Bethuel Ngobeni, 'kingpin' in illegal gold mining case, still on the run
The National Prosecuting Authority has amended the indictment against eight people accused of being part of an illegal mining enterprise after the alleged kingpin Bethuel Ngobeni failed to appear in court for the second time. Ngobeni, a Zimbabwean whose real name is believed to be Zingai Dhliwayo, has been on the run since December after the Pretoria high court revoked his bail. In February he failed to appear in court and judge Portia Phahlane authorised a warrant of arrest. The new indictment, handed to his co-accused on Monday, omits his name. The accused — Lerato Bathebeng, Dumisani Moyo, Neo Duba, Poppy Mathongwane, Nhlanhla Magwaca, Moseki Sechele, Thabo Sechele and Khudzai Mashaya — face several charges including trading in illicit gold, money laundering, fraud, racketeering and violating the Immigration Act. Bathebeng was Ngobeni's girlfriend. It is believed the accused ran a multimillion rand enterprise in which they bought stolen gold-bearing materials, processed and sold them. Ngobeni is the central figure in the enterprise that operated in Carletonville and Khutsong between 2018 and 2022. The indictment alleged Ngobeni was the mastermind (kingpin) of the enterprise and the first point of contact for all transactions. 'The undercover agents proposed to sell the stolen unwrought gold-bearing material to the members of the enterprise. An undercover agent would contact Ngobeni and inform him he is in possession of the gold,' the indictment reads. Ngobeni would then direct the undercover agents to contact Magwaca, Moyo and Mashaya as well as Charles Mapuya or Elijah Chikati. Mapuya and Chikita evaded arrest in 2022 and are believed to have fled to Zimbabwe. Sowetan reported in August last year about how Ngobeni had stolen the identity of a man from Mpumalanga. The state alleges Ngobeni spent the proceeds of illegal mining on cars and homes, all of which have been placed under preservation until the completion of his trial. According to the state, Ngobeni spent R4.2m on six cars and two houses during a seven-month shopping spree. The new 55-page indictment contains a list of 44 witnesses, including the South African diamond and precious metals regulator, the Hawks and car dealership representatives. The judge ordered that Mashaya be transferred from Potchefstroom to the Kgosi Mampuru prison in Pretoria. The matter was postponed to Wednesday.

Life sentence for security guard who raped minor at residential complex
A man who raped a child on the first day of work at a residential complex in Florida, Roodepoort, has been handed a life sentence. Mpho Antonio Lebona, 26, was arrested on the day of the rape of the 14-year-old girl in January 2021 because residents in the complex reacted quickly to the victim's report of the attack, said National Prosecuting Authority spokesperson Phindi Mjonondwane. It was Lebona's first day of employment as a security officer at the complex. "He had been tasked with overseeing access to the complex's communal washing area. The victim, who resided at the complex, approached Lebona to unlock the washing area. The victim's parents were at work during the commission of the offence. The accused locked the door behind them and raped the victim, and inflicted a bite wound on her neck." Roodepoort regional court prosecutor Claude Payne presented victim impact statements from the girl and her mother which highlighted the trauma, particularly the loss of the victim's virginity. Citing the nature of the crime against a child, magistrate Thelma Simpson said life imprisonment was the only befitting sentence, reflecting the court's commitment to justice for such heinous acts. Limpopo pig farmer's trial postponed as accused turns witness
The High Court in Polokwane postponed the trial of three men to Thursday. The state accuses them of murdering two women and dumping their bodies in a pigsty on a Limpopo farm. Limpopo pig farmer Zachariah Olivier, farm supervisor Rudolph de Wet, and Zimbabwean national William Musora face charges of murder, attempted murder, defeating the ends of justice, illegal possession of a firearm, and unlawful possession of ammunition. Musora faces an additional charge under the Immigration Act. The state alleges the men shot and killed Maria Makgato and Lucia Ndlovu in August last year at Onverwacht farm, outside Polokwane. A third woman reportedly escaped. The victims had allegedly gone to the farm to collect expired food for the pigs. According to the prosecution, the accused dumped the women's bodies in a pigsty, where the pigs consumed them. During brief court proceedings on Monday, 20-year-old De Wet, a supervisor on the farm, turned state witness under Section 204. His lawyer, Muhammed Farouk Valjee, told the court that De Wet will testify that Olivier fatally shot the women and forced him, under duress, to dispose of their bodies. The state is expected to withdraw charges against De Wet once he gives his testimony. Olivier and Musora, aged 60 and 50 respectively, remain in custody and have yet to enter their pleas.
