Harnett County man charged with rape, assault, other crimes

A western Harnett County man is facing multiple charges, including two felony counts each of statutory rape of a child under 15 and indecent liberties.
Tommy Joey Tapia, 26, of the 500 block of Thomas Farm Road between Seminole and Mamers, was indicted April 21 in Harnett County Superior Court.
He was initially arrested May 14, 2024 and held on a $100,000 secured bond. That was modified to an unsecured $100,000 bond on Aug. 28, 2024, and he posted it on Sept. 3, 2024.
However, his bond was revoked on May 5 due to new charges following his arrest on April 10 for violating a protective order, assault on a female and domestic violence, all misdemeanors.
He is now being held on secured bond of $200,000.
Tapia allegedly raped a 14-year-old girl on and after Nov. 22, 2022, according to a court document.
On Dec. 16, 2023, he allegedly hit her on the head with a firearm and then threw her cell phone out the window of a car when she was 15.
On April 13, 2024, he allegedly punched her in the right eye and stole her iPhone 14 Pro Max valued at $1,200.
For those incidents, he is facing felony larceny, felony possession of stolen goods, assault on a female and interfering with emergency communications, the latter two are misdemeanors.
Tapia also faces multiple charges stemming from Jan. 14, 2024, including driving with a revoked license, expired tag, no inspection, no insurance, window tint violation, no seat belt and failure to stop at a red light. He failed to appear in court on Sept. 12 and Oct. 18, 2024.
He was served with a civil suit for failure to pay child support on Feb. 27.
On May 7, 2019, Tapia pleaded guilty to no driver's license and was fined $440, stemming from July 9, 2016. He failed to appear in court one time, and also was found responsible for failure to maintain lane control. He paid the fine.
A charge of simple assault and communicating threats and stemming from 2015 and 2016 were dismissed. No reasons were given in eCourts.

The wife of a celebrity hairstylist will spend the rest of her life in prison for having her lover kill her husband in what was supposed to appear as a home invasion robbery gone wrong. Monica Sementelli, 53, was sentenced to life without parole Monday for the brutal stabbing of her husband, Fabio Sementelli, 49, in their Woodland Hills home eight years ago. A jury in April convicted her of murder and conspiracy to commit murder for masterminding the slaying on their Woodland Hills deck, where one of their daughters would later find him wounded in a pool of blood. Los Angeles County Superior Court Judge Ronald Coen, before pronouncing sentence, rejected a bid by Sementelli's legal team to get her sentenced to 25 years to life in prison. Fabio Sementelli suffered multiple wounds to his face, jawline, neck, chest and thigh and the fact that his $8,000 Rolex watch was left on his wrist when he was killed left detectives puzzled. Blood from the crime scene was soon linked to Robert Baker, a convicted sex offender and former porn star who began an affair with Monica Sementilli after serving as her racquetball coach at a West Hills fitness club. While prosecutors have painted Sementilli as the 'mastermind' behind the slaying, as she stood to gain $1.6 million in life insurance payouts, Baker took the stand during the 2 1/2-month trial and insisted he killed the hair mogul for love. 'I murdered him because I wanted her,' Baker testified during her trial. 'She had nothing to do with it.' Baker was previously convicted of Fabio Sementilli's murder and also sentenced to life without parole. During Sementilli's trial, L.A. County Deputy Dist. Atty. Beth Silverman presented video evidence that showed Monica Sementilli watching a live feed of the area shortly before the attack to ensure Baker had a clear path to her husband. Mitzi Roberts, a veteran homicide detective with the Los Angeles Police Department, also testified that Sementilli and Baker exchanged 95 messages through an encrypted messaging app called Viber on the day of the killing and 180 messages the day before. While Sementilli denied all wrongdoing and publicly grieved her husband — an executive at the hair care company Wella — she was involved in a torrid affair with Baker. The pair sexted during her husband's funeral, according to Silverman, who said the the new widow even sent nudes to Baker during the service in Toronto. Baker's accomplice, Christopher Austin, also testified for the prosecution and insisted Baker told him Sementilli had directed her husband's murder. Austin, a former Oregon probation officer, said he never spoke to Monica directly, but Baker made clear his lover wanted her husband 'gone.' 'Everything he did, he did after he got a text message, which told me he was talking to her via text message.' Austin testified. 'I did not hear him talk to her on the phone ... but everything happened in sequence.' Defense attorney Leonard Levine insisted, 'Adultery is not murder. ... Everything she did was to protect the affair, not to cover up the murder.' He called Baker a ``Svengali,'' saying that Sementilli made the ``biggest mistake of her life'' in becoming involved in an extramarital affair with him.

A Worcester man has been indicted on a murder charge in the 2008 fatal stabbing of a Becker College student, the Worcester County District Attorney's Office announced Wednesday. On Tuesday, a grand jury indicted 40-year-old Marquis Brown in the death of 19-year-old William Smith, the district attorney's office said in a press release. He pleaded not guilty to the charge during his arraignment in Worcester County Superior Court later that day, according to court records. On Sept. 21, 2008, Worcester police responded to 101 Highland St. for reports of a large fight, the district attorney's office said. At the scene, they found a crowd of people and several ongoing skirmishes. As one officer approached the intersection of North Ashland and Dix Streets, he noticed someone carrying a young man who had been stabbed in the chest, the district attorney's office said. The man, who was later identified as Smith, was rushed to a local hospital where he was declared dead. Brown was arrested in Worcester on Tuesday without incident, the district attorney's office said. He was held without bail following his arraignment and is due back in court on July 21. Worcester resident Steven Black, 39, was also indicted in connection with Smith's death on a charge of perjury, the district attorney's office said. He was arraigned in Worcester County Superior Court on June 6 and released on $5,000 cash bail with a GPS monitoring device and conditions of release. Attorney Maura Tansley — Brown's defense lawyer — did not immediately return a request for comment on the case Wednesday night. No further information about the case has been released. Becker College was a private institution with campuses in Worcester and Leicester that closed for good in 2021 due to financial struggles. Its legacy is carried on at Worcester's Clark University, which opened the Becker School of Design & Technology in the wake of the college's closure, allowing for the continuation of some of the school's most renowned programs. Tyler Perry is facing legal backlash to the tune of $260 million from an actor who appeared in his BET drama 'The Oval' and is accusing the media mogul of quid pro quo sexual harassment, sexual battery and retaliation, among other counts. Perry's accuser, actor Derek Dixon, filed his lawsuit against the billionaire film and TV producer in Los Angeles County Superior Court on Friday. The actor claims Perry leveraged his power and standing in entertainment 'to create a coercive, sexually exploitative dynamic with Mr. Dixon — initially promising him career advancement and creative opportunities,' according to court documents reviewed by The Times. Tyler Perry Studios and the And Action production company are listed as co-defendants. A representative for Perry did not immediately respond to The Times' request for comment but his attorney Matthew Boyd dismissed the lawsuit as a 'scam,' according to a statement shared with multiple outlets. 'Tyler will not be shaken down and we are confident these fabricated claims of harassment will fail,' the statement said. In his 46-page complaint, Dixon says he met the 'House of Payne' creator in September 2019 when he was working as event staff for one of Perry's parties. The multi-hyphenate entertainer offered Dixon the chance to audition for his show 'Ruthless' a month after their first meeting. Perry claimed he would 'change [Plaintiff's] life' and offered him a small role in the TV series, 'setting up the first stage in a series of escalating quid pro quo offers,' the lawsuit alleges. From January 2020 to June 2024, Perry 'sustained a pattern of workplace sexual harassment, assault and retaliation,' the lawsuit alleges. Dixon appeared in 85 episodes of Perry's presidential drama 'The Oval' from 2021 to 2025, according to IMDb. Dixon accused Perry of relentlessly probing him about his sex life, making suggestive comments and expressing jealousy about his interactions with other men during the duration of their work together. The complaint features multiple screenshots of alleged conversations between Dixon and the media mogul, including messages in which the director asks 'What's it going to take for you to have guiltless sex?' and likens the actor to a rose but says he is 'so blocked that you refuse to be smelt [sic] or opened.' The lawsuit — which evokes cases against Harvey Weinstein, Bill Cosby, Kevin Spacey and other high-profile Hollywood figures accused of sexual harassment — also details multiple occasions where Perry allegedly groped the actor. The first was in January 2020 when Dixon stayed the night in a guest room at Perry's home in Georgia and allegedly felt Perry 'slip into bed behind him and start rubbing Dixon's body around his inner thigh in a highly sexual and suggestive manner.' Dixon also accuses Perry of 'violently' grabbing his throat in March 2020, groping his buttocks in a trailer later that year, and pulling down his underwear and groping his buttocks again in June 2021. The complaint underscores that Dixon repeatedly refused Perry's advances and walked a fine line, keeping his interactions with Perry professional but friendly enough to remain in his good graces. He claims the threat of Perry killing off his character constantly loomed over his 'Oval' tenure. In addition to casting Dixon in his series, Perry also expressed interest in helping the actor develop a show, the lawsuit says. Dixon distanced himself from Perry after the alleged June 2021 assault, the lawsuit says, but the producer's 'fixers' reached out with a new storyline for his 'Oval' character and a pay raise. They also allegedly told Dixon he could not tell his castmates about the new perks. Perry allegedly continued to ask Dixon about his sex life through the years that followed and in March 2024 plans to pitch Dixon's show began to fall apart. After Perry offered Dixon a writing spot on one of his series in June 2024, Dixon 'woke up and realized Perry was never going to be serious about helping Dixon' grow his career, the lawsuit says. Dixon claims he reported the alleged sexual harassment to the Equal Employment Opportunity Commission but the complaint was not investigated. Dixon left 'The Oval' and Perry allegedly retaliated by telling Dixon he could say only that he was taking medical leave. 'Defendant made the leave of absence unpaid and therefore terminated Plaintiff's employment causing Dixon additional loss of income and insult,' the suit says. The lawsuit also includes allegations of work environment harassment, workplace gender violence, sexual assault, negligent retention and intentional infliction of emotional distress.
