CCP fines fertilizer firms, FMPAC Rs375mn for price fixing

The Competition Commission of Pakistan (CCP) has imposed penalties to the tune of Rs375 million on companies and an industry association for collusion in the fertilizer sector.
According to a press statement released on Tuesday, the CCP took decisive action against anti-competitive conduct in the fertilizer sector, imposing a penalty of Rs50 million each on six major urea manufacturers.
Moreover, the Fertilizer Manufacturers of Pakistan Advisory Council (FMPAC), a leading industry association, was fined Rs75 million.
The CCP bench—comprising Dr Kabir Ahmed Sidhu and Salam Amin—concluded that six urea manufacturing companies, i.e. Fatima Fertilizer Limited, Fauji Fertilizer Company Limited, Fauji Fertilizer Bin Qasim Limited, Fatima Fertilizer Company Limited, Engro Fertilizer Company Limited and Agritech Limited in coordination with their trade association, FMPAC, 'under the guise of conducting an awareness campaign/advertisement, have effectively fixed the price of urea across the country'.

'Such conduct goes beyond the bounds of lawful information dissemination and enters into the realm of anti-competitive behaviour' in violation of Section 4 of the Competition Act, 2010.
CCP said that despite claiming price independence, the manufacturers failed to justify their synchronised pricing strategy.
'The commission's investigation uncovered that the conduct not only distorted competition, but also harmed farmers across Pakistan, especially during the critical Rabi and Kharif season, by artificially influencing fertilizer prices and limiting market choice,' said CCP.
The government body shared that the respondents' attempt to claim protection under the 'state action doctrine' was also rejected, asserting that no formal government directive or compulsion existed to justify their collusive behaviour.
CCP noted that the respondents took advantage of a federal government directive regarding initiating an awareness campaign encouraging farmers regarding urea price and used it as a tool to fix the price in coordination among themselves and jointly announced the uniform price for the urea buyers/consumers.
The bench also held that such 'actions, under the pretext of complying with government instructions, effectively undermined market forces and distorted competitive pricing mechanisms.'
CCP shared 'with great concern' that despite significant variations in input costs, different economies of scale, size of the market, and different prices of gas, all respondents were charging an identical price for the size of the urea bag, i.e. Rs1,768 per bag.
The bench also noted that 'in a market where each undertaking's production capacity and market share are matters of common knowledge, such a coordinated disclosure cannot be viewed as incidental or competitively benign. Rather, the joint announcement constitutes an overt manifestation of concerted conduct.'
Moreover, repeated directions from the Fertilizer Review Committee (FRC) were given to the respondents to address their failure to manage supply imbalances.
CCP informed that it had issued warnings to the fertilizer manufacturers and FMPAC in 2010, 2012 and 2014, 'which failed to produce any lasting change'.

The development came as Minister for Railways Hanif Abbasi addressed the "Meet the Press" event at the Lahore Press Club. Speaking on the occasion, the minister announced "sweeping reforms" to modernise the sector, highlighting improvements such as outsourcing cleaning services at seven stations across Rawalpindi, Karachi, and Lahore, enhancing food quality, and installing free Wi-Fi at Lahore Railway Station. He highlighted key infrastructure upgrades, including a soon-to-be-finalised agreement for the Rohri–Karachi railway section and a Rs50 billion allocation by Punjab Chief Minister Maryam Nawaz to upgrade the Lahore-Rawalpindi track, reducing travel time to two hours. Escalators and information desks have been introduced at stations, and a 105-kilometer railway track for coal transport is set to be completed by April 30, reducing electricity costs from Rs15 to Rs4.5 per unit. Additionally, a business train with Wi-Fi-equipped coaches and high-quality dining will be inaugurated on July 29 by PM Shehbaz Sharif. The minister announced plans to digitise the railway system, link sixteen banks to the railways app, and install ATMs at 348 stations. To address inefficiencies, three railway companies have been shut down, and long-leave employees would be recalled. "Pakistan Railways is the pride of Pakistan," Abbasi declared, promising to make it profitable if the federal government covers pensions and salaries. He stressed that the railways issues stem not from labourers but from unnamed individuals who looted the system. He emphasised the need for investment in railways to boost the national economy, warning that major reforms are imminent and bureaucratic inefficiencies will not be tolerated. Addressing employment concerns, Abbasi revealed a compassionate approach to contract workers. "We could dismiss contract employees with a one-month salary, but instead, we are considering reassigning railway sanitation staff to their local areas," he shared, signaling a commitment to employee welfare. The "Suthra Punjab" initiative will be extended to Railway colonies, aiming to enhance living conditions for staff and their families. Abbasi also claimed unprecedented improvements in cleanliness across the railway system, stating, "The level of cleanliness we have now achieved in Railways has never been seen before." Cracking down on illegal activities, Abbasi issued a stern warning against ticketless travel and related offenses. "Smuggling and theft used to plague Railways. Now, anyone traveling without a ticket or aiding such activities will face imprisonment," he cautioned. To bolster security, Pakistan Railways has recruited 500 new personnel for the Railway Police and plans to acquire scanners and metal detectors using the department's own budget.

ISLAMABAD: The government is likely to direct the Competition Commission of Pakistan (CCP) to take action against vanaspati manufactures on suspension of collusive behaviour as the industry has not passed on the reduction in prices of commodity to the consumers, sources in Commerce Ministry told Business Recorder. On March 13, 2025, during discussion on presentation on status of availability and price fluctuation of vegetable ghee/ cooking oil, the Economic Coordination Committee (ECC) of the Cabinet directed that the Ministry of Industries and Production to present the status of availability and prices variation of the commodity in the next meeting of the ECC, given the rising price trend of vegetable oil. In this regard, the MoI&P held two meetings with Pakistan Vanaspati Manufacturers Association (PVMA) in April and May 2025 for deliberations. 'Anti-competitive practices'; CAT upholds Rs50mn fine on Vanaspati Manufacturers Association The data available with Pakistan Bureau of Statistics (PBS), Federal Board of Revenue (FBR) and Ministry of National Food Security and Research was also consulted. According to sources, it was observed that since early December, 2024, there had been a 24% decline in the international price of palm oil, whereas the price of cooking oil in the local market is still higher by 4.5% compared to the peak in international prices. An overview of Pakistan's Ghee sector suggested that import and marketing of edible oil and ghee is not regulated. PVMA is a registered association with 148 members and 450 licenced brands of ghee and oil. Market share of imported oil and oil seeds is 89% (3.842 Million MT) while locally produced-oil seeds have a share of 11% i.e., (0.474 Million MT) only. Total requirement of edible oil in Pakistan is around 4.2 to 4.3 million MT. Pakistan is the third largest importer of oil and oil seeds in the world and imported around 88% of palm oil/olein from Indonesia and around 11%imports from Malaysia. Furthermore, soft oils i.e., Soybean, Sunflower, Canola are imported from Argentina, Brazil, United States, Ukraine etc. PVMA maintained that current stocks of around 375,000 MT of palm oil and olein are available at ports, which are sufficient for one month. Furthermore, ships are arriving on regular basis. Regarding price, the PVMA revealed that it was a wrong perception that local edible oil or ghee market is closed and monopolistic as more than 148 manufacturers are registered with PVMA. Consequently, due to intense competition, it is not possible for a seller to sell at a higher price. The prices will further fall when the cheaper Palm oil/olein reaches ports within around two and half months. Moreover, due to new trade policy introduced by US, there is a recession in palm oil and olein market. The sources said that ample stocks are available in the country. However, the impact of international prices is generally transferred to local market after two months when the imported raw materials reach Pakistan. The impact of decreasing international prices in the month of December, 2024, was not transferred to general public despite lapse of more than two months. 'The Competition Commission of Pakistan should take necessary action to ensure no cartelisation in oil and ghee sector and provincial governments should vigilantly monitor the prices of different tier brands,' the sources continued. ISLAMABAD: The Market Intelligence Unit (MIU) of the Competition Commission of Pakistan (CCP) has achieved a remarkable 92% efficiency rate in processing and referring leads related to anti-competitive practices during the fiscal year 2024-25. This milestone underscores MIU's growing role in supporting CCP's enforcement efforts and ensuring fair competition in Pakistan's evolving market landscape. Over the past year, the MIU identified more than 170 potential cases of anti-competitive behaviour across a range of sectors. These leads were referred to the relevant departments for further action, with the following outcomes: 1; The Cartels and Trade Abuses (C&TA) Department selected five leads for formal inquiries under Section 37 (1) of the Competition Act, 2010. 2; The Office of Fair Trade (OFT) initiated 28 inquiries based on MIU referrals. 3; All five merger-related leads flagged involved consummated mergers, prompting in-depth scrutiny and potential enforcement actions. 4; Adopting AI for Market Surveillance 5; The MIU's success is fuelled by the strategic use of artificial intelligence (AI) and advanced digital tools for market monitoring. These include: 6; Web scraping techniques to systematically collect data from digital platforms. 7; Utilization of Google Cloud Vision AI and Microsoft Azure AI to extract and analyze market intelligence from visual and textual data. These capabilities have enhanced MIU's ability to proactively detect collusion, deceptive marketing, and abuse of dominance. The MIU continues to be a key pillar in CCP's enforcement structure by providing actionable intelligence that leads to investigations and shapes policy direction.
