The State has provisionally withdrawn charges against Gugulethu siblings who were accused of fraud and money laundering following the murder of actor David 'Gums' Manuel.
Wanda and his sister Sindiswa Mbele briefly appeared in the Athlone Magistrate's Court on Wednesday morning, months after being arrested in connection with the case.
The charges were withdrawn pending further investigation.
Manuel, best known for his role in 'Noem My Skollie', was shot and killed alongside his best friend Alfonso Fisher at his Gugulethu home on October 8, 2024.

The Mbele siblings, who live across the road from the victim's house, were initially linked to the double murder.
However, they were only charged with fraud and money laundering after allegedly altering a funeral policy taken out on Manuel shortly before his death.
During Wednesday's proceedings, the State prosecutor informed the court: 'The investigating officer has not addressed some of the queries that I had. The matter is therefore provisionally withdrawn until the investigation is concluded.'
The decision sparked visible relief for the accused and their loved ones.
Outside court, Sindiswa's partner said: 'What a relief. We had been waiting for a long time for this day to come. We expected the matter to be withdrawn, but the State has been investigating.'
At the time of the withdrawal, both Wanda and Sindiswa were out on R800 bail.
According to the State, the pair took out life insurance policies on three individuals unrelated to them.
'They are charged with fraud and money laundering in terms of the Prevention of Organised Crime Act 121 of 1998 (POCA). It is alleged that the accused took out a life policy for three people, who are in no way related to them. On October 8, one of the insured (persons) was fired at, in the process, two people were killed,' the State prosecutor said during their first appearance.
Following Manuel's death, Wanda allegedly claimed R60 000, while Sindiswa received R50 000 from the policies.
The siblings are also accused of using R15 000 of that money to purchase furniture at a Bradlows store.
The State had previously presented WhatsApp messages as part of its case, including one in which Wanda allegedly wrote to his sister: 'They are going to die, Sindi,' in a conversation related to the funeral policies.
Despite these submissions, Magistrate Keith Le Keur ruled during their bail hearing that the State had not provided sufficient evidence to justify detaining the accused.
'There wasn't enough evidence presented by the State to keep the siblings behind bars,' Le Keur said.
He added that there was no indication the pair would interfere with witnesses or evade court proceedings.

It also alleges that the accused attempted to kill Nkosikhona Madlala and Sandile Colin Sambo by hitting them with golf sticks, baseball bats, putting wooden pallets on their bodies, and pouring fuel on them with the intent to burn them to death. The State alleges that Gopal had addressed his co-accused and some community members to attack black Africans outside his tavern. A State witness, Anard Chetty, who said he used to reside at Gopal's tavern after he lost his job during Covid-19, told the court that on July 12, 2021, when the victims were attacked, Tyreece hit Dlamini with a rock on his head. He stated that Dlamini arrived at the tavern in a taxi bearing the Africa Touch logo, accompanied by others. Chetty testified that Gopal used to sell alcohol illegally, as it was banned during that time because of Covid-19 lockdown restrictions. He said a female and two males had alighted from the taxi to go to the tavern, and within minutes, they came back running. At that time, a lot of vehicles came, with one being driven by Gopal's brother, blocking the taxi. He said the taxi occupants, including Dlamini, who were left inside, were told to come out and lie down on the floor. He said there was resistance from the taxi occupants and stated that the people who had come in vehicles had sticks and they assaulted the victims. He said they ran in different directions. 'A female and one male ran to the container behind the tavern and came out the next day around 6.00 in the morning,' Chetty said. He said that when Dlamini jumped out of the taxi, he was tripped by Gopal's brother, and he fell. 'More people came to assault him,' he added. Additionally, Chetty, who would constantly get emotional and cry, said that as Dlamini was being assaulted, Tyreece picked up a rock and hit him with it. 'After the third accused (Tyreece) picked up the big rock, Accused Four (Timothy) took the hammer and beat him with it. Those are the two fatal blows that ended that guy. He couldn't move,' he said, crying. Additionally, Chetty told the court that Dlamini was his friend. He said Tyreece is the son of Timothy. During his testimony, Judge Mluleki Chili kept on reminding him to slow down as they took notes. At some stages, when Chetty got emotional, he would tell him to drink water and take a minute. All the accused are out on bail. The trial continues.

This, as the State presented crucial cellphone evidence on Wednesday, alluding that she had represented herself as three different persons while carrying out the crime. Jacobs, 37, was widely supported by her family at the Bellville Magistrate's Court where she faces charges of kidnapping and defeating the ends of administrative justice. Closing arguments in her much-anticipated bail application continued where Sergeant Dawid Fortuin presented new evidence, that of cellphone records, pertaining to the merits of the State's case. Fortuin, from the Serious and Violent Crimes Unit for Kidnapping, took the witness stand armed with the evidential cellphone records, in which he detailed that they had confiscated cellphones from Jacobs following her arrest, one of which had a dual SIM. He said the records showcased that three persons, namely a Sameemah, Wasiema, and Chevon Classen, had used three different cellphone numbers with three different IMEI numbers - alluding that the person in question was Jacobs who had represented herself as such. He stated that the records showed that on June 18 and 19, the cellphone of Jacobs was found in the jurisdiction of the Mitchell's Plain District Hospital where the mother of baby Mogamat Imaad Sharmar, Imaan Sharmar, had given birth. Next Stay Close ✕ He said the cellphone records further showed that Jacobs had been in Strandfontein on June 28, the date of the kidnapping, and Chevon at Middestad mall in Bellville. Fortuin added that queries with management about the the identity of Chevon, who claimed to work for an NPO, the Zoey Project, which assisted mothers, was confirmed to have no staff member with that name Jacobs's lawyer Asongewa Mafuya dropped a bombshell when presenting his arguments as to why she was a candidate for bail. He said Jacobs was diagnosed with bipolar disorder in 2023 and had three children, one of which was a minor aged seven years. Mafuya said the State did not present evidence to prove that she would disturb or interfere with the matter, or that she was a flight risk. He added that Jacobs's children were in the care of her friend while her 67-year-old mother was in hospital. The magistrate asked the State to clarify who Chevon was. "Was Chevon and Sameemah in the vehicle the day of the kidnapping?" he asked. The State clarified that to the Uber driver Jacobs had been presented and to Sharmar, Chevon had been presented. Fortuin stated that with the inquiry relating to another victim, that of a 15 year old girl, who was pregnant, they were waiting for vital video footage of her vehicle. He said her arrest was imminent in that matter. State prosecutor, Salaahuddeen Simon, presented arguments as to why Jacobs was not a candidate for bail, in which he cited that the public's trust in the justice system and that she could evade her trial and that she was a flight risk or could interfere or destroy evidence. The matter was postponed for bail consideration to July 28. The State is set to prove that Jacobs kidnapped Imaad on June 28 at Middestad Mall after pretending to be a sponsor for the Zoey Project and that she had befriended Sharmar prior to that. Earlier, Fortuin detailed that a witness who visited Jacobs behind bars following her arrest, said she claimed she did not kidnap the infant but that she was given the baby by the mother whom she had given money and takkies. Showdown over future of Nelson Mandela Bay city manager expected on Thursday

Notices for a council meeting to discuss the future of Nelson Mandela Bay city manager Noxolo Nqwazi were issued on Tuesday as the political fallout over last week's abandoned council meeting continued. A new Nelson Mandela Bay city council meeting was called for Thursday, a week earlier than planned, with political pressures rising for a decision on city manager Dr Noxolo Nqwazi's future within the metro. The fallout from last week's meeting, which was scheduled to discuss the issue but abandoned because the reports were 'not ready', continues. ACDP councillor Lance Grootboom has written to the acting city manager, Ted Pillay, to ask why money spent on the abandoned meeting should not be classified as fruitless and wasteful expenditure. He said the abrupt abandonment of the meeting was 'deeply concerning'. Meanwhile, a legal opinion provided to the Nelson Mandela Bay metro by advocate Olav Ronaasen SC has advised the council to abandon its disciplinary hearing of Nqwazi. She was put on precautionary suspension in late 2023 and again in early 2024, pending disciplinary action which had been instituted against her. Ronaasen said he has been asked to advise on the viability of the disciplinary proceedings against Nqwazi and the status of the criminal proceedings against her to enable the council to reach an informed decision as to whether it should persist with the disciplinary proceedings or withdraw them and continue to pursue a settlement with her, in terms of which her employment with the municipality would terminate. The disciplinary hearing against her has been put on hold pending negotiations for a settlement, but the National Treasury has refused to approve a departure which would allow a settlement to be paid, suggesting that the disciplinary proceedings should first be pursued to completion. Nqwazi was arrested by the Hawks in September 2022, along with the metro's former human settlements director Norman Mapu, businessman Xolani Masela, his spouse Nwabisa, former Democratic Alliance councillors Trevor Louw, Neville Higgins and Victor Manyathi, and Nelson Mandela Bay ANC secretary Luyolo Nqakula. They face charges of corruption, money laundering, fraud and contravening the Municipal Finance Management Act. It is alleged that kickbacks for a toilet tender awarded during the 2020 Covid-19 pandemic were used to reward Louw, Higgins and Manyathi for voting for a motion of no confidence against former DA mayor Athol Trollip. However, an application is pending for Nqwazi to be discharged after the close of the State's case, with her legal team arguing that the State had failed to lead any evidence against her. Different charges She is facing different charges at her disciplinary hearing. It is alleged that she misled the council by failing to disclose that a PWC forensic report did not support allegations of financial misconduct against Anele Qaba — now CEO of the Mandela Bay Development Agency — which meant his suspension was unwarranted and should have been lifted. Nqwazi's alleged failure, according to Ronaasen's opinion, was that she did not fully inform the council of the situation, which resulted in unauthorised and wasteful expenditure when a R3-million settlement was paid to Qaba. The second charge against her is that she unsuccessfully took a Special Investigating Unit report about the toilet tender on legal review, resulting in unauthorised and wasteful expenditure for the municipality. However, Ronaasen pointed out that Nqwazi performed both of these tasks under instruction from the council. As a result, he said, there was little chance of the disciplinary proceedings succeeding. He advised the council to revisit its decision, withdraw the proceedings (subject to the Treasury's approval), and formalise the in-principle settlement reached with Nqwazi. 'It would be financially irresponsible to pursue prolonged disciplinary proceedings,' he said. 'I suggest that this opinion be submitted to the National Treasury as part of the municipality's motivation as to why the disciplinary proceedings should be withdrawn.' However, Deputy Mayor Gary van Niekerk — who was frequently in conflict with Nqwazi during his tenure as mayor — said in a media statement issued on Tuesday that the city was at a crossroads 'for clean governance, accountability and the rule of law'. He issued the statement just a day after Executive Mayor Babalwa Lobishe said in a memorandum that all communications from the political leadership in the metro must go through her. She did not respond to a Daily Maverick request for comment. 'Efforts by opposition actors to engineer the return of suspended (and criminally charged) municipal manager Noxolo Nqwazi risk reversing the progress made towards stabilising governance in the metro,' said Van Niekerk. 'Legal wrangling over her suspension has dragged on while she has continued to draw a salary, and contests over her status have become a rallying point in broader power plays in council.' Van Niekerk himself is facing criminal charges after allegedly using a council letterhead to obtain legal services for himself while he was speaker of the council — after Nqwazi had declared his seat vacant due to disputes in his former party, the Northern Alliance. He was found guilty at a disciplinary hearing, but earlier this week the MEC for cooperative governance, Zolile Williams, decided against removing Van Niekerk as a councillor and instead issued a reprimand. Van Niekerk said the legal fees for Nqwazi's disputes with the council had reached R800,000, while 'the municipality spent more than R5-million paying her salary and those of successive acting city managers appointed during her suspension'.
