
Bilateral Investment Treaty talks with UK drag on as sunset clause, dispute resolution remain unresolved

New Delhi | Milan: India and the United Kingdom are still negotiating the proposed Bilateral Investment Treaty (BIT) which was to be announced alongside the free trade agreement (FTA) and the Double Contribution Convention Agreement.Two issues, the sunset clause and dispute resolution, are pending, which is why the BIT talks are continuing, said people with knowledge of the matter. The UK is keen on bringing taxation issues within the purview of the BIT, something about which India has reservations, they said."Parliament has the sovereign powers on taxation and that cannot be brought within the BIT. But hopefully these issues can be resolved soon," one of the persons told ET on condition of anonymity. Earlier, there were plans to conclude all three deals simultaneously.India insists on exhaustion of local remedies before an investor can take the state to arbitration for a dispute, something that many countries, including the UK, are opposed to under the investor state dispute settlement As per the model BIT text, investors need to exhaust local solutions for at least five years before arbitration. The provision is aimed at preventing arbitrators from having expanded jurisdiction and is a point of contention.This treaty became crucial after India lost international arbitration disputes to investment treaty award holders such as Cairn Energy PLC, Vodafone Group BV and Devas Mauritius Ltd, and now it has to balance safeguarding foreign investment with protecting public interest.The treaties help protect investors and investments.While India had cancelled more than 70 of its 80-plus BITs by 2016, only seven countries have accepted the existing model text treaty.While the finance ministry looks at investment issues, investment chapters are part of free trade agreements which the commerce department negotiates.Investment is a sticking point in India's proposed trade pact with the UK.Eleven investor-state dispute settlement cases were filed against India between 2000 and 2020, according to the United Nations Conference on Trade and Development.

The trip is expected to witness the signing of a bilateral Free Trade Agreement (FTA) between India and the UK. The two sides had concluded negotiations for the trade agreement on May 6. During his trip, Modi will discuss various issues with British PM Keir Starmer concerning bilateral relations. From the UK, PM Modi will depart for Maldives for a state visit from July 25-26. Recent uptick in India-UK ties The relations between India and the UK have been on the rise in recent years. The Strategic Partnership between the two countries was elevated to Enhanced Partnership for the Future in 2010. The historical ties have got a boost since Brexit. In 2021, India and the UK upgraded their ties to a Comprehensive Strategic Partnership. They also adopted Roadmap 2030 to boost the relations in trade and investment, defence and security, and people-to-people contact and so on. In 2023, India and the UK established the 2+2 Foreign and Defence Dialogue. Last year, they launched the Technology Security Initiative. In May, New Delhi and London concluded talks to reach a bilateral Free Trade Agreement deal, discussions for which first began in January 2022. Business ties have also enhanced between India and the UK, with goods trade surpassing $23 billion in 2024-25, Indian Express reported, citing data by Indian government sources. PM Modi in the UK PM Narendra Modi, who is on his fourth visit to the UK, will hold discussions with his British counterpart Keir Starmer on a range of bilateral issues. 'They will also exchange views on issues of regional and global importance,' the Ministry of External Affairs (MEA) said in the official announcement. The Indian leader is also slated to meet King Charles III. File Photo/Reuters During the visit, PM Modi will review the state of the Comprehensive Strategic Partnership (CSP), 'with a specific focus on trade and economy, technology and innovation, defence and security, climate, health, education and people to people ties,' the MEA said. PM Modi is also likely to interact with business leaders in the UK. FTA, Khalistan & more A key part of PM Modi's UK visit is the finalisation of the trade agreement between the two countries. India and the UK are expected to sign the FTA on July 24. 'We are working on legal scrubbing and other last-minute work that needs to be done,' Foreign Secretary Vikram Misri told a press conference on Tuesday, ahead of PM Modi's visit. STORY CONTINUES BELOW THIS AD The India-UK FTA would eliminate duties on 99 per cent of Indian exports to Britain, including key sectors such as textiles, leather, gems and jewellery and auto parts and engines. In return, India will reduce or remove tariffs on 90 per cent of British products, including medical devices and alcoholic beverages. According to British estimates, the India-UK FTA will enhance bilateral trade by £25.5 billion annually by 2040. PM Modi had announced the trade deal with the UK on May 6, calling it 'ambitious and mutually beneficial'. The UK government has described the agreement as 'the biggest and most economically significant bilateral trade deal'. Commerce and Industry Minister Piyush Goyal will accompany PM Modi to London for the signing of the India-UK FTA. The talks will reportedly feature matters related to security and technology. India is likely to raise the issue of a surge in Khalistani threat in the UK. 'The presence of Khalistani extremists…we have brought to the attention of our partners in the UK. This should be a matter of concern for our partners as well,' Misri told the media. The extradition of fugitives could also be among the top agendas during PM Modi's UK visit. India is seeking the extradition of Lalit Modi, Nirav Modi and Vijay Mallya, who are wanted for financial fraud, from the UK. 'There are a few questions related to fugitives from Indian law and justice in the UK. These have been a matter of discussion between both sides, and we continue to make the case for these fugitives to be rendered to India. Obviously, there is a legal process that such requests and such issues go through in the other country, and we continue to follow up very closely with our partners in the UK on these matters,' the Indian foreign secretary said. Kreditbee gets nod to become public entity

On July 5, the company also received an approval from the Reserve Bank of India (RBI) to merge group technology arm Finnovation Tech Solutions into non-banking finance company Krazybee Services, said one of the people cited above. This will help bring Kreditbee's entire technology and credit disbursal business under one entity – a vital step before the company could go public, the sources queries to the startup remained unanswered until press time Tuesday. Kreditbee recently reverse-flipped its parent entity from Singapore to India. Three other prominent fintech lenders – Aye Finance, Kissht and Moneyview – are at different stages of going public.'Kreditbee, like many other digital lending startups, is getting internal processes in place so that it can get IPO ready,' one of the persons cited above said. 'Once the opportunity comes, it can quickly go public.'Post the merger approval, its entire business will be undertaken through Krazybee Services, which will book some loans on its own while others will be through NBFC partners including PayU Finance, Vivriti Finance, and Northern Arc. ET had reported on June 26 that many lending startups preparing for an IPO may actually start the process towards the end of the current year or early next year. Kreditbee, one of the largest consumer lending startups in the country, is expected to kick off the IPO process only next company, at a consolidated level, closed FY25 with a net profit of Rs 473 crore and total income of Rs 2,712 to a note released by credit rating agency Crisil on July 14, Kreditbee has built a total asset base of Rs 7,119 crore, with its net non-performing asset level at around 1.6%, after in 2017 by Madhusudan Ekambaram, Karthikeyan Krishnaswamy and Vivek Veda, Kreditbee has raised around Rs 2,100 crore in equity infusion over multiple funding rounds. It counts Premji invest, Motilal Oswal, Mirae Asset Ventures and Japanese financial services major MUFG among its major company primarily offers unsecured personal loans and is now venturing into secured credit products as well.
