After 18 years, SC closes petitions on Human Rights Violations by Salwa Judum in Chhattisgarh

New Delhi, June 3 (UNI) Bringing closure to a long-running legal battle, the Supreme Court has disposed of all pending petitions filed by sociologist Nandini Sundar and others concerning alleged human rights violations committed by Salwa Judum activists and security forces in Chhattisgarh.
These matters had remained before the apex court for nearly 18 years.
The case traces back to the Chhattisgarh government's controversial deployment of local tribal youth as Special Police Officers (SPOs) to combat Maoist/Naxalite insurgency.
The SPOs, often associated with groups like the 'Koya Commandos' and Salwa Judum, were accused of committing serious rights violations in the course of anti-insurgency operations.
In a landmark 2011 ruling, the Supreme Court had directed the State of Chhattisgarh to disband and disarm all SPOs, noting grave concerns over state-sponsored vigilantism. Despite that judgment, two writ petitions and one contempt petition remained pending until recently.
A bench comprising Justices B.V. Nagarathna and Satish Chandra Sharma disposed of the cases, holding that the writ petitions were closed on the ground that the reliefs sought had already been addressed through the 2011 judgment.
The contempt petition, which challenged the Chhattisgarh Auxiliary Armed Police Force Act, 2011, was found to be outside the scope of contempt jurisdiction, as it effectively sought new writs in the guise of contempt, the court ruled.
The bench clarified that the enactment of a law cannot be considered contempt of court merely because it follows a judicial order.
'The promulgation simpliciter of an enactment is only an expression of the legislative function and cannot be said to be an act in contempt of a Court unless it is first established that the statute so enacted is bad in law constitutionally or otherwise,' the Court held.
Emphasising the separation of powers, the bench reiterated that any law passed by Parliament or a State legislature must be challenged solely on grounds of legislative competence or constitutional validity, not as contempt of court.
The Court underlined, 'A legislature has the power to enact or amend a law, even to remove the basis of a judicial judgment, as long as it operates within the constitutional framework.' It also noted that Courts do not have the authority to treat the exercise of legislative power as contempt, simply for enacting or amending laws.
Importantly, the bench observed that restoring peace and ensuring rehabilitation in Chhattisgarh remains the constitutional responsibility of both the State and the Union, citing Article 315 of the Constitution.
'It is the duty of the State of Chhattisgarh as well as the Union of India to take adequate steps for bringing about peace and rehabilitation to the residents of Chhattisgarh who have been affected by the violence from whatever quarter it may have arisen,' the Court said.

Chandigarh, July 21 (UNI) In a significant step towards ensuring safer workplaces for women, the Chandigarh Police has introduced the SHe-Box (Sexual Harassment Electronic Box) portal, enabling women to file complaints of workplace sexual harassment online from the comfort of their homes. The initiative eliminates the need for victims to visit police stations or offices to report incidents. The portal, developed under the aegis of the Union Ministry of Women and Child Development, allows women from both government and private sectors to lodge complaints. Investigations will be overseen by a Deputy Superintendent of Police (DSP) to ensure prompt and serious action, maintaining the gravity of each case. The SHe-Box portal is designed to address a wide range of workplace harassment issues, including inappropriate behavior, mental harassment, threats, or any form of discomfort faced by women. It caters to all women employees, whether permanent, contractual, temporary, or engaged in domestic work. To file a complaint, women need a valid email ID and mobile number. The portal's user-friendly interface includes a 'Register your Complaint' option on the homepage, along with a user guide and FAQs for assistance. Telangana's Congress MPs to raise Hyderabad Metro Rail expansion & BC quota issues in Parliament

HYDERABAD: Congress MPs from Telangana will raise the issue of Hyderabad Metro Rail expansion project in the monsoon session of Parliament starting Monday. They were given a PowerPoint presentation on Saturday on the proposed new routes, how it would benefit poor students among other sections of society, and that the detailed project reports (DPRs) were already submitted to the central govt. Hyderabad Metro Rail MD NVS Reddy gave the presentation, which was also attended by BJP MPs Eatala Rajender, Konda Vishweshwar Reddy, and M Raghunandan Rao. The presentation was given following directions from chief minister A Revanth Reddy, so that the MPs from the state would have all information about the project when the issue comes up for discussion in Parliament. Besides seeking central funding and cabinet approvals for the Metro rail expansion project, the Congress MPs from the state would also seek cabinet approval and funding for the Regional Ring Road (RRR), a dedicated corridor from the dry port in Telangana to the sea port at Rajahmundry in Andhra Pradesh. "Chief minister A Revanth Reddy is expected to come to Delhi soon. He will meet AICC president Mallikarjun Kharge and Rahul Gandhi and seek their support to raise these issues. The CM will also meet INDIA bloc MPs, their party presidents, and other like-minded parties and seek support for BC reservations inclusion in the IX schedule. There is a likelihood of the CM addressing a meeting of INDIA bloc MPs at the Constitutional Club in Delhi," Bhongir MP said. The Congress MPs said urbanisation would go up to 60% of Telangana if the RRR and dedicated corridor were developed. Industries and investments would also come. "We will raise the issues through question format during question hour, during zero hour, and under other rules of the Lok Sabha," Mahabubabad MP Balram Naik said.
