
Why are ‘tainted' candidates allowed in fresh process? Cal HC asks SSC

Kolkata: Calcutta High Court on Tuesday questioned the School Service Commission's decision to allow "tainted" candidates to participate in the fresh recruitment process. "Why are tainted candidates being permitted in spite of directions by the
Supreme Court
?" Justice Saugata Bhattacharya asked the counsel representing SSC.
"In your May 30 notification, there is no express bar to debar tainted candidates from applying. I can observe that there are loopholes in the notification. But the court is not interfering since leave is granted," Justice Bhattacharya said.
The SSC sought time to provide clarifications and requested that no formal remarks be recorded at this stage. "Kindly do not record anything. Whatever we did was strictly in adherence with the Supreme Court order," the counsel submitted.

This comes after a petitioner approached the HC contending that the May 30 SSC notification did not prohibit those who were removed from their jobs by the apex court from participating in the fresh recruitment process. The petitioner argued that the omission of a prohibition on such candidates was contrary to the observations and orders of the Supreme Court on the matter.
On Tuesday, the petitioner stated that the omission in the notification may not have been intentional and could be rectified.
The case was adjourned with the court indicating that any clarification regarding the scope of the Supreme Court's directions may be sought before the apex court.

NAGPUR: Saying 'I love you' does not amount to sexual harassment unless accompanied by conduct suggesting sexual intent, Bombay high court's Nagpur bench ruled Monday while overturning a 2017 conviction under the Pocso Act . Justice Urmila JoshiPhalke acquitted a 25-yearold man from Katol in Nagpur district, nearly eight years after he was sentenced to three years' rigorous imprisonment for harassing a 17year-old girl. He appealed the session court verdict in HC and was out on bail. 'If somebody says that he is in love with another person or expresses his feelings that in itself would not amount to an intent showing some sort of sexual intention' the judge said in her order. 'Words expressed as 'I love you' would not by themselves amount to 'sexual intent' as contemplated by the legislature,' she added. The case dated back to Oct 2015, when a class 11 student accused the man of stopping her and her cousin , grabbing her hand and saying: 'I love you'. Based on her complaint, police charged him under sections 354A (sexual harassment) and 354D (stalking) of IPC, along with Section 8 of Pocso Act. Two years later, the sessions court convicted him. His counsel Sonali Khobragade said his actions did not meet the legal threshold for sexual assault or stalking as there was no repeated contact or physical act indicating sexual intent. Justice Joshi-Phalke agreed. 'There should be something more that must suggest the real intention is to introduce the angle of sex…,' she said. 'The offence under Pocso Act is not made out as there is no allegation that the accused touched the girl with sexual intent.' HYDERABAD: Many workers from Bihar and Odisha were among those affected by Monday's explosion at Sigachi Industries in the Pashamylaram Industrial Area. Several of them shared stories of how many from their village came to Hyderabad in search of work. Mohd Zameer Alam, from Bihar's Bhojpur district, recalled how he had helped his uncle Tasabuddin from his village secure a job at Sigachi earlier this year. Tasabuddin is now missing, and Zameer distraught. "About 50-60 people from my village are working here, with about four to five in Sigachi. We worked in three shifts. The first shift included my mother-in-law, Ruksana Kathoon, who was identified as one of the deceased," Zameer said. Just like Zameer, Sahu said many people from his district as well as from neighbouring ones have moved to Hyderabad to find jobs in factories. "There are no such jobs in our district," said Sahu. Telangana HC raps police for settling civil disputes against court orders
HYDERABAD: The Telangana high court on Tuesday pulled up the police for "settling" civil disputes despite court injunctions. It orally directed the DGP to ensure the SOPs on duties of cops are displayed at police stations and uploaded on the website for people's benefit. Justice Tadakamalla Vinod Kumar gave the direction while hearing a petition of Pamu Sudharshanam accusing Nagole police of forcing him to settle a civil dispute through registration of criminal cases. He said the police were asking him to pay 55 lakh to real estate agents for settling a dispute over his plot in Bandlaguda. Rachakonda commissioner G Sudheer Babu appeared via virtual mode and Nagole SHO appeared physically to explain their stand on allegations. The court, which prima facie concluded that the plot owner was detained in Nagole police station to settle the matter, directed cops to produce CCTV footage of the day.
