The Attorney-General's Chambers (AGC) today reminded civil servants that their constitutional rights have legal boundaries, particularly when joining public rallies.
In a statement today, the AGC said civil servants are subject to the Oath of Office as provided for in subregulation 20(3) of the Public Officers (Appointment, Promotion, and Termination of Service) Regulations 2012.

KUALA LUMPUR: The High Court has dismissed Health Minister Datuk Seri Dr Dzulkefly Ahmad's application to recuse Judicial Commissioner (JC) Arziah Mohamed Apandi from presiding over his defamation suit against former prime minister Datuk Seri Najib Razak over a Facebook post alleging cronyism. In delivering her decision, JC Arziah held that the plaintiff had failed to demonstrate any real danger of bias arising from her prior case management directions or from the fact that she is the daughter of former attorney general Tan Sri Mohamed Apandi Ali. "The relationship is between my father and the defendant (Najib) – not between myself and any party. There is no evidence of any continuing relationship between my father and the defendant beyond a brief court appearance as a witness in 2019. "My father ceased to hold office at the AGC in 2018, which is seven years ago. Any connection to this litigation is tenuous and historical," she said. Arziah further stated that the court found no evidence of actual bias or circumstances that would lead a reasonable observer to conclude it exists. "The application is accordingly dismissed," she said. On April 14 this year, Dzulkefly filed an application to recuse Arziah, citing alleged bias stemming from remarks made by the JC during case management proceedings held on March 7 and April 7. He contended that those remarks, which touched on the possibility of striking out the matter, gave rise to actual bias or, at a minimum, a perception of bias. Dzulkefly further argued that JC Arziah's position as the daughter of former attorney general Mohamed Apandi, who was appointed to the post in 2016 by the defendant, Najib, also raised grounds for actual bias or a reasonable apprehension of bias. Dzulkefly filed the defamation suit in his personal capacity in January 2022, alleging that Najib had published a defamatory Facebook post on Aug 24, 2020, relating to allegations of cronyism. The post was accompanied by a screenshot of a Sinar Harian article dated Jan 28, 2019, which featured the plaintiff's photograph. The plaintiff alleged that the impugned statement implied, among other things, that he engaged in cronyism by awarding positions or appointments to relatives without any objective assessment of their qualifications or suitability for roles in government or private entities. He further claimed that the defendant had published the statement with the intent to attack his character, degrade and humiliate him, and that the post was politically motivated with the express purpose of defaming him and tarnishing his reputation. In his statement of defence filed on March 29, 2022, Najib contended that the Facebook post in question, which touched on the issue of cronyism, did not refer to Dzulkefly personally but was directed at the Pakatan Harapan coalition. – Bernama

PUTRAJAYA, July 28 — The Enforcement Agency Integrity Commission (EAIC) said today it found abuse of power and procedural weaknesses in the issuance of medical visas to foreign nationals by Immigration Department officers. It has since referred its findings to the Attorney General's Chambers (AGC), recommending charges against the officers under the Penal Code, the Immigration Act 1959/63, and/or the Passports Act 1966. 'The Special Task Force found that there was abuse of power by Immigration officers who approved medical visas for foreign nationals from several countries,' it said in a statement here. '[This is despite them] being aware that the applications submitted were incomplete and did not comply with the provisions outlined in Immigration Circular No. 10/2001.' It said the investigation was carried out by a Special Task Force formed under Section 17 of the Enforcement Agency Integrity Commission Act 2009, and led by EAIC Commissioner Datuk Seri Razali Ab. Malik. The task force had reviewed irregularities in the medical visa approval process, including an examination of procedural compliance, witness interviews, document seizures, and the preparation of appropriate recommendations for further action by the authorities. In October last year, EAIC said it seized 156 Social Visit Pass (Medical Treatment Pass category) application files believed to be linked to a medical visa syndicate involving Immigration Department officers. This came after Immigration Department director-general Datuk Zakaria Shaaban confirmed that the EAIC had visited the Immigration headquarters to conduct further investigations into alleged breaches of integrity involving officers from the department. Reports stated that the syndicate, which had allegedly been operating for some time, had granted medical visas to foreign nationals to enter the country, supposedly for medical services. In February this year, Home Minister Datuk Seri Saifuddin Nasution Ismail said the EAIC had called in 22 Immigration Department officers to assist in the investigation.

KUALA LUMPUR, July 27 (Bernama) -- The Works Ministry (KKR) has acknowledged the legal proceedings involving one of its civil servants, who was charged under the Penal Code at a Magistrate's Court here two days ago. In a statement issued today, the ministry said its Disciplinary Board will convene soon to ensure that the legal process is not disrupted and that the matter is handled in accordance with the Public Officers (Conduct and Discipline) Regulations 1993. "KKR will not compromise on any misconduct that could tarnish the image of the public service and the ministry. Internally, we continue to implement awareness, education and intervention programmes as preventive measures.
