Madras HC presses ECI on AIADMK symbol decision delay
There are multiple civil suits pending in courts regarding the issues.
When the petitions filed by EPS seeking a direction to the ECI for speedy disposal of the representations, which were submitted by expelled AIADMK party men including former MPs P Ravindranath, KC Palanisamy and Surya Moorthy, came up for hearing, the ECI's counsel Niranjan Rajagopalan told the HC that the commission would take a decision 'as expeditiously as possible' and time frame need not be set by the court.
The bench of Justices R Subramanian and K Surender said it could see 'hesitation' on the part of the ECI and asked its counsel whether he wanted the bench to disclose why there is such a 'hesitation'.
Making an oblique reference to the timeline set by the Supreme Court to the President regarding granting of assent to bills passed in State Assemblies in the Tamil Nadu Vs Governor RN Ravi case, the bench said, 'If the President can be set a timeline, why can't the Election Commission?"
It also asked, 'Is the Election Commission above the President? The ECI counsel responded, 'Everyone is equal in the Constitution.'
The two-judge bench directed the counsel to file written instructions by July 21 on the time period by which it can take a decision on the representations and adjourned the hearing.

HYDERABAD: The state govt is likely to file caveats in the Telangana high court and Supreme Court to protect the proposed ordinance extending 42% reservations to BCs in local bodies after taking legal experts' opinion. " While welcoming the state cabinet's decision, various BC association leaders also sought to warn that the entire community will launch an agitation and see the end of the political career of any individual or party if they went to court against 42% reservations to the BCs. He said the only permanent solution was for the central govt to amend the Constitution and include BC reservations enhancement in the IX Schedule. "The central govt has disappointed the BCs as it sat on the BC Bills sent by the govt for almost three months. With no other option, the Congress govt decided to come out with an ordinance. Our appeal to all the political parties is to support the 42% quota to BCs. Anyone opposing the BC quota will be branded as anti-BC," he said.

"What bigger taunt can there be?": Ashok Gehlot hits out at EC after SC's order on Bihar's voter list revision
Jaipur (Rajasthan) [India], July 12 (ANI): Senior Congress leader and former Rajasthan Chief Minister Ashok Gehlot on Saturday criticised the Election Commission's Special Intensive Revision (SIR) of electoral rolls in Bihar, calling it a politically motivated move. Citing the Supreme Court's observation that even the judiciary does not have the authority being exercised by the EC, Gehlot said, 'What bigger taunt can there be?' 'Everyone knows about the way the BJP run the governance with Nitish Kumar on the front... The environment of Bihar is in favour of the INDIA alliance. When I went to Patna, I saw there might be a change,' Gehlot said. He questioned the feasibility of the ECI's SIR exercise just months ahead of elections. 'Election Commission is conducting SIR a month before the elections, while it is impossible to survey two crore people...' he said. 'A Supreme Court judge said this authority is not with me, what bigger taunt can there be?' he added. On ticket distribution for the Bihar elections, he said, 'Everything will happen smoothly...' Gehlot also referred to Congress leader Rahul Gandhi's article that questioned the Election Commission's functioning during the Maharashtra elections. 'The election commissions began the survey a month ago, and they are trying to cut the names of people who have been voting for 10 years. If the intention was to add new names, people might have accepted it, but this is unacceptable,' he said. On Thursday, the Supreme Court allowed the Election Commission to continue with its exercise of conducting a Special Intensive Revision (SIR) of electoral rolls in poll-bound Bihar. A bench of Justices Sudhanshu Dhulia and Joymalya Bagchi did not stay the SIR process but asked the ECI to consider allowing Aadhaar, ration cards, and electoral photo identity cards as admissible documents to prove voter identity during the SIR of electoral rolls being undertaken in Bihar. 'We are of the prima facie opinion that in the interest of justice, the Election Commission will also include documents like Aadhaar, Ration Card, Voter ID card, etc. It is for the ECI to decide whether it wants to accept the documents or not, and if it does not, then provide reasons for its decision, which shall be sufficient to satisfy the petitioners. Meanwhile, petitioners are not pressing for an interim stay,' the bench stated in its order. In its order, the top court noted that the timeline for the process is very short since elections in Bihar are due in November. The apex court posted for hearing on July 28 the pleas challenging ECI's move to conduct SIR of electoral rolls in Bihar and asked the poll panel to file its affidavit within one week. During the hearing, the bench opined that Aadhaar should be included within the list of documents permissible as an ID proof. "Linking Aadhaar to Voter ID different from using it as ID proof," Congress's Manish Tewari responds to Amit Malviya
New Delhi [India], June 12 (ANI): Congress MP Manish Tewari has responded to BJP leader Amit Malviya's criticism of the Congress party's stand on Aadhaar-Voter ID linkage, stating there is a clear difference between linking Aadhaar to Voter ID and using Aadhaar, which contains biometric identifiers, merely as proof of identity. In a post on X, Manish Tewari wrote, 'It does not really require rocket science to figure out that there is a difference between linking the Aadhar ID to the Voter ID and the Aadhar ID that has biometric identifier's being used as proof of identity.' Earlier, BJP leader Amit Malviya hit out at the Congress over what he described as a 'shameless flip-flop' in its stand on Aadhaar and Voter ID linkage. In his post on X, Malviya pointed to Congress' protests in Parliament in 2021 against the Centre's proposal to link Aadhaar with Voter ID, and compared it to the party's current stand. '2021: Modi government proposes voluntary linking of Voter ID with Aadhaar. Congress protests inside Parliament with placards screaming: 'Aadhaar is just for targeted delivery of benefits. It can't be linked with Voter ID!' Malviya's post read. The post added, '2025: Congress now wants Aadhaar to verify Voter ID. Same Aadhaar. Same Voter ID. Just exposed hypocrisy. Anything for votes--even if it means shameless flip-flops!' Malviya's remarks came in response to an ongoing debate over the use of Aadhaar in the Special Intensive Revision of the electoral roll in Bihar.
