Council did not manage guided busway risk, judge told
Cambridgeshire County Council has been prosecuted by the Health and Safety Executive (HSE) after three people died and a teenager was seriously hurt on the busway during a six-year period.
The council has admitted breaching health and safety legislation.
A judge has been taking evidence at a sentencing hearing at Cambridge Crown Crown.
Jennifer Taylor, Steve Moir and Kathleen Pitts all died after collisions on the busway, serving Cambridge, Huntingdon and St Ives, between 2015 and 2021.
Barrister Pascal Bates, who is leading the HSE legal team, outlined evidence on Thursday as relatives of people who died watched from a public gallery.
He said guided busways were rare.
"This case is about the management of risk," Mr Bates told Judge Mark Bishop.
"The incidents in this case are related to incidents where that management did not work."
He said one charge related to crossing the busway and one charge to people being alongside.
Mr Bates said the case concerned the "mismanagement of safety" and added: "Central to the case was unpreparedness by the council."
He told the hearing the council had repeatedly refused to ask itself "relevant questions".
Mr Bates also said there had been "warnings" and told the judge: "It persisted, with inadequate justification, in not doing what it should have been doing all along."
He said buses running on the busway were "relatively silent".
"They are modern machines and they whisper along," Mr Bates added.
He told the hearing the "line speed", or maximum speed, for guided buses was 56mph (90km/h).
He said between 2011 and 2023 there had been three deaths and a number of "serious injuries" to "innocent" members of the public.
In 2011, a bus had made an emergency stop and a passenger had hit her head and fractured her skull.
Mr Bates said the incident had not been reported to the HSE.

Guided busways are tracks which enable buses to travel at speed.
They have been built along former railway lines
The Cambridgeshire busway is one of the best-known in Britain - one also runs between Luton and Dunstable
On Monday 5 March 2007, then Transport Secretary Douglas Alexander opened a manufacturing plant at Longstanton, near Cambridge, which aimed to produce the 6,000 concrete beams for the guided bus route between St Ives and Cambridge
The Cambridgeshire busway required Government approval and the Cambridgeshire Guided Busway Order 2005 came into force on 11 January 2006
The hearing is due to end on Friday.
The judge was shown footage of two incidents. Both involved people trying to cross the busway. Mr Bates said one incident resulted in a woman's death and, in the second, a teenage boy was badly hurt.
Judge Bishop has indicated that he will announce decisions on sentencing at a later date.
A lawyer had said at an earlier hearing that a commercial organisation convicted of the same offences would expect a seven or eight-figure fine.
In September 2024, council chief executive Dr Stephen Moir apologised.
"We fully recognise and accept that during the historic operation of the guided busway, when these incidents occurred, that we fell far short of meeting these standards," he said in a statement released by the council.
"For that we are truly sorry."
In October at an earlier court hearing, the council admitted two breaches of the 1974 Health and Safety at Work Act.
The breaches were:
Failing to ensure members of the public were not "exposed to risks" when using "designated crossing points"
Failing to ensure members of the public were not "exposed to risks" when in the "vicinity of, or seeking to travel alongside" the busway
Barrister Ben Compton KC, who represented the council, had told the judge at an earlier hearing that the authority's "financial circumstances" would have to be considered before sentence was passed.

Scottish airport fined £144,000 for failures that led to death of employee
The company that runs Glasgow Prestwick Airport has been fined more than £144,000 for failures that led to a member of airport staff falling to his death when a guardrail gave way. Joseph Dempsey, an experienced member of the airport's ground handling team, died in the incident on January 11 2023. The 59-year-old had been preparing to unload cargo from an aircraft using a pallet loader. He had positioned the loader alongside the aircraft and was repositioning a guardrail when it suddenly gave way and he fell to the tarmac some 10 feet (three metres) below. Mr Dempsey's colleagues immediately went to his assistance and paramedics attempted CPR and advanced life support. However, these efforts proved unsuccessful and Mr Dempsey was pronounced dead at the scene. An investigation by the Health and Safety Executive (HSE) found that one of the guardrail posts had completely fractured, and that there were visible signs of significant corrosion, discolouration and flaking white paint around the area. At Ayr Sheriff Court on June 25, Glasgow Prestwick Airport Ltd pled guilty to a breach of health and safety legislation, having failed to ensure the pallet loader was maintained and in good repair. At the same court on Thursday, the company was fined £144,050, including a victim surcharge of £10,050. Debbie Carroll leads on health and safety investigations for the Crown Office and Procurator Fiscal Service (COPFS). Speaking after the sentencing, she said: 'Joseph Dempsey lost his life in circumstances which could have been avoided if Prestwick Airport had in place a suitable and adequate maintenance and inspection programme to ensure the equipment he was using was in a good state of repair. 'This prosecution should remind duty holders that a failure to fulfil their obligations can have fatal consequences and they will be held accountable for this failure.' Metallurgical examination of the guardrail posts carried out during the investigation found differences in chemical composition, manufacturing, and wall thickness which indicated the posts were manufactured from two different tubing sections. The HSE found these welded sections were not a feature of the manufacture's original design, and appeared to have been modified while the loader was under the ownership of Prestwick Airport. The investigation also found the welds on both the guardrail posts contained defects which would allow moisture in, creating a corrosive environment and speeding up deterioration. It was also found that the maintenance programme in place at the time did not cover the parts of the guardrail where failure or deterioration could lead to health and safety risks. Graeme McMinn, HM principal inspector of health and safety, said: 'Employers have an absolute legal duty to ensure that equipment they use at work is maintained in an efficient state and in good repair and full working order. 'This incident is a tragic reminder of what can result when that does not happen.' Since the incident, Prestwick Airport has undertaken a review of all work at height, and checks of the guardrails on the platform loaders have been made part of the regular service and inspection schedule.

Execution date set for man who abducted woman from insurance office, killed her
A man who abducted a woman from a Florida insurance office and killed her is scheduled for execution in Florida under a death warrant signed by Republican Gov. Ron DeSantis. Kayle Bates is set to die Aug. 19 in the 10th execution scheduled for this year. DeSantis signed the warrant Friday, just three days after the state executed Michael Bell for fatally shooting two people outside a Florida bar in 1993 as part of an attempted revenge killing. Bell was the 26th person to die by court-ordered execution so far this year in the U.S., exceeding the 25 executions carried out last year. It is the highest total since 2015, when 28 people were put to death. Bates, now 67, was convicted of first-degree murder, kidnapping, armed robbery and attempted sexual battery in the June 14, 1982, Bay County killing of Janet White. Bates abducted White from the State Farm insurance office where she worked, took her into some woods behind the building, attempted to rape her, stabbed her to death, and tore a diamond ring from one of her fingers, according to a letter from Florida Attorney General James Uthmeier summarizing the history of the case. Bates' attorney, James Driscoll Jr., said in a phone call Saturday that he would be filing further appeals in the case. 'We believe his execution would violate the U.S. constitution,' he said.

This is the shocking moment a rogue builder strolls away from a house he caused to explode just moments before. Barry Newman, 58, was undertaking renovations on a property in Bulwell, Nottingham, when the three-storey terraced house erupted from its first floor. The builder had positioned a defective portable space heater, linked to a propane gas (LPG) cylinder, in the property's cellar to combat dampness. His injuries were so bad, he has been unable to work since. A nearby neighbour captured footage of the aftermath of the blast, showing smoke billowing from the semi-detached property and debris strewn across the pavement and road. Newman - the sole proprietor of Foster Brother Builders - can be seen walking unscathed from the property, glancing back at the devastation he has wrought. Last week (June 19), Nottingham Magistrates' Court handed Newman, of The Quay, Beeston Marina, Nottingham, a 12-month suspended sentence, sparing him an immediate stint behind bars. He was also instructed to complete 240 hours of unpaid work and ordered to pay costs of £2,000. The Health and Safety Executive (HSE) investigated the incident, which occurred on November 22, 2022, and discovered that Newman failed to conduct a risk assessment. He failed to provide appropriate and well-maintained equipment for the task at hand. The heater's manufacturer's guidelines explicitly state that it should only be used in areas with good ventilation and that LPG cylinders should not be stored underground. This is due to the fact that the gas, being denser than air, will accumulate at lower levels in the event of a leak. HSE guidance stipulates that employers must ensure work equipment is utilised solely for tasks and under conditions deemed suitable. Newman admitted to violating Regulation 4(3) of the Provision and Use of Work Equipment Regulations 1998. Roy Poulter, HSE Inspector, commented: "This gas explosion has left one man unable to work due to the seriousness of the injuries sustained and it could have easily resulted in someone losing their life. "This case should serve as a strong reminder to those in the building trade on the dangers of working with gas and the need to assess the risk, and just how serious both HSE and the courts take failures like this. "HSE will take action against those who do not do all that they can to keep people safe."
