IHC hears petitions against PECA Amendment Act 2025
Justice Inam Amin Minhas of the Islamabad High Court (IHC) on Monday heard multiple petitions seeking the annulment of the controversial Prevention of Electronic Crimes Act (PECA) Amendment Act 2025.
The petitions were filed by the Pakistan Federal Union of Journalists (PFUJ), prominent TV anchors, and the Islamabad High Court (IHC) Journalists Association.
The federal government has submitted its written response to the court.
A government lawyer stated that provincial governments have also been made respondents in the case. Lawyer Imran Shafiq told the court that an initial objection raised by the Registrar's Office had been resolved.
During the hearing, IHC directed the petitioners' lawyers to begin presenting their arguments. PFUJ counsel Dr Yasir Aman Khan opened the arguments by giving historical context as the judge asked to first provide the background so the court can understand the case.

"The PECA Act was introduced in 2016," said Dr Yasir, adding that the 2025 Amendment removed several provisions from the original act and added new ones.
He noted that the amendment also establishes a Social Media Complaint Council, expanding the law's scope.
Justice Inam Amin Minhas instructed the petitioners to clarify the changes in the Code of Conduct, highlighting what it previously entailed and what has now been altered.
PECA amendment
Earlier this year, the National Assembly passed a set of amendments to the Prevention of Electronic Crimes Act (PECA) under a supplementary agenda, significantly expanding the government's authority to regulate online content and penalise digital offences.
PECA (Amendment) Act 2025 included provisions for the formation of a Digital Rights Protection Authority (DRPA), which will be empowered to remove online content, restrict access to prohibited material, and impose penalties on individuals who share such content.
The amendments also broadened the definition of 'social media platforms' to encompass tools and software used to access these platforms.
The revised law now extends its jurisdiction to include websites, applications and various communication channels. As part of the legislative changes, the FIA Cybercrime Wing is to be disbanded and replaced with a stricter framework of enforcement.
Under the new rules, individuals sharing expunged material from parliamentary or provincial assemblies on social media could face imprisonment of up to three years along with a fine of Rs2 million.

Radio Pakistan buildings in Karachi: Senate body alarmed over illegal occupation, power theft
ISLAMABAD: The Senate Standing Committee on Information and Broadcasting has expressed serious concern over the illegal occupation of Radio Pakistan buildings in Karachi and electricity theft through unauthorized connections. Senator Waqar Mehdi raised the issue during the committee meeting on Tuesday, urging immediate inspections of Radio Pakistan properties across the country to assess conditions and prevent further encroachments. The meeting, chaired by Senator Ali Zafar, also advanced the Prohibition of Unethical Advertisements Act, 2025, as lawmakers pushed for stricter controls on content promoting gambling, alcohol, and inappropriate clothing while calling for a balanced approach that avoids excessive regulation and police overreach. The committee decided to proceed with voting on the bill, seeking the Information Minister's formal stance. Senator Afnan Ullah cited gambling ads during cricket matches and depictions of alcohol in TV dramas as examples of regulatory lapses, while Senator Sarmad Ali proposed oversight by PTA or religious advisory boards. Senator Pervaiz Rashid, however, warned against overregulation of cultural norms and urged a focus on enforcing existing PEMRA laws. Deliberations also included the Right of Access to Information (Amendment) Bill, 2023, where Senator Zarqa Suharwardy Taimur criticized the practice of government departments providing incomplete or selective data. She called for written justifications for denials of information, a move backed by Chairman Ali Zafar. The committee resolved to invite the Information Commissioner for further consultation. On the state of the cinema industry, concerns were raised over stagnant film production due to a lack of screening venues. Addressing financial matters, the committee reviewed Pakistan Television's (PTV) exhausted Rs. 11 billion annual budget, with Rs. 8.5 billion consumed by salaries. Senator Zafar questioned inconsistencies between reported payments and on-ground realities, seeking employment data from the past five years and calling for a future briefing on potential reforms. The panel also discussed the chronic losses of PTV and raised the prospect of privatization. Lastly, the committee voiced frustration over the lack of data concerning PECA-related cases against journalists and social media activists. Chairman Zafar noted the Ministry of Information had failed to submit its report and the Ministry of Interior had not responded. The committee resolved to summon the Interior Secretary in the next session for clarification. SC decision on transfer of judges to IHC challenged
ISLAMABAD: The judgment of the constitutional bench of the Supreme Court on transfer of judges to the Islamabad High Court (IHC) has been challenged. The Lahore Bar Association, Lahore High Court Bar Association on Wednesday filed intra court appeals (ICA) against the five-judge verdict under Section 5 of the Supreme Court (Practice and Procedure) Act, 2023, read with Article 184(3) of the Constitution. The petitioners prayed that the impugned order passed by the constitutional bench dated 19-06-2025 be set aside and allow the constitution petition No27/2025. The Constitution Bench on June 19, 2025 by majority of 3 to 2 held that transfer of judges under Article 200 is within the framework of the Constitution, and transfer (permanently or temporarily) cannot be construed as a fresh appointment. The IHC five judges – Justice Mohsin Akhtar Kayani, Justice Tariq Mahmood Jahangri, Justice Babar Sattar, Justice Sardar Ejaz Ishaq Khan and Justice Saman Rafat Imtiaz, Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan, Karachi, Lahore and Islamabad High Court Bar Associations had filed the petitions against the transfer of three judges namely, Justice Sardar Muhammad Sarfraz Dogar from Lahore High Court (LHC), Justice Khadim Hussain Soomro from Sindh High Court (SHC), and Justice Muhammad Asif from Balochistan High Court (BHC) under Article 200 (1) of the Constitution. The apex court without upsetting the notification of transfer of judges in the IHC remanded the matter of seniority to the President of Pakistan to determine the seniority after examining/vetting the service record of the transferee judges as soon as possible, including the question of whether the transfer is on a permanent or temporary basis. The petitioners contended that the impugned order is against the constitution, law and all rules of fairness and thus void, without jurisdiction, coram non judice, having been passed without lawful authority and is thus of no legal effect. They submitted that all orders passed, actions taken, notifications issued, including the determination of seniority of judges and subsequent proceedings of the Judicial Commission of Pakistan (JCP) in relation to the appointment of the Chief Justice of the IHC are all void and unconstitutional and of no legal effect. The said order and the notifications and the appointments were purportedly made in pursuance of the directions given the impugned order. It is the case of the Appellant that the impugned order is unconstitutional and void and thus all orders and actions taken in pursuance thereof are also void and unconstitutional and of no legal effect. PPP leader questions legitimacy of PML-N's mandate
ISLAMABAD: A senior Pakistan People's Party (PPP) leader Nabeel Gabol, on Wednesday, said it point blank: the 'so-called two-thirds majority was given to the ruling Pakistan Muslim League-Nawaz (PML-N) in alms.' The PPP stalwart lost his cool after coming face to face with PML-N loyalists and the State Minister for Interior, Talal Chaudhry, during a meeting of National Assembly Standing Committee on Interior, when the latter boasted that 'we have toppled government in the past and we can, again.' The committee meeting was held with MNA Raja Khurram Nawaz in the chair. The tone of the state minister for interior angered Gabol who is the PPP MNA from Karachi, and he confronted Chaudhry, saying 'the regime given to PML-N has made them arrogant, which needs to be curtailed.' The PPP stalwart said that the attitude of the state minister and Capital Development Authority (CDA) chairman towards the committee members is uncalled for and is not acceptable. 'The attitude of the minister and, surprisingly, the CDA chairman, Muhammad Ali Randhawa who is a government official, towards committee members is simply not acceptable and I'm going to boycott the meeting in protest against their unruly attitude,' he said and staged a walkout from the meeting in protest. The committee chairman requested Gabol not to stage a walkout from the meeting, but he left the meeting after an exchange of harsh words with Chaudhry. During the discussion over the Capital Development Authority (Amendment) Bill, 2025, moved by PPP MNA Shazia Marri, an official of the Law Ministry said that the law already exists and therefore, the ministry did not support this bill. To this, Marri said that she would move a privilege motion against the Law Ministry official. Talal Chaudhry replied, 'Go ahead, I will face it myself.' The committee made a sub-committee for further examination and discussion over the Capital Development Authority (Amendment) Bill, 2025. During the meeting when the Law Ministry official said that the Constitution is supreme, Pakistan Tehreek-e-Insaf (PTI) MNA and member of the committee Shehryar Afridi asked the official to repeat the statement, saying, 'It sounds good.' MNA Zartaj Gul said that we want to understand it. In response, Talal Chaudhry remarked that those who do not understand are made to understand. Special invitee Minister for Parliamentary Affairs Dr Tariq Fazal Chaudhry criticised recent increases in property transfer fees by the CDA, calling them unacceptable. He said that a committee was formed by the prime minister to look into real estate matters in Islamabad. The CDA must withdraw this fee hike immediately, he said. During the meeting, Chaudhry urged Minister Talal Chaudhry to pay attention, adding, 'This is not about Faisalabad, Minister Sahib! This is about Islamabad—please focus and listen.' The minister for parliamentary affairs also expressed concern over deteriorating road conditions following recent rains, pointing out that even newly constructed roads submerged. He urged CDA to ensure pending projects are completed, saying that people gather in front of his and chairman committee's offices in protest. The meeting was attended by MNAs, Syeda Nosheen Iftikhar, Malik Shakir Bashir Awan, Syed Rafiullah, Haji Jamal Shah Kakar, Sardar Nabeel Ahmed Gabol, Khawaja Izhar Ul Hassan, Nawabzada Mir Jamal Khan Raisani, Muhammad Ijazul Haq, Mohammad Jamal Ahsan Khan, Nisar Ahmed, Sahibzada Muhammad Hamid Raza, Shehryar Khan Afridi, Jamshaid Ahmed, Zartaj Gul, Sofia Saeed Shah, Shazia Marri, Aliya Kamran, Dr Mahreen Razaq Bhutto and Dr Tariq Fazal Chudhary and senior officials.
