Delhi High Court to examine if Centre has power to order cuts in Udaipur Files movie

The Delhi High Court on Wednesday (July 30, 2025) asked the Centre if it had the authority to pass an order directing six cuts in the film Udaipur Files-Kanhaiya Lal Tailor Murder, while exercising revisional powers.
'You have to exercise the powers within the four corners of the statute. You can't go beyond that,' a Bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela said.
The court posed the question after being informed that the Centre, while exercising its revisional powers under the Cinematograph Act, had suggested six cuts to the producers of the movie, in addition to a disclaimer.
The court was also informed that the film has been recertified, but not issued to the producers, because the matter is pending in the High Court.
The court was hearing a plea by Mohammed Javed, one of the accused in the Kanhaiya Lal murder case, objecting to the release of the film on the ground that it would prejudice his case during the trial.
Senior advocate Maneka Guruswamy, representing Mr. Javed, submitted that six witnesses have been examined till now in the case and 160 witnesses remain.
'I was 19 years old when I was arrested. I am Accused No. 8 in the trial. I was released on bail by the Rajasthan High Court because there was no connection between me and the allegations. I am a citizen of this country and am entitled to a fair trial,' Ms. Guruswamy said.
'My right to a fair trial is jeopardised by the release of the film,' she argued.
While Ms. Guruswamy concluded her arguments, the submissions of Additional Solicitor-General Chetan Sharma, who was representing the Centre and the Central Board of Film Certification (CBFC), remained inconclusive and the court said it would continue the proceedings on August 1.
Besides Mr. Javed's plea, another petition has been filed by Jamiat Ulema-i-Hind president Maulana Arshad Madani. It could not be heard due to the non-availability of the counsel.
Kanhaiya Lal, an Udaipur-based tailor in Rajasthan, was murdered in June 2022, allegedly by Mohammad Riyaz and Mohammad Ghous, for sharing a social media post in support of former BJP leader Nupur Sharma after her controversial comments on Prophet Mohammed. The trial is pending before the special NIA court in Jaipur.

Gill and and the BJP strongly condemned the action, accusing the AAP government of indulging in 'political vendetta'. The Vigilance Bureau, however, claimed to have uncovered details of suspicious financial transactions running into crores between Gillco Developers — the Mohali-based realty firm founded by Gill — and entities linked with Shiromani Akali Dal leader Bikram Singh Majithia who is currently in jail after being arrested in a disproportionate assets case. Gill was the 'halka in-charge' of Kharar for the Akali Dal till he quit the party in July. He was widely tipped to join AAP, especially after ruling party's Kharar MLA, Anmol Gagan Maan, announced her resignation and decision to quit politics on July 19. However, she took back her resignation the very next day. A senior vigilance official said that the searches at Gill's residence was in furtherance of the investigations into an FIR (No. 22, dated June 25) registered at Punjab Vigilance Bureau (VB) Police Station Flying Squad, SAS Nagar, against Majithia. The official added that searches were carried out three premises linked to Gillco Developers in Punjab and Chandigarh. 'During the searches, the Bureau uncovered details of suspicious financial transactions running into crores between Gillco Developers and entities linked with Majithia. Further investigations are ongoing,' the official said. Majithia was held on June 25. According to the FIR registered by the Vigilance Bureau, its preliminary investigation has revealed that more than Rs 540 crore worth of 'drug money' was laundered in several ways and Majithia had allegedly facilitated it. The official added that after registration of FIR against Majithia, certain suspicious financial links and transactions between Gillco Developers and some of the entities had come to notice. 'These were developed in a meticulous manner by conducting investigations. To conduct further in-depth inquiries into these transactions and to gather relevant evidence, the Vigilance Bureau conducted these searches in accordance with procedure established by law,' the official said. Bureau officials said several incriminating documents, electronic devices and other evidences have been seized in the ongoing searches. An official spokesperson said that the search operations were conducted strictly in accordance with the legal procedures and the search was still underway. 'Electronic devices and relevant documents were also seized during the searches', he added.

Hisar: Dalit rights activist and advocate Rajat Kalsan and his two companions, Deepak Saini and Pravesh, have been remanded in 14-day judicial custody. The three of them appeared in court on Saturday after being arrested for allegedly assaulting a police team in Hisar's auto market. They were allegedly under the influence of alcohol at the time. City police apprehended his associates during his one-day police remand. A bail application for all the three accused was submitted during court proceedings. The court sought a response from the police and scheduled the bail hearing for Monday. On Thursday, Narnaund police arrested advocate Kalsan in a separate case registered about six months ago, involving a social media post allegedly supporting the accused in the murder of a woman at Budana village. Kalsan was granted bail by a Hansi court in the case. However, soon after his release, Hisar Police arrested him in the latest case related to the alleged assault. The FIR against advocate Kalsan was registered at the City Police Station on the complaint of Hansi special staff sub-inspector Ravikant under various non-bailable charges. Advocate Kalsan has been a prominent figure in Dalit activism, recently joining protests after the death of a youth named Ganesh in a DJ-related dispute in Hisar. He has also advocated for justice in the Bhatla case in Hansi and was a key legal representative in the high-profile 2010 Mirchpur Dalit atrocity case in the Narnaund region. Complaint submitted to NHRC Hisar-based advocate and social worker Bajrang Indal has submitted a joint complaint to the National Human Rights Commission (NHRC) and the National Commission for Scheduled Castes regarding the manner of Rajat Kalsan's arrest. The advisory comes in the wake of a string of attacks on Indian nationals in Ireland. Meanwhile, officials say the matter has been taken up with the relevant Irish authorities in Dublin and also in Delhi. 'There has been an increase in instances of physical attacks reported against Indian citizens in Ireland recently. The Embassy is in touch with the authorities concerned in Ireland in this regard,' the advisory said. 'At the same time, all Indian citizens in Ireland are advised to take reasonable precautions for their personal security and avoid deserted areas, especially at odd hours,' it said, issuing emergency contact numbers for help. Last Sunday, a 32-year-old Indian-origin man, Santosh Yadav, was attacked by six teenagers in his Dublin apartment, leaving him with a fractured cheekbone. In a separate attack, a 40-year-old Indian man was beaten and stripped by a group of teenagers, raising concerns over the surge in racially motivated violence in the country. The authorities are now investigating the matter as a potential hate crime case. 'The recurrence of attacks on innocent, highly qualified technical experts and professionals has caused widespread fear among the community all over Ireland,' an Embassy official told The Indian Express over phone.
