Centre clears appointment of 2 judges in Bombay HC
New Delhi: The Centre on Friday cleared the appointment of two additional judges to the Bombay High Court following the recommendation made by the Supreme Court Collegium. "In exercise of the power conferred by clause (1) of Article 224 of the Constitution of India, the President is pleased to appoint S/Shri (i) Gautam Ashwin Ankhad and (ii) Mahendra Madhavrao Nerlikar, to be Additional Judges of the Bombay High Court for a period of two years, in that order of seniority, with effect from the date they assume charge of their respective offices," said a notification issued by the Union Ministry of Law and Justice. In September last year, the apex court Collegium, headed by then CJI D.Y. Chandrachud, recommended for elevation of advocates Ankhad and Nerlikar to the Bench of the Bombay High Court. In a statement, the SC Collegium said that advocate Ankhad has expertise in commercial, contract and arbitration cases. "The candidate's average net professional income of Rs 226.55 lakhs for the last five years is indicative of the fact that he has a substantial practice. He has 56 reported judgments delivered in cases in which he appeared/argued," added the statement. Advocate Nerlikar, who belongs to a Scheduled Caste, has an experience of more than two decades in civil, criminal, constitutional, labour and service cases. "He has represented the Government of Maharashtra at the Aurangabad Bench in the capacity of Assistant Government Pleader and Additional Public Prosecutor from 2013 to 2023 and has been representing as an Additional Government Pleader and Additional Public Prosecutor since November 2023," the SC Collegium had noted. As per the memorandum of procedure (MoP) governing the appointment of High Court judges, the proposal for the appointment should be initiated by the Chief Justice. The Governor, as advised by the Chief Minister, should forward his recommendation along with the entire set of papers to the Union Minister of Law & Justice as early as possible, but not later than six weeks from the date of receipt of the proposal from the Chief Justice of the High Court. The Union Minister of Law & Justice would consider the recommendations in the light of such other reports as may be available to the government in respect of the names under consideration. The complete material would then be forwarded to the Chief Justice of India (CJI) for his advice. The CJI would, in consultation with the two seniormost Judges of the Supreme Court, form his opinion in regard to a person to be recommended for appointment to the High Court. After their consultations, the Chief Justice of India will, in the course of 4 weeks, send his recommendation to the Union Minister of Law & Justice. Further, as per the MoP, as soon as the warrant of appointment is signed by the President, the Secretary of the Department of Justice will inform the Chief Justice, and a copy of such communication will be sent to the Chief Minister. He will also announce the appointment and issue the necessary notification in the Gazette of India.

‘Why is socialist and secular in BJP's constitution': Amid Preamble row, Kharge's retort
Congress president Mallikarjun Kharge asked the Bharatiya Janata Party Friday why it had included the words 'socialist and secular' in the party constitution when leaders of the Rashtriya Swayamsevak Sangh were calling for their removal from India's Preamble. At a public meeting attended by Congress workers from across Telangana, Kharge read out Article II of the BJP constitution which read: 'The Party shall bear true faith and allegiance to the Constitution of India as by law established and to the principles of socialism, secularism and democracy and would uphold the sovereignty, unity and integrity of India'. Commemorating 50 years of the imposition of the Emergency at an event last month, RSS general secretary Dattatreya Hosabale called for a discussion on whether the words 'socialist' and 'secular' should remain in the Preamble of the Constitution because 'they were added later'. Without naming Hosabale, Kharge, who was speaking at an event called 'Jai Bapu, Jai Bhim, Jai Samvidhan', said: 'Now an RSSwala wants to change the preamble of the constitution by removing the words secular and socialist. I challenge you, BJP, (Prime Minister Narendra) Modi, (Home Minister Amit) Shah and everyone. No one can change or remove this (from the constitution). It is my challenge. You won't be able to do so'. Criticising the current BJP rule in the Centre, Kharge said: 'Modiji has visited 42 countries, but he has not visited our own Manipur. Manipur where rape, violence is happening. Why is Modi silent about Manipur? Rahul Gandhi and I went there. Modi has not even peeped into Manipur to see what's happening there'. About the Pahalgam terror attack, Kharge said: 'We had stood behind the country and the soldiers of the country when the terror attack happened. But why did Modi leave the war in the middle? He did not make use of the chance he got to square with Pakistan,' he said. Coming down heavily on US President Donald Trump's announcement that he 'brought peace' between India and Pakistan, Kharge said, 'Why is Modi silent about Trump's announcement'. He added that India's foreign policy has made enemies out of countries everywhere. Kharge added, 'We will teach BJP a lesson. The Congress party will come to power in the Centre…Modi and Shah will leave Delhi when this happens'. In Telangana, Kharge said that 42 percent reservation for Backward Classes will be implemented in educational and employment and local body elections. 'We will not stop till the BC reservation is implemented in the state,' Kharge said, congratulating the state government for conducting the caste survey. In the meeting which was held to boost the morale of Congress workers at the booth and local body levels, Kharge said that every development programme implemented by the state should reach 'each household'. He exhorted workers to relay the welfare measures of the Congress including those for farmers, women and youth to the grassroots.

The portal was launched in the presence of chief justice DK Upadhyay and justice Prathiba M Singh, chairperson of Delhi high court's internal complaints committee (ICC). 'Any such act which negates the conducive atmosphere of the workplace has to be forbidden or prohibited. Sexual harassment demeans women, acts as a barrier to her creativity, slows down the efficacy causing immense mental and physical trauma, which is completely antithetical to the enabling principle of equality, liberty and justice– which forms the core values of the Constitution,' he said. He added, 'This menace, has to be taken head on and it is from this perspective that lies the significance and importance of this act and also assumes importance of the fact that today large number of women are joining and becoming partners in nation building exercise and are contributing meaningfully in all walks of life, which were exclusively reserved for men. There is a paradigm shift that is taking place, therefore it is incumbent on all of us to ensure that the workplace remains safe, secure, encouraging and not plagued by these insidious practices.' In his speech the judge also laid emphasis on some of the aspects that act as hurdle in ensuring a safe workplace for women including the cultural resistance in acknowledge certain acts of sexual harassment, mindset that women's role is confined to domestic sphere. 'One of the greatest challenge is the deep rooted cultural resistance in acknowledging certain acts of sexual harassment. In fact many organisations consider these complaints of sexual harassment as a threat of their reputation, rather than providing opportunities of growth. There is a need to sensitise the people that there are certain acts which are prohibited, which cannot be tolerated,' he said. Justice Singh said that it is important for men to understand what makes a female counterpart uncomfortable and to extend help or cooperation in case they face inappropriate behaviour. 'It is also equally important for men to extend help or cooperation whenever such a woman faces any such kind of inappropriate behaviour from the men. Not only cooperation but empathetic attitude. Certainly not sympathy. Because what women require is not an act of charity, but it is a solemn obligation on all of us to ensure the dignity of women,' he said.
