record price of $329 per unit of energy following capacity auction. That figure is vastly higher than the $269 set in 2024. That wholesale energy cost is passed down to utility companies like ComEd. CBS News Chicago has reached out to ComEd, which has not yet announced what the supply price will be next summer. ComEd issued this statement: "ComEd remains committed to keeping energy affordable today and planning for a more reliable future; and we recognize that rising electricity costs are challenging for families across northern Illinois. The latest PJM auction reflects broader market challenges, like increasing demand and fewer available generation resources. While ComEd doesn't profit from these prices, we're acting now to support our customers with bill assistance, including the $10 million Customer Relief Fund as well as our delivery of flexible payment options, and energy efficiency programs, while working with Governor Pritzker, Attorney General Kwame Raoul, and other stakeholders to advocate for reforms to modernize how capacity is priced." ComEd said the results of the PJM auction on Tuesday will be reflected on customer bills beginning in June of next year.

Governors Plan to Rebuke Managers of Largest U.S. Electric Grid
Angry with the rising cost of electricity, a bipartisan group of governors is expected to dress down officials that manage the nation's largest power grid system on Wednesday for failing to rein in costs. A representative for nine Eastern governors is expected to address executives of the grid system, known as PJM, during a meeting at its headquarters in Audubon, N.J., near Philadelphia. The grid stretches across 13 states, serving more than 67 million consumers from Chicago to Virginia Beach. 'As our regional grid confronts intertwined reliability and affordability crises, PJM itself faces an unprecedented crisis of confidence from market participants, consumers and the states,' nine governors wrote last week in a letter to PJM, a nonprofit organization. 'In the past, other regions looked to join PJM due to its many strengths; today, across the region, discussions of leaving PJM are becoming increasingly common.' A 10th governor, Mike DeWine, Republican of Ohio, sent a separate letter to PJM making similar points. In June, The New York Times reported that Democratic and Republican governors were increasingly angry and frustrated with PJM. Many of them have said the nonprofit is not doing enough to check the rising cost of electricity, including by not moving quickly enough to add cheaper sources of energy to its grid. State officials have been communicating with one another about their concerns, including what they say is the nontransparent way in which PJM makes important decisions about the grid. The officials also say the nonprofit, which is run by industry representatives and overseen by a federal regulatory agency, is not sufficiently accountable to state lawmakers or residents. (Bloomberg) -- Businesses and households served by the largest US power grid will spend a record $16.1 billion to ensure electricity supplies — a result that prompted immediate calls from utilities and energy groups to build more generation amid the AI frenzy. That raises the capacity price per megawatt each day to $329.17 from $269.92. The AI boom is driving the biggest surge in electric demand in decades, leading to soaring utility bills and disagreement over which power resources are best equipped to satisfy those needs. While the power industry is coalescing around new plants as a way to alleviate potential shortfalls — and to make money — such efforts would also risk adding to consumer costs at a time when politicians are sensitive about energy inflation. 'It literally tells you we are out of generation,' said Sean Kelly, a former power trader and chief executive officer of power forecasting firm Amperon Holdings Inc. 'It's good for traders, it's good for asset owners, it is not good for consumers.' The shares of independent power producers Constellation Energy Corp., Talen Energy Corp., NRG Energy Inc. and Vistra Corp. gained in late trading in New York on Tuesday. The results of PJM's auction — which secures a year of electricity supplies starting in June 2026 — may add 1.5% to 5% to consumer electricity bills, according to Executive Vice President Stu Bresler. 'Customers are frustrated by high energy costs and I share their frustration,' Calvin Butler, chief executive officer of utilities owner Exelon Corp., said in an emailed statement. The capacity auction has a compounding impact on customers as rising demand, shrinking supply and aging infrastructure add to costs, Butler said. To address the shortage, Exelon has proposed building power plants instead of only buying supply from others in the capacity auction, and then passing those costs directly to ratepayers. Impact of data centers David Lapp, Maryland's People's Counsel, pointed to data centers as the culprit behind another record auction: 'Residential customers will continue to bear unreasonably high prices to support actual and projected power demands from data centers owned by some of the world's biggest corporations.' In a statement Tuesday, Lapp said he expects many Maryland residents to see slight bill increases, though some may see small declines. While PJM didn't specify how much of the projected demand increase was tied to AI, Bresler said in a media briefing Tuesday that 'the majority of the demand increase you saw was large loads and data center additions.' After the auction, PJM's contracted power mix will include 45% natural gas, 21% nuclear, 22% coal, 4% hydro, 3% wind and 1% solar. And although the grid operator has approved about 46 gigawatts of new power supplies for grid connection — mainly renewables and batteries — those haven't been built because of financing, permitting and supply chain delays. The results of the auction come amid a debate over older fossil-fuel plants that had been expected to retire. The Trump administration has already moved to keep plants afloat, contending that they're needed for grid reliability, while also phasing out tax credits for renewables. Yet, with those subsidies expiring at a time of record auction prices, solar and wind developers will likely try to build everything they can in the next two years, according to Kelly. 'We are going to see a lot of renewable generation before the end of 2027,' he said.
