SC rebukes cartoonist booked over caricature of PM, RSS

India Gazette3 days ago
New Delhi [India], July 14 (ANI): The Supreme Court on Monday rebuked Indore-based cartoonist Hemant Malviya for his objectionable caricatures of Prime Minister Narendra Modi and the Rashtriya Swayamsevak Sangh (RSS) while terming his conduct 'inflammatory' and 'immature.'
A bench of Justices Sudhanshu Dhulia and Aravind Kumar expressed disapproval of the cartoonist's conduct saying, 'The comedians, cartoonists etc. look at their conduct...'
Advocate Vrinda Grover, appearing for Malviya, said the cartoonist will delete the post and make a statement that he was not endorsing the objectionable comments.
She admitted that the cartoonist's comments and the caricature might be 'unpalatable or in poor taste', but it was still not an offence.
The advocate prayed for interim protection to Malviya, saying that the police were knocking at his door.
When the bench asked about the age of cartoonist, Grover said he was aged over 50 years. To this Justice Dhulia said, 'Still no maturity. We agree that it is inflammatory.'
The bench then posted the matter for hearing on Tuesday. The apex court was hearing an anticipatory bail of Malviya for his objectionable caricatures of PM and RSS.
The Madhya Pradesh High Court on July 3 had rejected his anticipatory bail plea.
The High Court had said that Malviya had misused the freedom of speech and ought to have used his discretion while drawing the caricature in question.
His plea has clarified that he had published the original cartoon during the peak of the COVID-19 pandemic when social media was rife with misinformation and fear related to the safety and efficacy of the vaccines.
The petitioner said his cartoon is a satirical caricature work which offers social commentary on the comments made by a public figure regarding some vaccines being effective and 'safe like water', even though their efficacy remains untested through rigorous clinical trials.
He further claimed that the caricature, was the artist's imagination of a common man being vaccinated by a public representative and has been in public circulation on social media for over four years.
It said that a social media user on May 1, 2025 had posted the cartoon with his comment stating 'through implication that caste census is merely a tool to distract the public from issues like Waqf and Pahalgam'.
The petitioner claimed that Malviya shared that post to demonstrate that his cartoons are freely available for public use and expression but he did not endorse the views expressed in the added commentary but acknowledged the use of his cartoon. (ANI)

Delhi to receive Rs 600 cr Central funds under special assistance scheme

Delhi will receive Rs 600 crore from the Central government under a special assistance scheme for Union Territories, said an official statement on Thursday. Delhi Chief Minister Rekha Gupta said the funds will be used to accelerate development projects across the city, including initiatives for traffic management, drainage, green energy and waste management. Gupta met Union Finance Minister Nirmala Sitharaman and briefed about the progress of various ongoing schemes and future requirements, and highlighted how effective transformations are taking place in the capital with the support of the Central government, the statement said. Sitharaman shared details about the Special Assistance to States/UTs for Capital Investment (SASCI) scheme, under which the Delhi government will receive Rs 600 crore in special financial assistance by the end of this month, it quoted Gupta as saying. The chief minister mentioned that a proposal for this allocation will soon be sent to the Ministry of Finance. Gupta said the Union Finance Minister assured full and continued support from the Centre towards the development of Delhi. "Delhi is not just the capital of the country, but also the cultural, administrative and economic hub of India. Its planned development and good governance should serve as a model for all," she said, adding that the government is consistently working in this direction so that Delhi residents receive all the facilities they rightfully deserve. Expressing gratitude to the Union Finance Minister for her positive outlook and cooperative approach, Gupta said the people of Delhi are witnessing the direct benefits of the collaborative efforts between the Central and state governments. She assured that the SASCI scheme will be implemented effectively and that every effort will be made to transform Delhi into a world-class capital city. Senior officials from both the Finance Ministry and the Delhi government were present during the meeting. The chief minister also emphasised that this meeting was not only crucial for accelerating the development of Delhi but also a prime example of cooperative federalism in action. The SASCI scheme was launched in 2020-21 in response to the economic revival required after the Covid-19 pandemic. It aims to provide interest-free loans for 50 years to states and Union Territories to support capital expenditure. The scheme promotes infrastructure development, employment generation and sustainable growth, and enables states to become active partners in the nation's overall development by equipping them with financial resources, reforms and capital capabilities.

POSH Act application to be extended to TV serial sector soon: WCD Director

After the film industry, the government plans to take forward efforts to prevent harassment of women in the workplace to the TV serial sector too. Inaugurating a two-day workshop on 'Strengthening institutional mechanisms combating violence against women and girls' organised by the Kochi-based Centre for Public Policy and Research (CPPR) in association with the U.S. Consulate General, Chennai, in the State capital on Thursday, Women and Child Development (WCD) Director Haritha V. Kumar said initiatives had been taken to understand how provisions of the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) [POSH] Act, 2013, were applicable to the film sector. As part of this, first round of trainings had been held for all stakeholders. After the TV serial sector, the government would focus on applicability of POSH Act in the gig sector. It would explore how gig workers could raise a complaint of sexual harassment and they could be empowered to raise it. The WCD Director said though internal committees (IC) had been set up in many places, the State had not been able to universalise them. ICs had been set up in government departments and offices. Now, trainings were being conducted for IC members in Technopark, Cyberpark, and SmartCity. She said the government was planning outcome assessments to understand how allocations for gender concerns in the Budget were translating into results. She called for deliberations on how to fast-track proceedings in domestic violence and Protection of Children from Sexual Offences (POCSO) cases to ensure justice and privacy for the survivors. S. Ajeetha Begum, Deputy Inspector General of Police, Thiruvananthapuram range, in her address, said the issue of patriarchy as well as socio-cultural norms had to be addressed to combat the violence. Despite strong laws, conviction rates remained low. For instance, in POCSO cases the conviction rate was around 16%. Again, there was only one woman protection officer for the entire district of Thiruvananthapuram. This highlighted the need to strengthen institutional mechanisms to protect women and children. Focus also had to be on rehabilitation and reintegration of survivors into society, the DIG said. Gita Gopal, special adviser on gender at the CPPR, said despite the large number of crimes that were registered in the State, more than 30% of the cases were pending in fast-track courts, in contrast to 60% in Bihar. It also had to be examined if the laws were survivor-centric. She called for measuring outcomes of institutions and laws to bring about policy changes and stressed the need to follow-up on survivors of violence. Anjali Prasad Guntur, director of programmes, Raksha Inc, Georgia, U.S. spoke about best practices in the U.S. on combating violence against women and girls. K.C. Rosakutty, chairperson, Kerala State Women's Development Corporation Ltd.; S.N. Raghuchandran Nair, president of the Trivandrum Chamber of Commerce and Industry; and D. Dhanuraj, chairperson of the CPPR, spoke. A message by Jeanne M. Briganti, Public Affairs Officer, U.S. Consulate General, Chennai, was screened on the occasion. The workshop will conclude on Friday.
