Madras HC: Remand orders against BJP lawyers' wing secy illegal
CHENNAI: The Madras High Court has held illegal the remand orders issued by the respective judicial magistrates in Coimbatore and Thirukazhukundram against advocate D Alexis Sudhakar, the state secretary of BJP's lawyers wing. Justice GK Ilanthiraiyan passed the orders recently on the criminal revision petitions filed by Sudhakar who was arrested on the charges of possession of weapons and cheating. Senior counsel Abudu Kumar Rajaratnam, appearing for Sudhakar, submitted that he was falsely implicated in a series of criminal cases by the police out of political vendetta and was arrested last year. The remand orders issued by the judicial magistrates were arbitrary and in violation of Article 22 (1) of the Constitution which guarantees the right to be informed of the grounds of arrest and the right to consult and be defended by a lawyer of one's choice. He also submitted that mandatory statutory safeguards including service of ground and reasons of arrest and intimation to family members were disregarded by the police officers while arresting Sudhakar. Justice Ilanthiraiyan held that a perusal of the arrest memo reveals the ground arrest and reasons for arrest were not stated. That apart, there is no record to show the petitioner's family was informed of the arrest. The non-compliance of the mandatory provisions is a clear violation, the judge said in the order. He held the remand itself is illegal when the petitioner was not informed of the reasons and the grounds for the arrest.

Non-bailable warrants issue: 73K cases pending, Madras HC appoints nodal officer
CHENNAI: Expressing concern over thousands of cases pending in courts for decades across the state due to issues in executing non-bailable warrants (NBWs), the Madras High Court has directed subordinate courts and the Director General of Police (DGP) to strictly follow the orders and guidelines of the Supreme Court in this regard. Citing the report filed by the Registrar General, the judge said 73,699 cases are pending at the stage of execution of NBWs from 1985 to June 2025 across the courts in Tamil Nadu. Commenting that pendency of warrants from 1985 'reflects a breakdown of the system', Justice P Velmurugan appointed R Mahesh Babu, a retired chief administrative officer of district judiciary, as the nodal officer to review the situation in subordinate courts and submit reports. File action taken report in 3 months: Judge to DGP The judge, in the order passed on Friday while disposing of a batch of petitions seeking directions to the police to execute NBWs against accused persons and subordinate courts to take charge sheets on file, also told the DGP to file an action taken report in three months.

Caste killing: Accused Surjith's judicial custody extended
Tirunelveli: The judicial custody of Surjith, the accused in the alleged caste killing of 27-year-old Kavin Kumar, was extended by 14 days on Saturday by the Tirunelveli court. After his arrest on July 27, Surjith was remanded in judicial custody until Aug 2. On Saturday, CB-CID officials produced him before the court for an extension of custody. It is to be recalled that Surjith, son of sub-inspectors Saravanan and Krishnakumari from Palayamkottai's KTC Nagar, was arrested for allegedly hacking Kavin Kumar to death with a sickle on July 27. The victim, an IT professional from Arumugamangalam near Eral in Tuticorin district, was in a relationship with Surjith's sister Subashini since their school days. On the day of the incident, Kavin came to a hospital in Palayamkottai to attend to his ailing grandfather where Subashini was working. Surjith allegedly confronted him outside the hospital, took him aside, and attacked him fatally before fleeing the scene. Kavin died on the spot due to multiple injuries. Following his arrest, Surjith was remanded in judicial custody and later detained under the Goondas Act on July 30. His father Saravanan was also arrested later.
