DM order denying arms licence to sportsperson set aside by HC

Time of India04-06-2025

Prayagraj: The Allahabad high court has set aside Deoria district magistrate's order dated May 3, whereby he had denied arms licence to sportsperson
Gaurav Gupta
, who had required it for training and competition purpose.
In the decision dated Jun 2, Justice Piyush Agrawal also remanded the matter to Deoria district magistrate, for deciding afresh application of the petitioner for grant of arm licence for sports training and competitions by passing a reasoned and speaking order, after giving due opportunity to the petitioner to cure the defect, if any, as well as to provide all documentary evidence/material, as required under the aforesaid rules, within a period of 15 days from date of production of certified copy of the order.
Through the present writ petition, the petitioner, a sportsman, assailed the order dated May 3, passed by Deoria district magistrate, whereby his application for arms licence was rejected.
The counsel for the petitioner submitted that in pursuance to the order dated Feb 27 of this court, the licensing authority had rejected the application of the petitioner for grant of arm licence by holding some defects in the sports certificate attached by him.
The certificate has been issued to the petitioner as a junior shooter and since the petitioner's category of shooting was not defined well and no affidavit with regard to the same had been filed, as per Arms Rules, 2016, the arms licence to the petitioner could not be granted.
Counsel for petitioner further submitted that with regard to the said defect, if any, no opportunity was given to the petitioner to cure the same.
He further submitted that since the petitioner had to participate in the upcoming pre-Uttar Pradesh state shooting championship competition, to be held in beginning of July, the petitioner shall be disqualified from participating in absence of a fire-arm licence. He also stated that the above said ground on which the application of the petitioner had been rejected, could be cured.
On the other hand, state govt's counsel supported the DM's order, which was under challenge, submitting that since the petitioner had failed to provide necessary documentary evidence in support of his application, the application of the petitioner had rightly been rejected.
He submitted that in the said application for grant of arms licence, the petitioner had not disclosed details as required under the Arms Rules, 2016.
After hearing the parties, perusal of the said application showed that no column had been framed as per aforesaid rules as to the detailed information/evidence of the petitioner as a 'Junior Shooter'.
Further, the impugned order (the order under challenge) did not refer to any opportunity being granted to the petitioner to cure the defect as pointed out in the impugned order.
"In view of peculiar facts and circumstances of the case as stated, the impugned order dated May 3, cannot be justified in the eyes of law and the same is hereby set aside," the court added.

Meta, TikTok can be sued by mother of teen killed while subway surfing

A lawsuit against wrongful death has been filed against Meta Platforms and ByteDance, TikTok's parent company, after a 15-year-old boy lost his life while 'subway surfing' on a moving train, Reuters reported. A New York state judge, Justice Paul Goetz, ruled on Friday that Norma Nazario, the mother of the deceased, can try to prove that both Meta and ByteDance 'goaded' her son Zackery into subway surfing by getting him addicted to platforms like Instagram and TikTok, where Zackery viewed content about 'dangerous challenges'. Meta and ByteDance have previously faced thousands of lawsuits, along with Snapchat, accusing the platforms of being addictive and causing harm to children, schools, and governments. Zackery Nazario died on February 20, 2023, after he and his girlfriend climbed on top of a Brooklyn-bound J train as it crossed the Williamsburg Bridge. According to Zackery's mother, a low beam struck him, causing him to fall between subway cars, which then ran over him. His mother also claimed that she found several videos related to subway surfing on her son's social media accounts. Meta, ByteDance term Zackery's death 'heartbreaking' While Meta and ByteDance seek immunity from user content under Section 230 of the federal Communications Decency Act and the free speech clause of the First Amendment of the US Constitution, Justice Goetz ruled that Zackery's mother can try to prove her son was targeted because of his age. He wrote, 'Based on the allegations in the complaint. It is plausible that the social media defendants' role exceeded that of neutral assistance in promoting content, and constituted active identification of users who would be most impacted.' The Manhattan judge, however, dismissed her claims against New York City's Metropolitan Transit Authority, stating that common sense and 'the realities of life in this city' should have stopped Zackery from pursuing subway surfing. The report, citing data from the New York Police, noted that at least six people died from subway surfing in 2024.

Pocso convict in TN walks free after survivor says she married him

CHENNAI: The Madras High Court has set aside a trial court order, convicting and sentencing a man to 20 years imprisonment in a case filed under the Pocso Act, by taking into account the statement of the alleged survivor girl that she had married the accused and the two have a child. Justice G K Ilanthiraiyan passed the order recently on an appeal filed by the convict, who was awarded the prison sentence (20 years under Pocso and 10 years under IPC) along with a total fine of Rs 1 lakh after he was found guilty under the Pocso Act for aggravated penetrative sexual assault and Section 366 of IPC – which dealt with kidnap or abducting a woman to compel her for marriage or intercourse – by the Mahila Court in Permabalur on April 4, 2025. The prosecution's case was that the appellant abducted the minor girl on August 10, 2015, and stayed with her till August 20. The police registered a case based on the complaint of the girl's father The trial court found him guilty and handed the punishment despite the statement that they were married and have a child. Challenging the trial court order, the man filed an appeal in the high court. During the hearing before the high court, the girl, who is now a major, appeared before the court along with the female child. She deposed that she married the convict and the two were leading a happy life with their child. The judge directed the appellant to register his marriage and produce the registration certificate to the respondent police station within eight weeks from the date of release from the prison, failing which the judgment will stand automatically cancelled.

Turkey: Cartoonist detained for satire on Prophet Muhammad; govt calls it 'ugly humour'

A Turkish cartoonist was detained and his satirical magazine targeted by protesters after publishing a controversial cartoon depicting the Prophet Muhammad, a move that has reignited a fierce debate over free speech and religious sensitivity in the country. Tired of too many ads? go ad free now Interior minister Ali Yerlikaya confirmed the arrest on Monday, posting a video on X showing the cartoonist, identified only as DP, being handcuffed and escorted by officers down a stairwell. He said the artist was taken into custody for questioning. The cartoon, published by the Istanbul-based Leman magazine, showed the Prophet Muhammad and Prophet Moses exchanging greetings mid-air while missiles rained down around them. The image quickly triggered outrage, including an attack on the magazine's headquarters, where a group of young men reportedly associated with an Islamist organisation hurled stones at the building. Justice minister Yilmaz Tunc said an investigation had been opened into the magazine, citing potential charges of 'publicly insulting religious values.' 'Cartoons or drawings depicting the Prophet harmed religious sensitivities and social harmony,' Tunc said. 'No freedom grants the right to make the sacred values of a belief a subject of humour in an ugly way,' he added. The episode drew comparisons to the 2015 attack on the French satirical magazine Charlie Hebdo, where gunmen killed 12 people after the outlet published cartoons of the Prophet Muhammad -- a tragedy that underscored the risks faced by artists and journalists tackling religious taboos. Two French-born Algerian Muslim brothers Saïd Kouachi and Chérif Kouachi carried out the Charlie Hebdo terrorist attack, storming Charlie Hebdo's offices in Paris, spraying gunfire on January 7, 2015, nearly a decade after the weekly published cartoons mocking the Prophet Muhammad. A third attacker, Amedy Coulibaly, killed a police woman and then four Jewish hostages in a kosher supermarket in a Paris suburb. Like the Kouachis, Coulibaly was killed in a shootout with police.
