Allahabad HC directs GDA to maintain status quo on demolition notice
Prayagraj(UP), Aug 2 (PTI) The Allahabad High Court has directed that status quo be maintained with regards to the demolition notices issued by Ghaziabad Development Authority (GDA) over alleged illegal properties built on public land. Hearing a writ petition, a division bench comprising Justice Mahesh Chandra Tripathi and Justice Prashant Kumar granted time to the district administration and GDA to place on record how they intend to rehabilitate the old inhabitants of the properties. The court also restrained the petitioners from creating any third-party interests or undertaking any development on the disputed property. The court also observed, 'In the facts and circumstances of the case, we also find that it is not in dispute that the petitioners have been occupying the place for the last 40-50 years." 'At this stage, we find that some indulgence and reprieve is to be accorded to the inhabitants who belong to the weaker sections of society and we further direct the authorities to ensure the formulation and implementation of a rehabilitation scheme for such persons," it said. The bench said the rehabilitation scheme shall be provided by the district administration and the GDA in the next hearing. The next hearing is listed for August 22. The petitioners filed the present writ petition for quashing the demolition notice dated June 16, 2025, issued by the GDA under section 26-A of the UP Urban Planning and Development Act, 1973. The GDA initially issued notice to 172 illegal occupants of public land on September 6, 2024, which is earmarked in the master plan. Consequently, 89 persons filed their objections which were considered and the impugned order (order under challenge) was passed. During the course of hearing, the counsel for the petitioner submitted that the petitioners are old inhabitants and in absence of any rehabilitation scheme as per the law, the old inhabitants, who are occupying small pieces of land for their shelter and admittedly belong to the lower sections of society, will suffer irreparable loss, if uprooted. After hearing both sides, the court in its order dated July 31 passed the above directives and observed, 'It is informed that in response to the earlier court's order, till date the GDA has not taken any remedial measures to rehabilitate the persons who were in illegal occupation for the last 40 years." A shocking triple murder has emerged from Uttar Pradesh's Ghazipur, where a man allegedly killed his parents and sister with an axe and was later arrested by the police. The accused reportedly confessed that a land dispute and ongoing family tensions led him to carry out the killings. According to a report by Amar Ujala, the incident took place on July 27 in Diliya village, which falls under the jurisdiction of Khanpur police station. The victims were identified as Shivram Yadav (65), his wife Jamuni Devi (60) and their daughter Kusum Devi (36). They were killed outside their home with an axe. Days after the brutal attack, their son Abhay Yadav alias Bhuttan Yadav was arrested near Chaukia crossing on Thursday night. Following the triple murder, a named FIR was reportedly registered against Abhay Yadav by a family relative, Amar Nath. The police then launched a search operation to locate him. According to Ghazipur ASP (City) Gyanendra Prasad, teams were deployed and the accused was eventually tracked down. He was arrested around 2 AM near the Chaukia crossing area, Amar Ujala reported. The accused reportedly told police that his sister, Kusum Devi, had gone through two marriages, both of which ended in disputes. As per Amar Ujala, her first marriage took place in Jaitpura and dowry was given by the family at the time. But the relationship did not last and ended after conflicts. Later, she was married again in Hatikhana, but that relationship also broke down. He also said that his sister's two failed marriages had become a major source of tension at home. According to the report, he believed these incidents had brought embarrassment to the family and led to frequent arguments. He also alleged that Kusum had started to dominate family matters and had turned their parents against him. Property Transfer To Sister Created Rift Another major point of conflict, as per the police interrogation, was a land dispute. The accused reportedly said that a piece of land had been transferred in Kusum Devi's name. He alleged that his sister took control of the property through their parents' support. As per the Amar Ujala report, the accused told police that a heated argument broke out in the family before the murders. Kusum Devi was also present during this confrontation. In a fit of rage, Abhay allegedly attacked her with an axe first. He then turned to his mother and father and killed them as well. As of now, Abhay Yadav remains in police custody. Court rap for ED over ‘misleading' post on raid on Jain's premises
New Delhi: A court has criticised the Enforcement Directorate for posting information in a misleading manner on its X account in 2022 regarding a search on the premises of AAP functionary and the then Delhi govt minister Satyendar Jain . The agency should act "impartially", the court observed. The observations came on Thursday from the court of special judge Jitendra Singh while upholding the Feb 20 order of a trial court that there was no prima facie case to proceed against BJP parliamentarian Bansuri Swaraj under criminal defamation provisions. Jain had filed a defamation case against Swaraj over her comments made on the basis of ED's post. "It is incumbent upon an investigative agency such as ED to act impartially and uphold the principles of fairness and due process. Any dissemination of information, including but not limited to official social media platforms, must be accurate, non-misleading and free from sensationalism," the judge pointed out. The judge said the manner in which the phrase "at the premises of Satyendar Kumar Jain and others" was used in the tweet tended to create an impression that the recoveries were made from the former minister's premises. The subsequent inclusion of the phrase, "and others", in a subtle and ambiguous manner, following the explicit naming of Jain, failed to clearly attribute the recoveries to "others" whose residences were also raided, he added. Jain, who was arrested in May 2022 on allegations of money laundering, had challenged the Feb 20 order by a magisterial court, declining to take cognisance of his defamation case against Swaraj. In his complaint, Jain alleged that Swaraj had made defamatory statements against him during an interview aired on Oct 5, 2023, on a news channel, to tarnish his image. He added that the statements were made in the context of an ED raid at his house.
